All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/lancaster/ _______________________________________________ Source: Lancaster Will Book Y-2-43 Written: March 20, 1775 Recorded: May 31, 1782 In the name of God, Amen, I John Bender of Warwick Township, in the County of Lancaster and State of Pennsylvania, being old and weak of body, but of sound mind and understanding (God be praised) and therefore make my Last Will & Testament in manner following. First; I order and it is my will that all my just debts be paid out of my estate. Item; It is my will and I do hereby give and bequeath unto my beloved wife Margaret my feather bed and bedstead with the furniture thereto belonging also a milch cow, my copper wash kettle and pewter basin, a pewter dish, two pewter plates, an iron pot, a penn, a chest and a table. Item; I give and bequeath unto my beloved son John Adam Bender and to my beloved daughter Elizabeth, the sum of five pounds lawful money of Pennsylvania, to each of them or the value thereof aforesaid. And as to the residue of my personal estate which may be left after the above mentioned articles are deducted, I order divided in the manner following, that is to say my said wife Margaret to have the one third part thereof and the remaining two parts shall be divided among all my children, share and share alike. And lastly I nominate mass? & appoint my said wife Margaret and my neighbor Peter Huber Executors of this my Last Will & Testament declaring this and no other to be my Last Will & Testament. In witness whereof I the said John Bender have hereunto set my hand and seal the 20th Day of March 1775. Register for the probate of wills and granting letters of administration for the County of Lancaster and State of Pennsylvania 1782 May 2: I Henry Leib, one of the son-in-laws of John Bender, late of Warwick Township in the County of Lancaster, aforesaid, yeoman, deceased, to hereby for myself and the other children of the deceased enter a caveat against the probate of a certain writing purporting to be the Last Will & testament of the late John Bender, deceased, until we are found thereon. Henry Leib Lancaster County: On the 31st day of May 1782 before me the subscriber appeared before me Peter Ricksecher and John T--- the subscribing witnesses to the will and on their affirmations respectively according to law did severely declare and affirm that they were present and seen the heard John Bender, the testator within named, sign, seal, publish, pronounce the within writing as his Last Will & Testament and at the signing thereof he was of sound and well disposing mind memory and understanding to the best of their knowledge, observation and belief. Be it remembered that on the 31st day of May 1782 the Last Will & Testament of John Bender, late of Warwick Township in the County of Lancaster, yeoman, deceased, was proven in due form of law and letters of testamentary were granted to Margaret Bender and Peter Huber, the executors therein named. Additional Comments: There were two Elder John Benders in Warwick Township, Lancaster County. This man was known as John Bender Sr.,(1701 - 1782)meaning the Elder. He was first married to Verona then Margaret.
