All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/lancaster/ _______________________________________________ Cocalico township, Lancaster Co., PA Written: April 2, 1828 Recorded: March 16, 1832 Wiest Christian & wife to Samuel Mentzer } This Indenture made the second day of April in the year of our Lord one thousand eight hundred & twenty eight Between Christian Wiest of Cocalico township in the county of Lancaster & state of Pennsylvania Yeoman & Anna his wife of the one part & Samuel Mentzer of the same place aforesaid yeoman of the other part Witnesseth that the said Christian Wiest & Anna his wife for & in consideration of the sum of five hundred dollars & ninety three cents & three quarters of a cent lawful money of the State of Pennsylvania to them in hand well & truly paid by the said Samuel Mentzer & before the ensealing & delivery herof the receipt where of they do hereby acknowledge & there of do acquit & forever discharge the said Samuel Mentzer his heirs executors & administrators by these presents have granted bargained sold aliened enfeoffed release & confirmed & by these presents do grant bargan sell alien enfeoff release & confirm unto the said Samuel Mentzer & his heirs & assigns that certain piece or tract of land situate lying & being in Cocalico township in the county of Lancaster aforesaid bounded & described by the lines & courses as follows to wit Beginning at a stone in a public road a corner of land of Charles Stonemetz thence extending by the same along in a public road north eight degrees & a half of a degree west forty nine perches & two tenths of a perch to a stone thence by the same north a half a degree West thirty two perches & six tenths of a perch to a stone thence by other land of the said Christian Wiest south eighty eight degrees & a half of a degree east forty nine perches & two tenths of a perch to a stone in a public road then ce by land of Jacob Eberley along in the said public road south a half a degree east thirty two perches & six tenths of a perch to the place of Beginning Containing ten Acres & three perches strict measure it being part of a land or piece or tract of land containing sixty six acres & sixty seven perches strict measure which Daniel Bard & Elizabeth his wife Charles Stonemetz & Maria his wife John Lutz & Susanna his wife & Martin Schware duly appointed guardian at an Orphans Court held at Lancaster over the person & estate of Sarah Schware by their release bearing date the fifth day of June Anno Domini one thousand eight hundred & twenty six for the consideration therein mentioned grant & release unto the said Christian Wiest party levete & to his heirs & assigns forever as in & by the said in part recited release relation being thereunto had will more fully & at large appear & whereas John Schware late of the said township of Cocalico being in his lifetime lawfully seized in & of a larger piece or tract of land of which the said recited piece or tract being part there of died leaving issue five daughters to wit the said Elizabeth. Maria. Susanna Anna & Sarah. Together with all & singular appurtenances whatsoever there unto belonging or in any wise appertaining & the revisions & remainders_rents_issues & profits thereof & also all the estate right title or interest_use_trust_property_possession_claim & dem and whatsoever of them the said Christian Wiest & Anna his wife in law or equity or other wise howsoever of in to or out of the same to have & to hold the said piece or tract of land containing ten acres & three perches strict measure hereditaments & premises hereby granted & released or mentioned or intended so to be with the appurtances unto the said Samuel Mentzer his heirs & assigns forever & the said Christian Wiest for himself his heirs executors & administrators doth covenant promise grant & agree to & with the said Samuel Mentzer his heirs & assigns by these presents that he the said Christian Wiest & his heirs the said above mentioned & described piece or tract of land containing ten acres & three perches strict measure hereditaments & premises hereby granted & released or mentioned or intended so to be with the appurtenances unto the said Samuel Mentzer his heirs & assigns against them the said Christ Wiest & Anna his wife & their heirs & against all & every other person & persons whomsoever lawfully claiming or to claim the same or any part or parcel thereof by former under him them or any of them or either of them shall & will warrant & forever defend by these presents. In Witness where of the said parties to these presents have hereunto interchangeably set their hands & seals dated the day & year first above written. Christ Wiest Witness Present at signing…William Carter..Samuel Eberley Lancaster County SS… Be it remembered that on the second day of April Anno Domini 1828 before me Samuel Eberly Esq one of the Justices of the peace in & of the said County personally came the above named Christian Wiest & Anna his wife & acknowledge the above indenture to be their act & deed & desired that the same might be recorded as such according to law, the said Anna being by in due form of law examined separate & apart from her said husband & the full contents of the above deed being by me first made known to her the sd Anna upon such separate examination as aforesaid declared that she did voluntarily & of her own free will & record seal & as her act & deed deliver the said without any coercion or compulsion of her said husband.
