I John Frey of East Cocalico Township in the County of Lancaster and State of Pennsylvania, being in a declining state of health, but of mind, memory and understanding, blessed be God for the same, and considering the uncertainty of this transitory life, do make and publish this my last will and testament in manner and form following to wit: First, I do order and direct that as soon as convenient after my decease, all my just debts and funeral expenses be duly paid and satisfied by my executors hereinafter named. I also order and direct that as soon as convenient after my decease my said executor shall sell all my household furniture and farming utensils at public vendue. I also order and direct that as soon as convenient after the expiration of six months after my decease my executors hereinafter named shall sell all my real estate consisting of three separate tracts of land all situate in East Cocalico Township aforesaid: the one on which I now live containing eight acres, be the same more or less , adjoining lands of John Gockley, Daniel Roth, John Wilson Esq. and others with the buildings and improvements thereon erected; another tract of land containing five acres, be the same more or less, adjoining lands of Frederick Ream,, Christina Echternach and others; also another tract of land the latter being timber land containing nine acres more or less adjoining lands of John Mishler, the Estate of Sebastian Gockley deceased, and others, together with all and singular, all of which said three tracts of land I purchased of Abraham Solenberger, for all of which tracts of land I authorize and empower my said executors or the survivor of them, to execute good deeds of conveyance to the purchasers thereof, which deeds I acknowledge shall be as good and valid in the law as if I had executed them in my lifetime. And the money arising from the sale of my real and personal estate as well as all my outstanding claims whether by bond, note or book accounts now due or which hereafter may become due, I give and bequeath unto my children or their legal representatives in the following manner, I give and bequeath unto my grand daughter Anna Furlow who is a daughter of my late daughter Catharine late the wife of Jacob Furlow deceased the sum of twenty five dollars, which is all that she is to receive out my estate, her mother having received a considerable share in her lifetime; and whereas I have advanced to the following named of my children as follows: to my daughter Elizabeth the widow of John Smith deceased, one hundred dollars, to my daughter Polly, the wife of Michael Kagerize one hundred dollars, to my son George forth two dollars, to my son Michael twenty dollars, and to my daughter Sarah the wife of John Lutz, one hundred dollars, for all of which sums charges are made in my books amounting to three hundred and sixty two dollars, all of which sums shall be added to my estate, and the sum or sums respectively before mentioned shall be deducted from their shares respectively herein after bequeathed to them. And touching all the rest or residue of my estate whether real or personal, or the money arising therefrom, I order and direct that the same be equally divided by my executors to and among all my children, namely: Elizabeth the widow of John Smith deceased, Polly the wife of Michael Kagerize, George, Michael, Sarah the wife of John Lutz, Leah, Rachel and Samuel, share and share alike Provided however that if any of my children above named should made a charge for services rendered after they become of age, the same be deducted form their respective legacies above bequeathed to them. And lastly I nominate and appoint my two sons, George Fry and Samuel Fry to be the executors of this my last will and testament hereby revoking all other Wills by me heretofore made and declaring this and no other to be my last will and testament. In witness whereof I have hereunto set my hand and seal the twenty sixth day of February Anno Domini one thousand eight hundred and forty four. Johannes Frey (seal) Signed, sealed, published, and declared by the said John Frey as his last will and testament in the presence of us, who in his presence and at his request have subscribed out names as witnesses. The interlining of the word “sell” within was done before signing. Christian Echternach John Wilson I John Fry the testator named in the foregoing will do hereby made this Codicil to be added and become a part of the aforesaid Will. Whereas I have understood that my son George Fry who is one of the executors named in my said Will intends moving some distance from the neighborhood, which would render his duties as executor inconvenient, I so hereby revoke said appointment and in lieu of my son George Fry I do hereby nominate and appoint my friend Adam Hoh who with my son Samuel are to be the executors of my last will and testament. In witness whereof I have hereunto set my hand and seal the eleventh day of November in the year of out Lord one thousand eight hundred and forty four. Signed, sealed, published and de Johannes Frey (seal) clared by the said testator as a Codicil To his last will and testament in the Presence of John Wilson Lancaster County, On the ninth day of May Anno Domini 1845. Before me the Subscriber personally appeared Christian Echternach and John Wilson the subscribing witnesses to the preceding Will, and on their solemn Affirmations say, that they were present and saw and heard John Frey the testator therein named sign, seal, publish, pronounce and declare the same to be his last will and testament; ;and John Wilson, the subscribing witness to the annexed Codicil, testifies as above regarding the same, and at the doing thereof, the testator, was of sound and well disposing mind, memory and understanding, to the best of their knowledge, observation and belief. Letters Testamentary granted to Adam Hoh and Samuel Frey, the executors, they being duly affirmed well and truly to administer the goods and chattels, rights and credits of the said testator according to law, and also they will diligently and faithfully regard and well and truly comply with the provisions of the Law relating to Collateral Inheritances.
