All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/lancaster/ _______________________________________________ Lancaster County, Pennsylvania, Deed Book D, page 193-194 Cocalico Township Written: February 25, 1752 Recorded: January 8, 1755 Christian Shieply & Ux to John Erbe } THIS INDENTURE made the twenty fifth day of February in the year of our Lord one thousand seven hundred and fifty two BETWEEN Christian Shiepley of the township of Warwick in the county of Lancaster and Province of Pennsylvania Yeoman and Esther his wife of the one part and John Erbe of the same Township in the said county and Province Yeoman of the other part WITNESSETH that the said Christian Shieply and Esther his wife for and in consideration of the sum of four hundred and seventy five pounds lawfull money of Pennsilvania to them or one of them by the consent of the other in hand well and truly paid by the said John Erbe at or before the execution hereof the receipt and payment whereof are hereby acknowledged have and each of them hath granted bargained sold released and confirmed and by these presents do and each of tehm DOTH Grant bargain sell release and confirm unto the said John Erbe his heirs and assigns ALL that certain tract or parcel of land situate on Cocolico Creek in the said county of Lancaster and Province of Pennsylvania Beginning at the said Creek thence by other land of the said Christian Shieply north sixty degrees west thirty perches to a post (interlined but not in the Originial) thence by the same south eighty seven degrees west thirty five perches to a post thence by the same south seven degrees west seventeen perches to a post thence by the same north eighty seven degrees west sixty perches to a post thence by the same south forty one degrees west one hundred and two perches to a post thence by Michael Deal's land north forty four perches to a black oak thence by the same and John Davis's land north east by north ninety six perches to a while oak marked thence by the said Davis's land north sixty four perches to a marked white oak thence by George Miln's land east north east ninety two perches to a marked white oak and north east forty six perches to a marked hickery thence by Bartholomew Segress's land south thirty degrees east across the said creek one hundred and sixty two perches to a post thence south sixty degrees west thirty perches to a white oak thence north thirty degrees west twenty two perches to the said creek thence down the same by the courses thereof fifty perches to the place of beginning Containing one hundred and fifty eight acres and a half and the allowance of six acres p. cent for roads and highways (It being part and parcel of a certain tract of land containing three hundred and seventeen acres and the usual allowance of six acres p. cent. For roads & highways which in and by a certain patent bearing date the eleventh day of April in the year of our Lord one thousand seven hundred and forty five was granted and confirmed unto the said Christian Shieply his heirs and assigns forever as in and by the said patent (recorded in the Office for recording of deeds for the city and county of Philadelphia in Patent Book A, Vol 11, page 530 &c the 30th day of July 1745) Relation being thereunto had may more fully & at large appear) TOGETHER with all and singular the houses outhouses edifices buildings barns stables gardens orchards meadows Leasows pastures feedings woods underwoods ways waters watercourses hedges ditches trees fences commons profits priviledges advantages commodities emoluments hereditaments rights members and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversion and reversions remainder and remainders thereof and all the estate right title interest use trust property possession claim and demand whatsoever both at law and in equity of them the said Christian Shieply and Esther his wife of in and to the same and every part thereof TO HAVE AND TO HOLD the said tract of land hereditaments and premises hereby granted and released (or meant mentioned or intended so to be) with the appurtenances unto the said John Erbe his heirs and assigns to the only proper use and behoof of the said John Erbe his heirs and assigns forever At and Under the Proportionable part of the yearly Quit Rent now and hereafter to become due and payable for the said hereby granted premises unto the chief lord or lords of the Fee thereof And the said Christian Shieply doth hereby grant for himself and his heirs that he and they the said Tract of land hereditaments and premises hereby granted with the appurtenances unto the said John Erbe his heirs and assigns against him the said Christian Shieply and the said Esther his wife and his heirs and against all and every other persons and person whomsoever lawfully claiming or to claim the same or any part thereof by from or under him her or them or any or either of them shall and will warrant and for ever defend by these presents AND the said Christian Shieply for himself his heirs executors and administrators doth hereby covenant promise grant and agree to and with the said John erbe his heirs and assigns that he the said Christian Shieply and also the said Esther his wife and his heirs and all and every other persons and person now having or lawfully claiming or hereafter to have or lawfully claim any estate right title or interest whatsoever of in and to the said hereby granted premises or any part thereof by from or under him her or them shall and will at any time or times hereafter at the request costs & charges of the said John Erbe his heirs or assigns make do acknowledge levy suffer perfect and execute or cause and procure so to be all and every such further and other lawfull and reasonable act and acts deed and deeds thing and things conveyances and assurances in the law whatsoever for the further better sure more perfect and absolute granting conveying assuring releasing and confirming the said premises hereby granted with the appurtenances unto the said John Erbe his heirs and assigns forever as by him or them or his or their council learned in the law shall be reasonably advised or devised and required IN WITNESS whereof the said parties to these presents their hands and seals have hereunto interchangeably set the day and year first above written.
