Anthony Esq, Shf to James Kerling } To all people to whom these presents shall come, Anthony E. Roberts Esquire High Sheriff of Lancaster County in the commonwealth of Pennsylvania Sendeth Greeting Whereas by a write of Levari Facias issued out of the District Court for the City and County of Lancaster bearing test at Lancaster the twelfth day of February last past to the said Sheriff directed he was commanded that without any other writ of the lands and tenements of Samuel Mentzer late of Lancaster County in his bailiwick to wit: of all that certain piece or tract of land situate lying and being in Cocalico Township Lancaster County bounded and described as follows to wit: Beginning at a stone in a public road a corner Land of Charles Steinmetz thence extending by the same along in a public road North eighty eight and a half degrees West forty nine perches and two tenths of a perch to a stone thence by the same one half of a degree west thirthy two perches and six tenths to a stone thence by land of Christian Wiest South eighty eight and a half degrees east forty nine perches and two tenths of a perch to a stone in a public road thence by land of Jacob Eberly along said public road South one and a half degrees east thirty two perches and six teths to the place of Beginning containing ten acres and three perches strict measure together with all and singular the appertenances thereunto belonging the lands and tenements of Samuel Mentzer in his bailiwick he should cause to be maid and levied the sum of Four hundred and fifty dollars which Henry Hibshman and Jacob Hagy for the use of Jacob Hagy lately in our district Court for the City and County of Lancaster before our Judge there of at Lancaster recovered against him of debt as eight dollars and fifty five cents; which to the said Jacob Hagy in our same Courts were adjudged for his damages which he sustained by occasion of the detention of that debt where of the said Samuel Mentzer is Convict – And that he should have these monies before our Judge at Lancaster at our district Court for the City and County of Lancaster there to be held on the second Monday in June next to render to the said Jacob Hagy for his debt and damages; And that he should have then there that writ. And whereas the said Sheriff having given due and legal notice of the time and place of sale of the said piece or tract of lands aforesaid did on Tuesday the seventeenth day of March Anno Domini one thousand eight hundred and forty expose the same to sale by public vendue or out cry and sold the same to James Kerling of East Cocalico Township Lancaster County for the sum of one thousands seven hundred dollars lawful money of Pennsylvania he being the highest and best bidder and that the highest and best price bidden for the same. Now know ye that the said Sheriff for and in consideration of the aforesaid sum of one thoushan seven hundred dollars to him in hand paid by the said James Kerling at and before the ensealing and delivery hereof the receipt whereof he doth hereby acknowledge hath granted bargained and Sold and by their presents according to the directions of the said recited writ and by force and virtue thereof doth grant bargain and sell unto the said James Kerling his heirs and assigns all that said piece or tract of land aforesaid together with all and singular the buildings improvement rights members and appertenances whatsoever there unto belonging or in any wise appertaining and the reversions and remainder rents issues and profits thereof and also all the estate right title interest property claim and demand whatsoever of him the said Samuel Mentzer of in to or out of the same to have and to hold the said piece or tract of land aforesaid hereditaments and premises hereby granted or mentioned or intended so to be with the appertenances unto the said James Kerling his heirs and assigns to his and for his only – proper use and behoof forever for such estate and under such rents and conditions as the said Samuel Mentzer had and held the same according to the form and effect of the laws and usage of this commonwealth in such case made and provided. In witness whereof the said Sheriff hath here unto set his hand and seal the thirteenth day of June Anno Domini one thousand eight hundred and forty. A. E.
