Carpenter & Ux to Jacob Shertz } THIS INDENTURE made the twelfth day of June in the year of our Lord one thousand seven hundred and seventy five. BETWEEN Emanuel Carpenter of the township of Earl in the county of Lancaster and Province of Pennsylvania Esquire and Catharina his wife of the one part and Jacob Shertz of the township of Bart in the county of Lancaster and Province of Pennsylvania aforesaid yeoman of the other part. WHEREAS Isaac Lefevre and Daniel Fierree made a purchase of the Honourable the proprietary of the province of Pennsylvania of two thousand three hundred acres of land and the usual allowance in joint tenancy as by patent confirmed by the said proprietary unto the said Isaac Lefevre and Daniel Fierree under the great seal of the province aforesaid and recorded in the rolls office at Philadelphia in patent Book A. Vol. 7 page 319 and dated the sixth day of November A. D. 1735 referrence thereunto had may fully appear. AND WHEREAS the said Isaac Lefevre and Catharina his wife Daniel Fierre and Anna Maria his wife by their certain indenture bearing date the sixth day of December A.D. 1744 for the consideration mentioned did grant and confirm unto Thomas Faulkner his heirs and assigns among other things or lands a certain tract or parcel of land containing one hundred and eighty five acres being part of the above mentioned two thousand three hundred acres. To hold to him the said Thomas Faulkner his heirs and assigns forever. AND WHEREAS the said Thomas Faulkner and Jeane his wife by their indenture bearing date the twentieth day of June A. D. 1746 for the consideration therein mentioned did grant and confirm unto Philip Fieree his heirs and assigns forever all the above mentioned tract of one hundred and eighty five acres of land by metes and bounds as in and by the said indenture reference thereunto being had may fully and at large appear. AND WHEREAS the said Philip Fierree and Leah his wife by their indentures of lease and release bearing date the fourteenth and fifteenth day of April A.D. 1748 for the considerations therein mentioned did grant and confirm unto their son Joel Fierree his heirs and assigns forever all that last above mentioned tract or parcel of land by metese and bounds as in and by the said indenture duly executed reference thereunto being had may more fully and at large appear. AND WHEREAS the said Joel Fierree and Mary his wife by their indentures of lease and release bearing date the sixteenth and seventeenth days of April A.D. 1752 for the consideration therein mentioned did grant and confirm unto his brother Jacob Fierree and to his heirs and assigns forever the one moiety or half part of the above described tract of land the said moiety containing ninety two acres and one half of an acre of land by metes &c as in and by the said indenture reference thereunto being had fully appears. AND WHEREAS the said Jacob Feree and Barbara his wife by their certain indentures of lease and release bearing date the first and second days of August in the year of our Lord one thousand seven hundred and fifty three for the consideration therein mentioned did grant bargain sell alien enfeoff and confirm unto the said Emanuel Carpenter his heirs and assigns forever the above recited and hereinafter fully described tract of land and premises as by the same indentures recorded in the office for recording of deeds in and for the county of Lancaster in Book E. Page &c and in Book O Page 514 referrence thereunto being had may fully clearly and at large appear. NOW THIS INDENTURE WITNESSETH that the said Emanuel Carpenter and Catharina his wife for and in consideration of the sum of one thousand pounds lawfull money of the province of Pennsylvania to them or one of them in hand well and truly paid by the said Jacob Shertz at or before the ensealing and delivery of these presents the receipt and payment whereof are hereby acknowledge have and each of them hath granted bargained and sold aliened enfeoffed released and confirmed and by these presents do and each of them doth grant bargain and sell alien enfeoff release and confirm unto the said Jacob Shertz his heirs and assigns forever all that the hereafter described tract piece or parcel of land situate lying and being in the township of Leacock in the county and province aforesaid bounded and limited as follows viz: Beginning at a post a corner of Samuel Lefevres land thence by land late of Thomas Story north by west seventy one perches and one half of a perch to a post thence by land of John Feree west two hundred and nineteen perches to a post thence by land of Jacob Feree south by east twenty three perches to a corner stone standing by the saw mill damm thence by the said Damns side south sixty six degrees east sixteen perches south twenty two degrees east thirty seven perches to a white oak south thirty three degrees east twelve perches to a white oak thence by land of the said Samuel Lefevre east one hundred and ninety seven perches to the place of beginning containing eighty eight acres of land be the same more or less and it being the same tract or parcel of land which the above named Jacob Ferree and Barbara his wife granted conveyed and confirmed unto the said Emanuel Carpenter his heirs and assigns as is above already recited. TOGETHER with all and singular the houses out-houses edifices and buildings thereon erected and built barns stables fences gardens orchards meadows fields pastures woods underwoods ways paths passages waters and water courses rights liberties priviledges emoluments hereditaments and appurtenances whatsoever to the said land and premises hereby granted belonging or in anywise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof and of every part and parcel thereof and also all the estate right title possession use trust property claim and coman of them the said Emanuel Carpenter and Catharina his wife of in and to the same. TO HAVE AND TO HOLD the said messuage and tract or parcel of land of eighty eight acres and premises hereby granted or meant mentioned or intended so to be with their appurtenances unto the said Jacob Shertz his heirs and assigns to the only proper use benefit and behoof of him the said Jacob Shertz his heirs and assigns forever subject to the payment of the proportionable part of the yearly quitt rent to become due and payable for the same to the chief Lord or Lords of the fee thereof. AND the said Emanuel Carpenter for himself his heirs executors and administrators and for the said Catharina his wife doth covenant promise and grant to and with the said Jacob Shertz his heirs and assigns by these presents that they the said Emanuel Carpenter and Catharina his wife and all and every other person or persons whatsoever anything having or lawfully claiming in the said premises above granted and released or mentioned or intended so to be or any part thereof by from or under him them or any of them shall and will from time to time and at all times hereafter upon the reasonable request and the proper costs anc charges in the law of him the said Jacob Shertz his heirs and assigns make do and execute or cause and procure to be made done and executed all and every such further and other lawful and reasonable act and acts thing and things deed and deeds conveyances and assurances in the law whatsoever for the further better more sure and perfect granting converying and assuring the said eighty eight acres of land and promises with the appurtenances unto the said Jacob Shertz his heris and assigns as by him the said Jacob Shertz his heirs or assigns or his or their council learned in the law shall be reasonably advised or devised and required. AND lastly that the said Emanuel Carpenter his heirs executors and administrators the said hereby granted and released tract of land and premises with the appurtenances unto him the said Jacob Shertz his heirs and assigns against him the said Emanuel Carpenter and the said Catharina his wife and their heirs and against all and every other person and persons whatsoever lawfully claiming or to claim the same by from or under him them or any of them shall and will warrant and forever defend by these presents. In witness whereof the parties first above named to these presents their hands and seals interchangeably have set the day and year first above written. Witness present at singing: Everard Gruper John Carpenter Emanuel Carpenter LANCASTER COUNTY SS: On the twelfth day of June A.D. 1775 personally appeared before me the subscriber one of the justices of the court of common pleas in and for the county of Lancaster the above named Emanuel Carpenter Esqr. And Catharina his wife and acknowledged the above written indenture to be their act and deed and desired that the same may be recorded as such the said Cathaina being of full age voluntarily consenting thereto the above contents being first made known unto her.
