I Christian Burkholder of Earl Township Lancaster County and State of Pennsylvania am weak in body but of perfect mind and memory, thanks be unto God. Therefore, I do hereby make and ordain this my last Will and Testament in manner following. I recommend my soul into the hands of the Almighty God that gave it, and my body I recommend to the Earth to be buried in a decent Christian burial by my Executors, and as touching such worldly estate wherewith it hath pleaseth God to bless me in this life, I give and dispose of the same in the following manner. First, I give and bequeath unto my two youngest daughters, Ann and Elizabeth all that certain piece of woodland in said Earl Township adjoining land of John Souder and Christian Burkholder, Jr. and others, containing about five acres, be the same more or less, except two acres and a half which I have sold to my son Christian, To have and to hold the said above described tract of woodland unto my two daughters, Ann and Elizabeth, their heirs and assigns forever as tenants in Common in equal part. I further give and bequeath unto the said Ann and Elizabeth a certain House and lot which I hold in partnership with my son Christian, but agreed with my said son Christian to convey all his right, title and interest of the said house and lot containing one acre and one hundred and sixty-five perches unto my said two daughters, Ann and Elizabeth. Further it is my will that if my son Christian shall at any time hereafter give a good and sufficient deed to my said two daughters, their hers and assigns forever, that then and in such case I order and impower my hereafter named Executors or the survivor of them to give a good and sufficient Deed to my said son Christian, his heirs and assigns forever, but not otherwise, for the above mentioned two acres and a half of woodland. Further it is my will that if my said son Christian shall give his Deed as aforesaid unto my said two daughters, their heirs and assigns, as tenants in common, that then and in such case my said two daughters shall pay to my named Executors the sum of One hundred and seventy-five pounds lawful money for the use of my estate. Further I will and ordain that my hereafter named Executors shall pay to the congregation which I belong, the sum of ten pounds for the use of the poor. Further I will and ordain that the remainder of my estate not before bequeathed shall be equally divided to and amongst all my children, share and share alike. Further, it is my will that what I have given to each of my children the same Shall be deducted out of their share; and lastly I nominate and appoint m sons Abraham and Daniel to be Executors of this my last Will and Testament, and likewise give them full power to give a good deed or deeds unto my said to daughters and my son Christian and said Deed or deeds shall be as good as if I have signed the same myself, in witness whereof I have hereunto set my hand and seal the twenty-seventh day of April, Anno Domini One thousand eight hundred and nine. On the 26th day of May Anno Domini 1809, Before me the Subscriber personally appeared Elizabeth Graff and Christian Meyer, the two Subscribing witnesses to the within Will, who upon their solemn affirmation, according to law, did severally declare and say that they were present and saw and heard Christian Burkholder the Testator therein named, sign, seal, publish, pronounce and declare the foregoing writing as and for his last Will and Testament, and that at the doing thereof he was of sound and well disposing mind, memory and understanding to the best of their knowledge, observation and belief. William Bausman, Register Be it remembered that on the 26th day of May Anno Domini 1809 The last Will and Testament of Christian Burkholder deceased was proved in due form of law and letters Testamentary thereon were granted to Abraham Burkholder & Daniel Burkholder the Executors named, They having first been duly qualified well and truly to Administer the estate of the said deceased Specially to exhibit a true & perfect Inventory thereof into the Registers Office at Lancaster within one Month from this date an to render a true and just account of their Executorship on said Estate in one year or when thereto lawfully required. Given under my hand and seal of said office. William Bausman. Reg. Additional Comments: Christian Burkholder, born June 1, 1746, in Switzerland, immigrated to Pennsylvania on October 1, 1754. He was a bishop of the Mennonite Church for the congregations in the Groffdale, Weaverland, and Bowmansville areas.
