All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/lancaster/ _______________________________________________ Source: Will Book H-1-594 Written: September 10, 1804 Recorded: September 17, 1804 In the Name of God Amen---- I Ulrich Borgholter of Brecknock Township in the County of Lancaster being sick & weak of Body, but God be thanked of sound Mind and understanding, I therefore thought proper to make my last Will and Testament in Manner following. First it is my Will and I order that all my Just Debts and Funeral Expenses be paid out of my whole Estate And further it is my Will and I order that my Son John Borgholter shall have the House & Stables, where he now lives, together with the Land about the House as many Acres as will amount to his full Share in my Estate if he takes the Land at the appraisement, and the said Land shall be valued by four impartial Men, that is, two of them shall be chosen by my Son John Borgholter, and the two other by my five other children and I give & bequeath the same unto my Son John Borgholter and to his Heirs and Assigns forever. But if my Son John should not be willing to take it at the appraisement, then it shall be sold at public vendue after the decease of my Wife, and the Land shall not be appraised until after the Death of my Wife or as soon as she Marries again. Item, it is my Will and I order that my hereafter named Executors shall give to my Son John or to the possessor of the above mentioned Land a good Deed after the Death of my Wife or after she is married again. Item, it is my Will that my Son Christian shall have the remainder of my Land & Plantation with all the Buildings on the Place which I give and bequeath to him & his Heirs forever. But the Land shall be appraised by four impartial Men, two of them to be chosen by my Son Christian and the other two by my five other Children which said Appraisement shall be made after the Death of my said Wife or after her Marriage. But if my Son Christian should not be willing to take the Land at the Appraisement, then it shall be sold at public Vendue after the above mentioned Time and further it is my Will that my hereafter named Executors shall give to my Son Christian or to the possessor of my said Land a free Deed for the Land. Item, it is my Will that my Son Christian or the possessor of the Land shall give Security for the Money for which it is appraised and further it is my Will that my Son Christian or the Possessor of the Land, shall yearly pay the Sum of Twenty Pounds until it is paid, but the payment to begin only at the before mentioned Time, and it is my Will that everything relating to my Land shall only be Done after the Death of my Wife, or after her Marriage. Item, it is my Will that my Son John shall have the Land on which he now lives in his Possession until he gets a full Right for it without paying anything for the same, and so likewise my Son Christian excepting the Allowance to my Wife that is to say my Wife shall have her dwelling Place in the House wherein I now live and she shall have the same Right in the House as she had in my Life Time for and during the Term she remains my widow. And it is my Will and I order that my Son Christian or the possessor of the Land which my Son Christian was to have, shall give unto my Wife Yearly twelve Bushels of good clean Wheat, Six Bushels of Rye, four bushels of Indian Corn, five Bushels of Buckwheat, Eight Bushels of Potatoes, a fat Hog of at least one hundred & fifty Pounds weight with the fat, fifty Pounds of good Beef, Ten Pounds of hackled flax, Ten Pounds of hackled Hemp, fifteen pounds of flax Ton, fifteen Pounds of hempton, the one third part of the apples and other fruit growing on the Land which my Son Christian is to have, also the third part of the Kitchen Garden for her use and to be ploughed & manured by the Possessor of the Land, also deliver fire wood to her House cut small fit to Burn and also carry her Grain to the Mill and the flour & Bran thereof back again to her House, and must keep her two Cows in Summer & Winter like his own and give her a Tame Horse to ride when she chooses and she may take her Choice of the one third part of the Garden, and if my said Wife should get Sick then my Son Christian or the Possessor shall attend her as it becomes Christians, and my Wife shall also have a right to the Spring house, and all these Articles shall be given & delivered to my Wife Yearly and every Year during her Life or as long as she remains my Widow by my Son Christian or the Possessor of the Place. Item, it is my Will that my Wife Ann shall have two Beds with the Bedsteads aforehand, and also the Pipe Stove with the Pipes also a Chest which she may fill with her Things and she shall have the choice of two Cows out of my Stock and Six Pounds of Wooll [wool], and with these Articles she may do what she pleases And further it is my Will and I order that my Son John shall have the Sum of Thirty Pounds aforehand to do with it what he pleases. And my Son Christian shall have my youngest Coult [colt] aforehand, and my Daughter Maria shall have a Heiffer [heifer] aforehand. And further it is my Will that my Wife Anna shall continue the Housekeeping until next Spring that is to the first of April, and it is my Will that my Will [Widow] shall have all the Spinning Articles that we now have to do with it what she pleases, and it is my Will that the residue of my moveable Property shall be appraised next Spring and then publically sold and it is my Will that all my Children shall be equal Shares excepting those afore mentioned. And lastly I do nominate & appoint my friend John Bauman & Abraham Guth Executors of this my last Will & Testament making hereby null and void all former Wills by me made declaring this and no other to be my last Will & Testament. Affirmed Lancaster County On the 17th day of September anno Domini 1804 before me the Subscriber personally appeared, Christian Musselman and John Guth the two Subscribing Witnesses to the annexed and foregoing Will who upon their solemn affirmations according to Law did declare and say that they were Present and Saw and heard Ulrich Burkholder the Testator therein names Sign seal publish pronounce and declare the annexed and foregoing Instrument in writing as and for his last Will and Testament and that at the time of the Doing thereof he was of sound and well disposing Mind Memory and Understanding according to the best of the Knowledge Observation and Belief. Be it Remembered That on the 17th day of September anno Domini 1894 The last Will and Testament of Ulrich Burkholder late of Brecknock Township in the County of Lancaster Yeoman Deceased, was proved in due form of Law and Letters Testamentary thereon were granted to John Bauman and Abraham Guth the Executors therein named They having first been qualified well and truly to administer the Estate of said Deceased, especially to Exhibit a true and perfect Inventory thereof into the Registers Office at Lancaster within one Month and to Under a true and just account of their Executorship on said Estate in one year from this date or when thereunto Lawfully Required, Given under the Seal of said Office G. Ross, Rec. Additional Comments: Ulrich Burkholder immigrated to PA from Switzerland in 1754 with his widowed mother and five siblings. He was a brother of Bishop Christian Burkholder in Earl Twp., Lancaster County. Ulrich was a minister in the Mennonite churches at Muddy Creek, now Bowmansville.
