I George Hagenberger of Donegal township county of Lancaster, and state of Pennsylvania, being old and infirm, but of sound memory and understanding, blessed be God for the same; considering the uncertainty of this worldly life, do make and publish this my last will and testament, in manner and form following, to wit. Principally and first of all I command my soul into the hands of God, and my body to the earth to be buried in a decent manner at the discretion of my executors herein after mentioned. And as to such worldly estate wherewith it has pleased God to bless me with in this life, I give, devise, and dispose of the same as follows. It is my will that my beloved wife Anamary shall have liberty of taking so much and all such goods of household furniture, beads, and other necessaries as she shall think fit to her own use during her natural lifetime. And the remainder of my personal estate not taken or owned by loving by the said bequeath, shall be sold by said executors, and the money or proceeds thereof equally divided among my children; my children George Hagenberger, Jacob Hagenberger, Catharine Hagenberger, who was intermarried with Abraham Etter, John Hagenberger, Peter Hagenberger, Abraham Hagenberger, Elizabeth Hagenberger, Mary Hagenberger, Samuel Hagenberger, or to their heirs, or the survivors of them, at the arrival of their respective full ages and to no other person or persons, to be detained in the hands of my said executors until of age as aforesaid. And as to my real estate of whatever the same may be shall be enjoyed and possessed by my loving wife, Anamary, during natural lifetime, if she remains my widow; and after her decease, my said wife Anamary; my sons shall and may divide all said real estate, if they can agree, and if they cannot agree, to sell the same and execute a title therefore to the purchaser or purchasers, them paying thereout unto the rest of my children above named or to their heirs, or the survivors of them, and to no other person or persons, an equal share, and all such shares to remain in the real estate till they or any of them shall respectively arrive at the age of maturity. And lastly, I nominate and appoint my son John Hagenberger, and my son Jacob Hagenberger, to be the executors of this my last will and testament. Hereby revoking and annulling all other wills and bequeaths by me heretofore made, declaring this and no other will and testament. In witness whereof, I have hereunto set my hand and seal, at Donegal township aforesaid the twenty fifth day of March A. D. one thousand eight hundred and twenty two, in the presence of the subscribing witness hereto, who at my request have witnessed the same. Lancaster County On the 21st day of January 1831 before me the subscriber personally appeared John Kendig and David Brubaker who being duly qualified according to law, did and say that they were personally acquainted with George Hachenberger the testator in the preceding instrument in writing named for upwards of twenty years, that they are acquainted with the hand writing of the said deceased, having seen him write and that they verily believe the name “George Hachenberger” subscribed thereto is the proper hand writing of the said George Hachenberger, now deceased, and that he the said deceased at the date and execution of the said instrument in writing, was of sound and well disposing mind, memory and understanding and continued so up to the time of his death on the 5th day of December 1830 to the best of their knowledge, observation, and belief. And the said Dabid Burbaker, did further declare andsay that Allowy Gamp, one of the subscribing, one of the subscribing witnesses to the said instrument, is absent from the neighbourhood of the deceased, and has not been heard from for 6 yearsand upwards, and cannot therefore be had or found to give his testimony: and that George Hollinger, the other subscribing witness, has died previous to the death of the said George Hachenberger, and that upon diligent search made, no person could be found on the neighbourhod as aforesaid, to prove the handwriting of the said Alloy Gamp, . And further saith not Johannes Kendig Affirmed and subscribed David Brubaker the day and year aforesaid John Bachman Jun. Deputy Reg. Lancaster County. On the 20th day of January, anno domini 1831. Before me the subscriber personally appeared Pallon Ross and Robert s. Currey esquires, who bing duly qualified according to law, did depose, declare, and say that they are well acquainted with the handwriting of George Hollinger esq. one of the subscribing w;itnesses to the within will, that they have frequently seen him write, and that they verily believe the name of G,. Hollinger subscribed as a witness to the said will, is the proper hand writing of the said George Hollinger. And further saith not Pallon Ross Same day Pallon Ross sworn Robt.
