Sanborn Late of the City of Scranton County of Lackawanna and State of Pennsylvania Deceased I Fannie W. Sanborn, testatrix, of the City of Scranton, County of Lackawanna and State of Pennsylvania, being of sound disposing mind, and memory, considering the uncertainty of life and being desirous of settling my worldly affairs while I have strength and capacity, do make this my last will and testament, hereby revoking all former wills by me at the time heretofore made. As to such estate as it hath pleased God to entrust me with, I give, bequeath and devise and hereinafter appearing. FIRST - I direct that my body be buried in my lot in the cemetery at Clark's Green, Lackawanna County, Pennsylvania, and that my executor hereinafter named shall expend the sum of fifty dollars ($50.00) from my residuary estate, as hereinafter provided, for a tombstone, to be erected over my grave, similar to the tombstone now over my mother's grave in my said lot. SECOND - I direct that all my just legal debts be paid by my executor hereinafter named, so soon after my decease as shall be consistent with a speedy settlement of my estate. THIRD - I give, bequeath and devise unto my executor hereinafter appointed, his heirs, successors and assigns, my house and lot, being numbered 1334 Penn Avenue, in the City Of Scranton, Lackawanna County, Pennsylvania, in trust, however, to sell said house and lot, either at private or public sale at his discretion, so soon after my decease as may be practicable in the discretion of my said executor , for such consideration and upon such terms as may be approved by my said executor and from the proceeds of said sale, I direct my said executors first to pay all my just and lawful debts and the expenses of the administration of my estate, and from the balance I direct him to pay the following legacies in full or pro tanto, according to the amount which may be received by my said executor for said property and I do authorize and empower my said executor to execute all necessary papers to effect said sale and to deliver a deed or deeds to the purchaser or purchasers . Any possible balance of said proceeds, after the payment of the following legacies or bequests, shall form a part of my residuary estate, as hereinafter provided. FOURTH - To Mary Wickizer Boucher, my niece of Avant, Oklahoma, I give and bequeath in cash the sum of Four Hundred Dollars ($400.00) FIFTH - To Leah Stone Holden, my niece of Egg Harbor, New Jersey I give and bequeath in cash the sum of Four Hundred Dollars ($400.00) SIXTH - To Esther Fannie Cahoon, my niece of Bath Beach, in the State of New York, I give and bequeath in cash the sum of Four Hundred Dollars ($400.00) SEVENTH- To Lovisa Cahoon Hartwick, my niece, I give and bequeath in cash the sum of Four Hundred Dollars ($400.00) EIGHTH - To Joseph G. Cahoon, my nephew, of Bath Beach, in the State of New York, I give and bequeath in cash the sum of Four Hundred Dollars ($400.00) NINTH - To Esther M. Wickizer Cahoon, my sister, of Bath Beach, in the State of New York, I give and bequeath in cash the sum of Five Hundred Dollars ($500.00) TENTH - To Jerome P. Wickizer, my brother of that part of the City of Scranton, known as Providence, Lackawanna County, Pennsylvania, I give and bequeath in cash the sum of Five Dollars ($5.00) ELEVENTH - To Guy Whiting Sanborn, my husband's nephew, who was brought up by me and cared for as a mother, of Fleetville, Lackawanna County, Pennsylvania, I give and bequeath in cash the sum of Four Hundred Dollars ($400.00) , subject to a deduction of any sum which he may be indebted to my estate either upon endorsements or otherwise. TWELFTH - To Otis M. Stone, my nephew, whose present whereabouts are unknown, I give and bequeath in cash the sum of Three Hundred Dollars ($300.00). If, however, his whereabouts cannot be ascertained by my executors at any time within one year from the time of my death, his bequest or legacy of three hundred dollars ($300.00) Shall lapse and revert to my residuary estate, to be distributed by my executor as hereinafter provided. THIRTEENTH - I give and bequeath to Mary Wickizer Boucher, above named, all my wearing appeal, whether made up or in dress goods not made up, and all my jewelry to be her by by my executor immediately after my death. FOURTEENTH - I direct that my executor shall sell at public sale vendue or auction, or at private sale at his discretion, all my household furniture, bedding and carpets, and all my personal property of whatsoever kind and description not herein specifically bequeathed, as soon after my death as may be practicable in the discretion of my said executor, and I direct that my said executor shall add the proceeds thereof to my residuary estate, to be distributed as hereinafter provided. FIFTEENTH - I do hereby give and devise unto my faithful