To Andrew Shover } THIS INDENTURE, MADE the sixteenth Day of May in the Year of our Lord one thousand seven hundred and eighty eight. BETWEEN Christian Eyer of Paxton Township in the County of Dauphin and State of Pennsylvania and Magdalena his Wife, of the one Part, and Andrew Shober of Warwick Township Lancaster County and State aforesaid, Mason of the other Part. WHEREAS the Honorable the Propriators of Pensylvania by their Patent dated the twenty third Day of May Anno Domini 1763, did grant and convey unto George Pfeil his Heirs and Assings, ALL THAT Tract of Land situate in Warwick Township aforesaid containing One Hundred and Thirty six Acres and a half and the allowance, as by said Patent recorded at Philadelphia in Patent book AA, Vol. 5, page 53 &c. may more fully and at large appear. AND WHEREAS the said George Pfeil and Veronica his Wife by their indenture dated the twenty seventh Day of June Anno Domini 1768, for the Consideration therein mentioned did grant and convey unto John Eyer and to his Heirs and Assigns forever, ALL THAT Piece or Parcel of Land bounded and described as follows, to wit, BEGINNING at a Black Oak a Corner of Arnold Becker's Land and from thence extending by Land of Samuel Huber South eighty eight degrees and a half West one hundred and forty four perches and a half to a post, thence by George Read's land North by East one hundred and sixteen perches to a White Oak, thence North seventy six degrees East eleven perches to a Hickhory, thence by Philip Byer's Land South twenty five degrees East twenty perches to a Stone, thence South eighty two degrees East twenty eight perches to a Sone, thence North fifty five degrees East, thirty four perches to a Sone, thence by Land of Jacob Huber and John Erb South East one hundred and twenty five perches and a half to a marked Black Oak, thence by Arnold Becker's Land South seventy degrees West forty seven perches to the Place of BEGINING. CONTAINING Eighty six Acres and Nine Perches and the Usual Allowance of six per cent for Roads and highways. (IT BEING Part of the said One Hundred and Thirty Six Acres and a half and allowance) may more fully and at large appear. AND WHEREAS the said John Eyer in his Life time whas seized and possessed of and in the said Tract of Land, and by the Last Will and Testament of the said John Eyer bearing Date the Twenty seventh day of October, Anno Domini 1776, and therein and thereby did give, devise and bequeath unto his Son Christian Eyer the said Eighty six Acres and Nine perches and allowance as aforesaid, and the same being granted and conveyed unto him the said Christian Eyer by Samuel Huber and Abraham Huber Executors fo the Last Will and Testament of the said John Eyer deceased, TO have and to hold to him his heirs or Assigns forever as by the said Indenture bearing Date the twenty eight Day of Aprill ANno Domini 1782, may more fully and at large appear. AND WHEREAS the said Christian Eyer and Magdalena his Wife by their Certain Indoresement on the Backe of the said Indenture bearing Date likewise the twenty eight day of Aprill Anno Domini 1782, and for the Consideration therein mentioned did grant and confirm the said Eighty six Acres and Nine Perches and Allowance unto Andrew Bets his Heirs and Assigns forever, may fully and at large appear. AND WHEREAS the said Andrew Bets and Catharina his Wife by their Indenture dated the sixteenth Day of August Anno Domini 1786, for the Consideration therein mentioned did grant and confirm the said Eighty six Acres and nine Perches and allowance unto Nicholas Kline his Heirs and Assigns forever, may more fully and at large appear. AND WHEREAS the said Nicholas Kline and Elizabeth his Wife by their certain Inenture dated the thirteenth Day of November in the Year of our Lord one thousand Seven hundred and eighty six for the Consideration therein mentioned did grant and confirm the said Eighty six Acres and Nine Perches and Allowance unto the above mentioned Christian Eyer his Heirs and Assigns forever, may more fully at large appear. NOW THIS INDENTURE WITNESSETH, that the said Christian Eyer and Magdalena his Wife for and in Consideration of the Sum of Two Hundred & Fifty seven Punds Specie lawfull Money of Pensylvania to them in Hand paid by the above said Andrew Shober at or before the Ensealing and Delivery ofthese Presents the Receipt whereof they do hereby acknowledge and thereof