All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/lancaster/ _______________________________________________ The Will of Zaccheus DAVIES Dated 12 August 1786 and proved 9 April 1787 In the Name of God Amen I Zaccheus DAVIS of Earl township in the County of Lancaster and State of Pennsylvania yeoman being in health of Body and sound Mind and Memory (Blessed be god) do this twelfth day of August in the year of our Lord one Thousand seven hundred and Eighty six Make and publish this my last Will and Testament in Manner following (that is to say) My Will is that my just Debts and my Funeral Charges be paid by my Executors hereafter named Imprimis I Give and devise to my Son Zaccheus DAVIS all my plantation and Tract of Land being about two hundred and Eighteen Acres of land (excepting as herein Excepted) together with the one half of the Grist Mills and other Buildings and Improvements belonging to the Land and Plantation to be held and possed {possessed} by my said Son his Heirs and Assigns forever on Condition nevertheless that if my said Son Zaccheus doth sell the said land and Mill or any part thereof or Comes indebted so as the said Land and Plantation must be sold then my said Son Shall have but the one fourth Part of the Money it will Sell for and the other Three Parts of the said Money I give to my Son Jenkin DAVIS and my five Daughters viz Dinah, Sarah, Ann, Elizabeth and Hanna to be equally divided amongst them or their Heirs, I Give and bequeath to my Son Jenkin DAVIS fifty Pounds to be paid to him or his Heirs in two years after my decease by my Executors, Item I Give and bequeath to my Daughter Dinah the Sum of Sixty Pounds to be paid to her or her Heirs within Three Years of my decease by my Executors. I Give and devise to my Daughter Anne and my Son in law Willis DAVIS the land whereon he hath built the fulling Mill and the land where his Tenter Stands and so much land as is necessary for to go to and from the said Mill and Tenter to be held and possed {possessed} by my Son {in law and Ann his wife and their Heirs forever in give} to my said Daughter Ann four Acres of my {land }that part Joyning to Richard DAVIS and {John DAVIS .Lands to be held by her Heirs and Assigns forever I also give to my Son in law Willis the use of the Meadow below the Fulling Mill for ninety years on Condition he {pay} the one Third of the Cost of Scouring and keeping {the} Mill Race in Order forever Item I give and bequeath to my Daughter Sarah the Sum of Ten pounds to be paid to her or her Heirs in two years after my decease by my Executors, Item I Give and bequeath to my Daughter Ann the Sum of ten pounds to be paid to her or her Heirs by my Executors in three years after my decease Item I give and bequeath to my Daughter Elizabeth the Sum of ninety pounds to be paid to her or her heirs within five years after my decease by my Executors Item I Give and bequeath to my Daughter Hannah the Sum of Sixty pounds to be paid to her by my Executors within Six years After my decease, Item I give and bequeath to Abia PARK the Sum of Sixty Pounds to be Paid to him by my Executors within Six years after my decease Item I give to Thomas Davis the Son of Sarah PELSNER Ten pounds to be paid to him within four years by my Executors, Item I give and bequeath to my GrandSon Zaccheus the Son of { ? } DAVIS the Sum of Ten pounds to be paid to him when he is Ten Years Old and put out on Interest for his use untill he is twenty one years of Age and then paid to him I give to my Son Jenkin above named the money that is due to me by a son of Thomas EVANS deceased {of} South Wales being about a hundred pounds I also give to my Son Zaccheus above named my Clock and Clock Case the Cloaths press, Desk, one Bed, bedcloths and {all} my Books provided he keeping them and give {them} to his Sons if ever he will have Sons and if any money Remains after paying the legacies above given and paying for a Stone to be put at the Head {of my} Grave I give the same to my Daughters{s to be Equally divided among them or their Children and I Make and Ordain} my Son Zaccheus DAVIS and my Sons in law Thomas CARTER and Willis DAVIS Executors of this my Will and Testament in trust and for the Intents and purposes in this my last Will Contained In Witness whereof I the said Zaccheus DAVIS have to this my last Will and Testament Set my hand and Seal the Day and year above written, Zaccheus DAVIS Seal Signed Sealed and Delivered by the said Zaccheus DAVIS as and for his last Will and Testament in the presence of us who were at the Signing and Sealing thereof. The words of Tract of and one Bed were interlined before the Sealing hereof. Richard DAVIS Isaac DAVIS. Lancaster County Sst. On the ninth Day of April Anno Domini, 1787 Personally appeared before me the Subscriber Richard DAVIS and Isaac DAVIS, the two Subscribing Witnesses to the foregoing Instrument of Writing and on their Solemn Affirmation Respectively did declare and Say that they were present and Saw and heard Zaccheus DAVIS the Testator therein named Sign Seal publish pronounce and declare the said Writing as and for his last Will and Testament and that at the doing thereof he was of Sound and well disposing mind, memory and Understanding to the Best of their Knowledge, Observation and Belief James Jacks regtr Be it Remembered that on the ninth day of April Anno Domini {1787} the last Will and Testament of Zaccheus DAVIS late of Earl township deceased was proved in due form of law and Letters testamentary thereon were granted to Zaccheus DAVIS and Willis DAVIS (Thomas CARTER the other Executor having renounced) the Executors therein named they haveing first been duly qualified well and truly to Aminister the Estate of the said deceased and Especially to Exhibit a true and Perfect Inventory thereof into the Registers Office at Lancaster within one month from this date and to render a Just and true Account of their Administration on said Estate within one year or when thereunto Lawfully Required, Given under the Seal of said Office JJ James JACKS Regtr {By order of sd} James JACKS Regtr Persons named in this Will: Sons: Zaccheus and Jenkin DAVIS Daughters: Dinah, Sarah, Ann, Elizabeth, & Hannah Sons in law: Willis DAVIS & Thomas CARTER Abia PARK (perhaps a grandson???)
