I Gabriel DAVIS taking to consideration the Mortality of my Body, being of sound mind & memory Do make this my last Will & Testament in form & manner folowing. Item my will is that all my Just Depts and funeral Expences be Justly paid and Satisfied. Item I order & my will is that my Real Estate be sold by my Executors herafter named as soon as it can Convenient after my Deceas ether intire or in parts as it may Suit best for the benefit of my Children and make a Title or Titles to the Purchaser or Purchasers as good as law will protect them in making to him or them his or their Heirs and Assigns for ever. Item, I give and bequeath to my Daughter Jean two hundred pounds out of my Estate undivided & two Beds & beding Sufitient for sd Beds of her choosing and a Case of Drawers. Item I give and bequeath to my Sister Sarah Darlintons Daughter Margaret Fifty pounds out of my Estate undivided. Item, I give and bequeath to my Daughter-in-Law Juliana Fifty pounds out of my Estate undivided. Item the Remainder of my Estate I order and my will is that it be equally divided among my Children & my GrandChild Gabriel my Son Archibalds Child share and share alike in case my sd GrandChild should die before he attains to the age of twenty one and without lawful Isue of his Body his share I order to be equally divided among my other Children excepting such part of it is may be expended on his nursing maintainance & Schooling. Item, be it Remembered that my Daughter Jean is to be equal as above notwithstanding the two hundred pounds I have given her out of my Estate undivided. Item Whereas my son George is infirm in mind in case his Share will not be sufitient to keep him his lifetime I subject the Legacies I have made to my own Children to Contribute share alike as far as is necesary. Item in Case my Executors should owe me money at my Deceas my Will is that such Depts shall be paid equal as if it were Due to me by any other person were not my Executor Son John DAVIS and I ordain my Son-in-Law, Joseph JONES Sole Executors of this my last Will and Testament Revoking all other Wills by me hitherto made this only to be my Will and Testament according to the true intent and meaning thereof. In Witness whereof I have hereunto set my hand and Seal the twenty first Day of May in the Year of our Lord one thousand Eight hundred & four - 1804 Gabriel DAVIS L.Y. Signed, Sealed & Declared by the Testator in our hearing and presence for his last Will & Testament. Geo THOMPSON, John THOMPSON, Arched McCURDY. -- Having taking to further consideration since I made the within will I thought it necesary to make some further provisions therefore I anexe this my Coditial, that is to say in Seling my Real Estate to keep twenty or thirty Acres more or les as they shall think proper for a residence for my Family as long as they find it necesary and to build on it necesary building out of the Money of my Estate to keep it as long as there will be a demand for my Family to live in and after that to sell it and aply the Money as my said will directs, but in case my Executors shall think it best to sell it whole and purchis elsewhere I submit it to their consideration in Case they should do so the said to be sold and the Money aplied as above when there be no further demand for it for my Family. Item, I give and bequeath to my Daughter-in-Law Juliana her Accomeditions with my Family Gratis as long as she continues my Son Archibald's Widow exclusive what I have bequeathed her in my Will. Lancaster County Ss On the 16th day of February, A.D. 1813 before me the subscriber personally appeared George THOMPSON and John THOMPSON two of the subscribing witnesses to the within will & Codicil who being duly sworn according to law did depose declare and say that they were present and saw and heard Gabriel DAVIS the Testator within named sign, seal, publish pronounce and declare the within writing as and for his last Will and Testament and Codicil and that at the time of the doing thereof he was of sound and well disposing mind memory and understanding to the best of their knowledge observation and belief. William BAUSMAN Regr Be it remembered that on the 16th day of February A.D. 1813 the last Will and Testament and Codicil of Gabriel DAVIS deceased was proved in due form of law and Letters Testamentary thereon were granted to John DAVIS and Joseph JONES the Executors therein named they having first been duly qualified well and truly to Administer the estate of the said deceased, especially to exhibit a true and perfect Inventory thereof into the Registers Office at Lancaster within one Month from this date and to render a true and just account of their Executorship on said estate in one year or when lawfully required.