andof every Part thereof do acquit exonerate and discharge the said Andrew Shober his Heirs and Assigns by these Presents HAVE granted, brgained, and sold, aliened, enfeofed, released and confirmed, and by these Presents DO grant, bargain and sell, alien, release, enfeoff and convrim unto the said Andrew Whober his Heirs and Assigns forever ALL THAT the above mentioned and described Tract of Eighty six Acres and Nine Perches and Allowance and Promises as the same above set forth and described bounded and limited as aforesaid. TOEGETHER with all and singular the Houses, Out-Houses, Edifices and Buildings thereon erected and built, Profits, Commondities, Advantages, Emoluments, Hereditaments, and Appurtenances whatsoever to the same Premisses belonging or in anywise appertaining, and the Reversion and Reversions, Remainder and Remainders, Rents, and Services of all and singular the Premisses above mentioned and of every Part and Parcel thereof with the Appurtenances, and also all Deeds, Evidences and Writings touching or concerning the said Premises only or only any Part thereof now in the Custody or Possession of the said Christian Eyer or which he can or may come by without Suit in Law or Equity, and also all the Estate, Right, Title, Interest, Claim and Deman whatsoever as well in Law as Equity of the said Christian Eyer and Magdalena his Wife, of, in and to all and singular the hereby granted Premisses with the Appurtenances. TO HAVE AND TO HOLD the said Eighty six Acres and Nine Perches with the Hereditaments and all and singular the Premisses above mentioned and every Part and Parcel thereof with the Appurtenances unto the said Andrew Shober his Heirs and Assigns, TO the only Proper Use and Behoof of the same Andrew Shober his Heirs and Assigns forever. UNDER and SUBJECT to the Yearly Quit Rent now due or hereafter to become due thereunto the Chief Lords of Fee thereof. AND the said Christian Eyer and Magdalena his Wife their Heirs, Executors and Administrators do covenanat, grant and agree to and with the said Andrew Shober his Heirs and Assigns that the said Christian Eyer and Magdalena hiw Wife, their Hiers and Assigns, and all and every other Person or Persons and his and their Heirs any thing having or claiming in the said Premisses above granted or meant mentioned or intended so to be or any Part thereof by from or under him them or any of them shall and will from Time to Time and at all Times hereafter uponthe reasonable Request and at the Costs and Charges of the said Andrew Shober his Heirs or Assigns, make, do and execute or cause to be made done and executed all and every such further and other lawful & reasonable Act & Acts, Thing and Things, Device and Devices, Conveyances & Assurances in the Law whatsoever for the further better more sure and perfect granting conveying and assuring of all & singular the said Premisses with the Appurtenances unto the said Andrew Shober his Heirs and Assigns forever, as by him the said Andrew Shober his Heirs and Assigns forever, as by him the said Andrew Shober or his Heirs or Assigns or his or their Council learned in the Law shall be reasonably advised devised or required. AND that he the said Christian Eyer and Magdalena hiw Wife their Heirs the said Eighty six Acres and Nine Perches of Land and Premisses unto the said Andrew Shober and his Heirs and Assigns, against him the said Christian Eyer and Magdalena his Wife and their Hiers and against all and every other Person or Persons whatsoever lawfully claiming said Premisses or any Part thereof, by, from or under him, them or any of them, shall and will WARRANT and forever DEFEND by these Presents. IN WITNESS WHEREOF the said Parties to these Presents have hereunto interchangeably set their Hands and Seals the Day and Year first above written. Sauter LANCASTER COUNT, SS: Be it remembered that on the sixteenth Day of May Anno Domini one [sic] one thousand seven hundred & eighty eight, Before me the Subscriber one of the Justices of the Court of Common Please for said County, personally came the above named Christian Eyer, and Magdalena his Wife and acknowledged the above Indenture to be their Act and Deed and desired that the same might be recorded according to Law. The said Magdalena his Wife, being of lawfull age and by me privately examine, she voluntary thereto consented, as Witness my Hand & Seal the Day & Year first above written.
