Shirk et ux To Willhamina Root } This Indenture made the Thirteeth day of March in the year of our Lord one Thousand eight hundred and Sixty-five (1865) Between Jacob H Shirk of the Township of Warwick in the County of Lancaster and State of Pennsylvania Drover and Anna his wife of the one part and Willhamina Root wife of William Root of West Cocalico Township in the County and State aforesaid of the other part Witneseth that the said Jacob H Shirk and Anna his wife for and in consideration of the sum of Six Hundred Dollars ($600.00) lawful money of the United States of America unto them well and truly paid by the said Wilhamina Root at and before the sealing and delivery of these pursuits the receipt whereof is hereby acknowledged have granted bargained sold aliened enfoffed released and confirmed and by these presents Do granf bargain sell alien enfeoff release and confirm unto the said Willhamina Root and to her heirs and assigns All That certain tenement and tract of land situated lying and being in West Cocalico Township in the County of Lancaster and State aforesaid bounded and described by the lines as follows to wit: Beginning at a stone thence by land of now or late of Peter Martin Esq. Samuel Mellinger and Jacob Keller respectively South eighty eight degrees west sixty nine and a half perches to a stone thence by land of late Adam Lauck south one quarter degree East thirty six perches and seven tenths of a perch to a Maple tree thence by the same South thirteen degrees west twenty three perches to a chestnut tree thence by lands of Samuel Mentzer South thirty nine degrees and one half East seven perches to a poplar an S 3 ¾ E Seven perches and three tenths of a perch to a stone thence by land of late Samuel Hagy North eighty eight and one quarter degrees East twenty seven and seven tenths perdue to a stone thence by land of William H. Paul Esq. North twenty four degrees East twenty six perches to a Black Oak Stump and North eighteen degrees East twenty six perches and seven tenths of a perch to a white Oak and South eighty six and one half degrees East twenty six and one half perches to a hickory thence by lands of now or late John Royer North eight degrees west twenty six perches to the Place of Beginning Containing as per deed from which the above description is taken twenty two acres and seventy nine perches of land Strict Measure it being the greator part of the same premises which Jacob Hagy and Catharine his wife by Indenture bearing date the 7th day of April A.D. 1824 for the consideration therein mentioned did grant and confirm unto Jacob Raush and to his heirs and assigns forever and the said Jacob Roush and Polly his wife by assignment endorsed on said Indenture bearing date the 27th day of March A.D. 1827 for the consideration therein mentioned did grant and assign the same unto Jacob Shirk and to his heirs and assigns forever as in and by the said in part recited Indenture and assignment thereon endorsed duly executed reference being had appears and the said Jacob Shirk being so thereof in his lifetime lawfully seized died intestate leaving a widow and issue twelve children to whom the said premises as above described by the laws of Pennsylvana did descend and come and the said widow and Eleven of the twelve children and heirs at law of said Jacob Shirk deceased by Indenture bearing date the 28th day of March A.D. 1863 for the consideration therein mentioned did grant and confirm all the same premises as above described unto the said Jacob H Shirk first party hereto who being the other and twelfth child of said deceased and to his heirs and assigns forever as in and by the said in part Recited Indenture duly executed reference being thereunto had appears Together with all and singular the Buildings and Improvements ways waters water courses rights liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversions and remainders rents issues and profits thereof and all the estate right title interest property claim and demand whatsoever of them the said Jacob A Shrik and Anna his wife in law equity or otherwise howsoever of in and to the same and every part thereof To have and to hold the said tenement and tract twenty two acres and seventy nine perches of land strict measure hereditaments and premises hereby granted or mentioned and intended so to be with the appurtenances unto the said Willhamina Root her heirs and assigns to and for the only proper use and behoof of the said Willhamina Root her heirs and assigns forever And the said Jacob H Shirk and Anna his wife for themselves their heris executors and administrators Do by these presents covenant grant and agree to and with the said Willhamina Root wife of William Root her heirs and assigns that they the said Jacob H Shirk and Anna his wife and their heirs all and singular the hereditaments and premises herein above described and granted or mentioned and intended so to be with the appurtenances unto the said Willhamina Root her heirs and assigns against them the said Jacob H Shirk and Anna his wife and their heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof by from or under him them or any of them shall and will warrent and forever defend In witness whereof the said parties to these presents have hereunto interchangeably set their hands Willhamina Root wife of William Root the sum of six hundred dollars lawful money of the United States in full for the consideration money before mentioned Jacob H Shirk Witness Present at signing above named Jacob H Shirk and Anna his wife and in due form of law acknowledged the above Indenture to be their and each of their act and deed and desired the same might be recorded as such and the said Anna Being of full age and separate and apart from her said husband by me thereof privately examined and the full contents of the above deed baing by me first made known unto her did therefore declare and say that she did voluntarily and of her own free will and accord sign seal and as her act and deed deliver the above written Indenture Deed or Conveyance without any coercion of compulsion
