We encourage links to the state and county table of contents. ___________________________________________________________ Lancaster County PA Deed Book F5; Pages 172-173 ADAM ULREY & UX) |THIS INDENTURE Made the second Day of April in the year TO |of our Lord One thousand seven hundred & sixty four ABRAM REGUAL |BETWEEN Adam Ulrey of Lebanon Township in the County |of Lancaster and Province of Pennsylvania Yeoman and Uliana his wife of the one Part and Abraham Regual of the Township County & Province aforesaid Yeoman of the other Part WHEREAS a certain Andrew Miller of the Township aforesaid was seized in his Demense of and in two Tracts of Land joining together situate lying and being in the Township of Lebanon aforesaid one of these containing one hundred & thirty two Acres of Land and Allowance of six Acres P.Cent for Roads & Highways which the Honble. the Proprietaries by Patent of the fifteenth Day of March Anno Domini 1747, Recorded in the Office for Recording of Deeds at Philadelphia in Patent Book A. Vol. 14. Page 75 the 26th Day of September Anno Domini 1748 did give grant & Confirm unto the said Andrew Miller To Hold to him the said Andrew Miller his Heirs and Assigns forever as in and by the said Patent may appear Reference thereto being had And the other Tract containing one hundred and ninety one Acres and Allowance as aforesaid which by Virtue of two Proprietary Warrants bearting Date respectively the 9th Day of June Anno Domini 1743 and the 25th Day of May 1748, was surveyed unto the said Andrew Miller AND WHEREAS the said Andrew Miller died Intestate, his eldest son Abraham Miller upon Petitioning to the Orphans Court held at Lancaster the 5th Day of May Anno Domini 1762 that on paying his Co-hairs their Shares, the said Court would be pleased to grant him the Possession of the said two Tracts of Land which by the said Court being granted to & performed by him the said Abraham Miller, Margareth the widow of the said Andrew Miller deceased Intermarried and now called Margareth Burkholder Jacob Miller & Andrew Miller one of them a Son of said Andrew Miller deceased and the other to a certain Jacob Miller likewise deceased who was intermarried with Christina Daughter of the said Andrew Miller deceased by their Release bearing Date the fifth Day of May Anno Domini 1762 did cede and remise unto the said Abraham Miller his Heirs and Assigns all their respective Shares & Claims to the said Two Tracts of Land and Appurtenances as in and by the said Release may appear Reference thereto being had AND by a Proprietary Patent bearing Date the sixteenth Day of October Anno Domini 1762 Recorded in the Office for Recording of Deeds at Philadelphia in Patent Book AA. Vol. 3 page 456, the full Possession of the Last mentioned Tract of one hundred and ninety one Acres of Land and Allowance as aforesaid was given & granted unto the said Abraham Miller To Hold to him the said Abraham Miller his Heirs & Assigns forever as in and by the said Last mentioned & recited Patent may appear Reference thereto being had AND WHEREAS for the better Improvement of the same Lands and as the same Lay commodiously situate for that Purpose he the said Abraham Miller to fix & have built a Town thereon caused certain Tracts or Parcels of the said Tracts of Land to be divided & laid out into Lots which said Lots are situated in the said Town on the said Premises now called Annvill And hath already granted & conveyed a considerable number of the same lots unto divers persons their Heirs & Assigns forever by several Deeds Conveyances or Leases under & Subject to the several & respective yearly Rents in the same Grants Conveyances or Leases severaly & respectively mentioned & reserved All which said Rents are made payable on every the first Day of January yearly forever AND in all which grants Conveyances or Leases are contained Clauses & Provisoes that on Default of Payment thereof it shall & may be lawful to and for the said Abraham Miller his Heirs Executors Administrators and Assigns or any of them to enter and make Distress for the same Rents and for Want of such Distress that the said Abraham Miller his Heirs Executors & Administrators & Assigns shall & may enter into hold and injoy as his or their former Estate as in and by the said several Grants Conveyances or Leases & the Counterparts therof (Relation to them being respectively had) may more fully & at large appear AND WHEREAS the said Abraham Miller by Indenture bearing Date the thirty first Day of March Anno Domini 1764 for the Consideration therein mentioned did grant bargain sell release & Confirm unto the said Adam Ulrey his Heirs & Assigns the full Quantity of one hundred sixty seven Acres and eighty four Perches of Land & Allowance (Part of the aforesaid two Tracts) that is to say one hundred and