sister, said Esther M. Wickizer Cahoon, of Bath Beach, in the State of New York, her heirs and assigns forever, in addition to the bequest hereinafter appearing, my vacant lot known as the Lovisa Wickizer property situate in South Abington Township, Lackawanna County, Pennsylvania. SIXTEENTH - Joseph P. Sanborn, my husband has willfully and maliciously deserted me continuously for the past seven or eight years and he doth still persist in his desertion and during all that time he has contributed nothing to my support and has abandoned me and left me to struggle alone and he has forfeited his right to participate in my estate, as I am advised is provided by law in the case of a deserting husband. But nevertheless, I authorize and direct my executor to set apart in bank the sum of One Hundred and Twenty Five Dollars ($125,00) from my residuary estate hereinafter provided, to be expended by him for the burial expense of my said husband, whenever he may die, provided, however, that he shall be buried in our family cemetery at Clark's Green, Lackawanna County, Pennsylvania; otherwise, said one hundred and twenty- five dollars ($125.00) shall lapse and become a part of my said residuary estate. SEVENTEENTH - After the payment of all charges against my residuary estate, as hereinafter provided, I give and bequeath the balance of my residuary estate unto Mary Wickizer Boucher, Leah Stone Holden, Esther Fannie Cahoon, Lovisa Cahoon Hartwick, Joseph G, Cahoon, Esther M. Wickizer Cahoon, Guy Whiting Sanborn, Otis M. Stone, all hereinafter mentioned, in equal shares, share and share alike. And as to the share of Otis M. Stone, if his whereabouts should not be ascertained by my executor at any time within one year from the time of my death, his share then in my residuary estate shall lapse and be divided equally among the other legatees whose names are mentioned in this paragraph. EIGHTEENTH - If any of said legatees should die before my decease, I direct that his, her, or their legacies, as hereinafter bequeathed shall not go to any heir, child or children, or heirs of said deceased legatee or legatees, but that said legacies or bequests so lapsed aforesaid, by death, shall be added to my residuary estate and be distributed by my executor, as provided in the seventeenth paragraph of this my last will and testament. NINETEENTH - I hereby nominate and appoint my good friend Adam Hartwick, of Clark's Summit, Lackawanna County, Pennsylvania, sole executor of this my last will and testament. I, Fannie W. Sanborn, testatrix, have to this my last will and testament set my hand and seal this Day of June in the year of our Lord one thousand nine hundred and thirteen (A.D. 1913) Fannie Sanborn (Seal) Signed, sealed, published and declared by the above named Fannie W. Sanborn as for her last will and testament in the presence of us, who have hereunto subscribed our names at her request as witnessed thereto, in the presence of said testatrix and of each other. Thos. J. Price. Chas A. Nicholson. Now, March 27th A.D. 1918, Adam Hartwick appears and being duly sworn says that Fannie W. Sanborn died the 22nd day of March A.D. 1918. REGISTER'S OFFICE, State of Pennsylvania, Lackawanna County, SS.: Scranton, Pa. March 27, 1918. Then personally appeared Thomas J. Price and Chas A. Nicholson, the subscribing witnesses to the foregoing last will and testament of Fannie W. Sanborn, late of the City of Scranton in said County and State, deceased, bearing date June - 1913, and on their solemn oath they say that they were present and did see and hear Fannie W. Sanborn deceased, the testatrix therein named, sign by writing her name seal, publish and declare the same as for her last will and testament and that at the doing thereof she was of sound disposing mind, memory and understanding to the best of their knowledge and belief. State of Pennsylvania, Lackawanna County, SS.: Be it Remembered that on the 27th day of March A.D. 1918 before Thomas Beyon, Register of Wills for the County of aforesaid, after due proof and hearing had, according to the laws of the said State, IT IS ORDERED AND DECREED, that the last will and testament of Fannie W. Sanborn late of the City of Scranton, in said County, deceased, and dated June 1913, be duly admitted to probate and filed of record in the office of the Register of Wills of said County. IN TESTIMONY WHEREOF, I have hereunto set my hand the day and year above written. Thomas Beynon Register. State of Pennsylvania, Lackawanna County, SS.: In conformity with the above and foregoing will and the probate thereof letters testamentary thereon were this the 27th day of March, A.D. 1918, duly granted unto Adam Hartwick in said testament named, he having first been duly sworn to well and truly to administer the goods, chattels, rights and credits which were of Fannie W.
