All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Romaine Stauffer staufferhof@cocast.net October 10, 2020, 8:14 am Written: November 5, 1842 Unrecorded Lancaster County deed This Indenture made the Fifth day of November Eighteen hundred and forty two, Between Christian Musselman of Earl township Lancaster County and State of Pennsylvania and Mary his wife of the first part and their son John Musselman of the same place of the second part, Witnesseth that the said Christian Musselman and Mary his wife for and in consideration of the sum of Three thousand dollars by the said Christian hereby irrevocably given, allowed and advanced to his said son John as a part of his share of the said Christian's estate, and to be by the said John accounted for in the distribution of his said fathers estate, as so much by him absolutely but irrevocably received in part of his share of his said fathers estate, and for and in consideration also of the sum of Four thousand five hundred and twenty dollars to them the said Christian Musselman and Elizabeth[Mary] his wife in hand paid by their said son John Musselman at and before the ensealing and delivery hereof the receipt whereof is hereby acknowledged, they the said Christian Musselman and Mary his wife Have granted, bargained, sold, aliened, enfeoffed, Released and confirmed and by these presents Do grant, bargain, sell, alien enfeoff, release and confirm unto their son John Musselman and to his heirs and assigns, all those two certain pieces or tracts of land in said Earl township, bounded as follows, to wit One thereof, a plantation with a dwelling house, barn and other buildings thereon, Beginning at a stone a corner of lands of John Bachman and David Huber, thence by land of the said John Bachman South twenty degrees and a quarter East fourteen perches and five and a half tenths to a stone, thence by the same North seventy three degrees East fourteen perches and five and a half tenths to a stone, thence by the same North six degrees west thirteen perches and two tenths to a stone, thence by land of David Huber north eighty two degrees East twenty six perches and two tenths to a stone, thence by land of Solomon Diller South three degrees and three quarters East seventy four perches and three tenths to a stone, thence by the same and land of David Rife South eighty five degrees and a half west one hundred and twenty one perches and nine tenths to a stump, thence by land of said Daniel Rife South three degrees and three quarters west thirty nine perches to a [word missing] tree, thence by the same South eighty three degrees and three quarters west fifty one perches and one tenth to a stone in the middle of a public road, thence along said road by other land of the said Christian Musselman North four degrees and a quarter west ninety two perches and nine and a half tenths to a stone in the middle of said road, thence by land of David Huber North seventy two degrees East Seventy perches and five and a half tenths to a stone, thence by the same South twenty degrees and a quarter East twelve perches and a half to a stone, thence by the same North seventy two degrees East sixty three perches and four tenths to the place of Beginning Containing Eighty four acres and one half neat measure. Being made up and composed of those two certain pieces or tracts of land, to wit, The one thereof that certain piece or tract of eighty five acres which David Hoover and Ester his wife by deed bearing date the first day of April Eighteen hundred and twenty five, Recorded in the Recorders office in and for said county in Book D vol 5 page 538 did grant and confirm unto the said Christian Musselman first party hereto in fee, Excepting from and out of the said eighty five acres a certain part thereof containing five acres and ninety perches, heretofore sold by the said Christian Musselman and wife to Daniel Rife. And the other of the said two pieces of land included in the said tract of Eighty four acres and a half, being that certain piece or tract of five acres and ten perches of land which Solomon Diller and wife by deed of date the twenty fourth of March eighteen hundred and thirty six did grant and confirm unto the said Christian Musselman first party hereto his heirs and assigns. And the other of the said two pieces of land, Beginning at the South East corer thereof, a stone thence by land of David Hoover north three degrees and a quarter west thirty one perches and six tenths to a stone, thence by land of George Sprecher and William Sprecher South eighty six degrees and one quarter west forty eight perches and eight tenths to a stone, thence by land of Samuel Musselman South five degrees East thirty one perches and six tenths to a stone, thence by remaining land of the said Christian Musselman North eighty six degrees and a quarter East forty seven perches and seven tenths to the place of Beginning Containing nine acres and a half. Being a part of a certain tract of about one hundred and one acres of land of which Christian Musselman Senior became in his life time lawfully seized in his demesne as of fee and being so seized did by his last will and testament in writing bearing date the [blank] duly proved and remaining in the Registers office of said county, give and devise unto his son the said Christian Musselman first party hereto and to his heirs and assigns. Together with all and singular the buildings and improvements, rights, liberties, privileges, hereditaments and appertenances unto the said described two pieces of land belonging or in any wise appertaining, and the Revisions and remainders, Rents, issues and profits thereof, and also all the estate, right, title, interest, property, claim and demand, whatsoever of them the said Christian Musselman and Mary his wife, of, in, to or out of the same. To have and to Hold the said above described and hereby granted two pieces or tracts of land, one hereof containing Eighty four acres and a half and the other containing nine acres and a half with their respective appertenances unto the said John Musselman his heirs and assigns to the only proper use and behoof of the said John Musselman his heirs and assigns forever. And the said Christian Musselman for himself, his heirs, executors and administrators does covenant, promise, grant and agree to and with his said son John Musselman his heirs and assigns by these presents, That he the said Christian Musselman and his heirs, the said above described and hereby granted two pieces or tracts of land, with their respective appertenances, unto the said John Musselman his heirs and assigns, against him the said Christian Musselman and his heirs and against all and every other person and persons whomsoever lawfully claiming or to claim, shall and will warrant and forever defend by these presents. In witness whereof the said parties to these presets have hereunto interchangeably set their hands and seals the day and year first above written. Sealed and delivered in presence of us Martin Luther Roland Diller Received on the day of the date of the above written indenture of and from my above named son John Musselman the sum of Four thousand five hundred and twenty dollars, which with the said allowance or advancement by me hereby to his irrevocably made, is in full of the consideration money above mentioned. Before me the subscriber one of the justices of the peace in and for said county personally came the above named Christian Musselman and Mary his wife and acknowledged the above written indenture to be their act and deed and desired that the same might be recorded as such according to law. The said Mary being of full age and by me duly examined separate and apart from her said husband and the contents of the said indenture by me being fully made known to her, she on the said separate examination declared that she did voluntarily and of her own free will and accord seal and as her act and deed deliver the said indenture without any coercion or compulsion of her said husband.