twenty five Acres & sixty Perches and Allowance (Part of the aforesaid Tract of one hundred & thirty two Acres & Allowance and the further Quantity of forty two Acres & twenty four Perches & Allowance (Part of the aforesaid Tract of one hundred & ninety one Acres and Allowance (on which said two Tracts of Land joining together & containing one hundred & sixty seven Acres & eighty four Perches of Land & Allowance the aforesaid Town of Annvill is laid out) Together with all and every the yearly Rents so reserved arising & issuing out of the said Several Lots so granted by the said Abraham Miller with all & every the Counterparts of said Grants or Leases and all Advantage & Benefit thereof and all the Estate Right Title Right & Title of Re-entry Claim and Demand whatsoever of him the said Abraham Miller of in & to the said Several Rents and every of them and of in & to the aforesaid One hundred sixty seven Acres and eighty four Perches of Land & Allowance To hold to him the said Adam Ulrey his Heirs and Assigns forever as in & by the said Indenture (Relation thereto being had) may more fully & at large appear NOW THIS INDENTURE WITNESSETH that the said Adam Ulrey & Uliana his wife for and in Consideration of the sum of two hundred eighty five Pounds Lawful Money of Pennsylvania unto him or them in Hand well & truly paid by the said Abraham Regual at and before the Execution hereof the Receipt & Payment whereof is hereby acknowledged have and each of them hath and by these Presents So and each of them Doth grant bargain & sell remise release enfeoff and confirm unto the said Abraham Regual his Heirs & Assigns two certain Tracts of Land joyning together situate lying and being in the Township of Lebanon and County of Lancaster aforesaid one of them BEGINNING at a Post and from thence by Land granted or intended to be granted to said Abraham Regual North ten Degrees West fifty five Perches to a Post thence by Land of said Ulrey North eighty three Degrees East eighty six Perches to a Stone South seven Degrees East thirty six Perches to a Stone North eighty three Degrees East fifty four Perches to a Stone South twenty six Degrees East thirty six Perches to a marked Hickory South sixty Degrees West forty seven Perches to a Post & South twenty one Degrees East eight Perches to Quitopehella Creek and down said Creek forty three Perches on the several Courses thereof to a stone thence by the Lands of said Adam Ulrey North three Degrees West fourteen Perches to a stone North seventy two Degrees West thirteen Perches to a stone thence North twelve Degrees East twenty four Perches to a stone North seventy nine Degrees West twenty four Perches to a Stone South forty two Degrees West nine Perches to a stone and South eighty three Degrees West thirty two Perches to the Place of Beginning Containing fifty two Acres of Land and Allowance of six P.Ct. (Part of the aforesaid one hundred twenty five Acres & sixty Perches & Allowance) and the other BEGINNING at the same Post above mentioned for Place of Beginning and from thence by the Lands of said Abraham Miller and a certain Martin Bowman South eighty three Degrees West thrity four Perches to a Post North seven Degrees West twelve Perches to a Post South eighty three Degrees West seventeen Perches to a Post North seven Degrees West thirteen Perches to a Post South eighty three Degrees West nine Perches to a Post North seven Degrees West sixteen Perches to a Post South eighty three Degrees West four Perches to a Post North seven Degrees West fourteen Perches to a Post North eighty three Degrees East sixty foiur Perches to a Post and South ten Degrees East fifty five Perches to the Place of Beginning Containing sexteen Acres & One hundred Perches of Land and Allowance (Part of the aforesaid forty two Acres and twenty four Perches & Allowance) (on which said two Tracts of Land Part of the aforesaid Twon of Annvill is laid out fixed and built) TOGETHER with all & singular the Houses Edifices & Buildings thereon erected & being (save except & always reserving unto the said Grantees in the said several Grants Conveyances or Leases respectively mentioned their Heirs & Assigns respectively their several & respective Estates Rights Titles & Interests in & to the several & respective Lots Pieces or Parcels of Ground to them granted & conveyed in & by the said Grants Conveyances or Leases heretofore as aforesaid given & granted by the said Abraham Miller (that is to say) all those Lots in the said Town of Annvill on the herby bargained Premises marked & numbered in the Plan or Draught hereto annexed (to wit) No. 20, 25, 27, 40, 47, 54, 89, 96, 103, 116, 131, 141, 148, 164, 171, 187, 192, 193, 214, No. 233, 234, 236 with their Appurtenances according to the Tenor Purport & true Meaning of their said several Grants or Leases