Mentzer } This Indenture made the thirty first day of March in the year of our Lord one thousand eight hundred and fifty nine Between James Kerling of West Cocalico Township in the County of Lancaster and State of Pennsylvania, Yeoman of the one part And John W. Mentzer of the same place aforesaid, Yeoman of the other part. Witnesseth That the said James Kerling for and in consideration of the sum of one thousand and one hundred dollars lawful money of the United State to him well and truly in hand paid by the said John W. Mentzer at and before the ensealing and delivery hereof (the receipt and payment whereof he doth hereby acknowledge and thereof doth acquit and forever discharge the said John W. Mentzer his heirs, executors and administrators by these presents) Have granted, bargained, sold, aliened, enfeoffed, released and confirmed, and by these presents do grant, bargain, sell, alien, enfeoff, release and confirm unto the said John W. Maintzer and to his heirs and assigns, all that certain piece or tract of land situate lying and being in West Cocalico Township in the County of Lancaster aforesaid, Bounded and described by the lines and courses as follows, to wit: Beginning at a stone in a public road, thence by land of Christian Burkholder and Henry Hack, North ten degrees and a half, west fifty two perches and seven tenths of a perch, to a stone in said road thence by land of Henry Hauck south eighty eight degrees east sixty five perches to a stone thence by land of Peter Shirk south twenty six degrees west forty one perches and two tenths of a perch to a stone, Thence by land of Jeremiah Wiest and Christian Usener, north seventy four degrees west thirty four perches to the place of Beginning Containing thirteen acres and fifty perches strict measure [It being a part of a larger piece or tract of land containing sixteen acres and seventy nine perches and half of a perch and the usual allowance of six percent for roads and high ways which William H. Paul and Sousanna his wife by their Indenture bearing date the thirty first day of March Anno Domini one thousand eight hundred and forty six for the consideration therein mentioned did grant and confirm with other land unto the said James Kerling party hereto and to his heirs and assigns forever, as in and by the said in part recited Indenture relation being thereunto had will more fully and at large appear. And also it being a part of a smaller piece or tract of land containing three acres and fifty seven perches strict measure which Peter Shirk and Veronica his wife by their Indenture bearing date the fifth day of February Anno Domini one thousand eight hundred and forty seven for the consideration threin mentioned did grant and confirm unto the said James Kerling party hereto and to his heirs and assigns forever as in and by the said in part recited Indenture relation being there unto had will more fully and at large appear] Together with all and singular the House, out houses, edifices, and builings thereon erected and being; and all ways, waters, water-courses, woods, trees, fences, gardens, orchards, rights, liberties privileges, advantages, hereditaments and appurtenances whatsoever there unto belonging or in any wise appertaining, and the reversions and remainders rents, issues and profits thereof And also all the estate, right, title, interest, use, trust, property, possession, claim and demand, whatsoever of him the said James Kerling in law or equity, or otherwise howsoever of in, to, or out of the same. To have and to hold the said piece or tract of thirteen acres and fifteen perches of land strict measure hereditaments and premises hereby granted and released (or mentioned or intended so to be) with the appurtenances unto the said John W. Mentzer his heirs and assigns, to the only proper use, benefit and behoof of the said John W. Mentzer his heirs and assigns forever. And the said James Kerling for himself his heirs executors and administrators, doth covenant, promise, grant and agree, to and with the said John W. Mentzer his heirs and assigns, by these presents that he the said James Kerling and his heirs, the said thirteen acres and fifty perches of land strict measure hereditaments and premises hereby granted and released (or mentioned or intended so to be) with the appurtenances unto the said John W. Mentzer his heirs and assigns against him the said James Kerling and his heris, and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part or parcel thereof shall and will warrant and forever defend by these presents. In witness whereof the said parties to these presents have hereunto set their hands and seals, the day and year first above written. Mentzer the sum of One thousand and one hundred dollars lawful money of the United States it being in full for the consideration money above mentioned. Witness present at signing H.G. Be it remembered that on the thirty first day of March in the year of our Lord one thousand eight hundred and fifty nine before me the subscriber; one of the justices of the Peace in and for the said County of Lancaster personally came the above named James Kerling and acknowledged the above Indenture to be his act and deed, and desired that the same might be recorded as such, according to law.