at & under the yearly Rents Covenants Provisoes & Agreements in the same Grants Conveyances or Leases respectively mentioned reserved & expressed Together also with all & every those the yearly Rents so reserved arising & issuing out of the said several & Respective Lots Pieces Parcels or Portions of Ground so granted and conveyed by the said Abraham Miller respectively & lying within the Bounds & Limits of the aforesaid two described Tracts of Land hereby granted or intended to be granted unto the said Abraham Regual with all & every the Counterparts of the said Grants Conveyances or Leases by them the said Grantees respectively sealed and executed & all Advantages & Benefit thereof & of all & every the Reservations Clauses Covenants & Agreements therein respectively mentioned & expresses And all Power Authority & Remedy of and for receiving & recovering all the said Rents & every of them by Virtue thereof or otherwise howsoever And also all the Estate Right Title Interest Use Trust Property Possession Right & Title of Re-entry Claim and Demand whatsoever of him the said Adam Ulrey both at Law & in Equity or otherwise howsoever of in & to the said several Rents and every of them And of in and to the said in Part two described Tracts of Land Together containing sixty eight Acres & one hundred Perches of Land & Allowance Hereditaments & Premises so granted & Conveyed as aforesaid & every or any Part or Parcel thereof with all & singular the Ways waters Liberties Priviledges Rights Members Advantages Hereditaments and Appurtenances thereto belonging or in any wise appertaining and the Reversion & Reversions Remainder &Remainders thereof TO HAVE AND TO HOLD the said two described Tracts of Land containing together sixty eight Acres & one hundred Perches of Land & allowance as aforesaid (except as before excepted) and all & singular the yearly Rents & other the Hereditaments & Premises hereby granted & conveyed (or mentioned and intended so to be) with their & every of their Rights Members & Appurtenances unto the said Abraham Regual hig Heirs and Assigns To and for the only Use Benefit & Behoof of him the said Abraham Regual his Heirs and Assigns forever At and under the Yearly Quit Rent now due and to become due for the same Premises to the Honourable the Proprietaries their Heirs & Successors as is Mentioned and reserved in the above two Patents or GRants And the said Adam Ulrey doth hereby grant for himself & his Heirs & to & for the said Uliana his wife that he & they the said two described Tracts of Land (Subject to & except as before excepted) Hereditaments & all and singular the Premises hereby granted & conveyed (or mentioned & intended so to be) with their & every of their Appurtenances unto the said Abraham Regual his Heirs & Assigns against him the said Adam Ulrey and his Heirs and against all & every other Person or Persons whomsoever Lawfully claiming the same shall and will warrant and forever defend by these Presents And the said Adam Ulrey doth covenant promise and grant for himself his Heirs Executors & Administrators (as also for the said Uliana his wife) to & with the said Abraham Regual his Heirs & Assigns by these Presents that he the said Abraham Regual his Heirs and Assigns shall and lawfully may from henceforth forever hereafter peaceably & quietly have hold use occupy possess & enjoy the said described Tracts of Land & Tenements Yearly Rents Hereditaments and all & singular the Premises hereby granted & conveyed (or mentioned and intended so to be) with their & every of their Appurtenances free clear and discharged or well & sufficiently saved and kept harmless of and from all former & other Grants Bargains Sales Jointures Feoffments Dowers Estates Entails Rent Rent-Charges Statutes Jusdgements Recognizances Executions and of and from all other Troubles Titles Charges and Incumbrances whatsoever had made Committed done or suffered to be had made committed & done by him the said Adam Ulrey and Uliana his wife their Heirs Executors or Administrators or any other Person or Persons lawfully claiming or to claim by from or under him them or any of either of them the Leases or Conveyances heretofore given & granted by him the said Abraham Miller as aforesaid to sundry Persons for the several & respective Lots Parcels or Portions of Ground in the Town of Annvill above particularly expresses marked and numbered & Contained in the Plan or Draught hereto annexed and the Particular Estate & Estates of all & every the Grantees in the said Leases or Conveyances mentioned and in & to the same Lots Parcels or Portions of Ground in & by Virtue of the said Leases or Conveyances only excepted IN WITNESS whereof the said Parties to these Presents their Hands & Seals have hereto interchangeable set the Day & Year first above written.
