I John Nees of the Borough of Lancaster in the County of Lancaster and State of Pennsylvania yeoman being sick and weak in body but of sound and disposing mind memory and understanding do make and declare this my last will and testament in manner following to wit: I commend my soul to God and my body to the earth to be decently interred as my executors shall direct in humble hope of a glorious Resurrection and an happy admission into the Regions of immortal bliss and glory in and through the merits of my mediator and Redeemer Jesus Christ and as to such worldly estate wherewith God hath bless me: I do give devise and dispose of the same in manner following to wit: Imprimis it is my will and I do order and direct that my just debts and funeral expences be paid and satisfied as soon as conveniently me be done after my decease – Item I do I do give and bequeath unto my eldest brother Adam Nees the Sum of five pounds in gold or silver coin to be paid to him out of my personal estate in one year after my decease, which together with the sum of twenty pounds he is justly indebted and owing unto me and which I hereby remit and forgive him, shall be in full of and for his part or share, and all claims and demands whatsoever of in to or out of my estate Item I do give and bequeath unto my nephew John Nees (son of my said brother Adam) the sum of ten pounds in gold or silver coin to be paid to him out of my personal estate in one year after my decease, which shall be in full of and for his part or share and all claims and demands whatsoever of into or out of my estate – Item I do give and bequeath unto my brother Jacob Nees the sum of ten pounds in specie of gold or silver coin to be paid him out of my personal estate in one year after my decease, which shall be in full of and for his part or share, and all claims and demands whatsoever of in to or out of my estate – Item I do give and bequeath out of my personal estate unto or for the use of the poor of the Religious Society of People or Congregation to which I belong settled and established in the township of Cocalico in the said County of Lancaster the sum of five pounds in specie of gold or silver coin to be paid to the overseers of the said Congregation or Society as soon as conveniently may be done after my decease and to be distributed to and amongst the said poor or applied to their use and benefit in such manner as the said overseers for the time being shall think proper and direct – Item I do give and bequeath and order to be paid out of my personal estate unto the Superintendants for the time being of the burial ground where I may happen to be interred the sum of five pounds in gold or silver coin to be paid as soon as conveniently may be done after my decease and to be applied for and towards repairing such burial ground and the inclosure thereof – Item I do give devise and bequeath unto my beloved wife Salome all and singular my messuages, tenements, lands, Hereditaments and real estate whatsoever and wheresoever and every part and parcel thereof with their and every of their rights members and appurtenances and also all the rest residue and remainder of my personal estate (not herein before particularly bequeathed) to hold to her my said wife Salome her heirs Executors Administrators and assigns to and for her and their proper use benefit and behoof forever. And lastly I do hereby nominate constitute and appoint my said wife Salome and my trusty friend William Dishong of Cocalico township in the County of Lancaster aforesaid and the survivor of them Executrix and Executor of this my last will and testament, hereby revoking and declaring null and void all former and other will or wills testament and testaments by me made and declaring this and no other to be my last will and testament. In witness whereof I have here unto set my hand and seal the twenty first day of August in the year of our Lord one thousand seven hundred and ninety three. Signed, sealed, published, pronounced and declared by } The testator John Nees as & for his last will and testament in } The presence of us who in his presence and at his request have } Subscribed our names as witnesses thereto. } John Nees {seal} Michael Lind, Jacob Mayer, Philip Gloninger } Whereas William Dishong one of the Executors by me constituted and appointed in and by my last will and testament within & afore written is lately deceased, therefore in order to supply the vacancy occasioned by the death of the said William Dishong, I the said John Nees the testator in the afore written will named still being of sound and disposing mind memory and understanding do by this my codicil to my said Last will and testament nominate constitute and appoint my trusty friend George Hensel of the Borough of Lancaster in the County of Lancaster Executor (with my wife Salome therein named and appointed of my said last will and testament within and aforewritten in the room and stead of the said William Dishong deceased hereby ratifying and confirming the within and foregoing writing in every respect as and for my last will and testament and declaring this codicil to my said testament. Before me the subscriber personall appeared Michael Lind Jacob Mayer and Philip Gloninger the three subscribing witnesses to the foregoing will the said Michael Lind and Jacob Mayer upon their corporal oaths and the said Philip Gloninger upon his solemn affirmation according to law did depose declare and say that they were present and saw and heard John Nees the testator therein named sign seal publish pronounce and declare the foregoing writing as and for his last will and testament and that at the doing thereof he was of sound and well disposing mind memory and understanding to the best of their knowledge observation and Belief --- G. Register Lancaster County SS On the 5th day of November Anno Domini 1807 before me the subscriber personally appeared Jacob Mayer and Philip Gloninger the two subscribing witnesses to the foregoing Codicil the said Jacob Mayer upon his corporal oath and the said Philip Goninger upon his solemn affirmation according to law did depose declare and say that they were present and saw and heard John Nees the testator therein named sign seal publish pronounce and declare the foregoing writing as and for a codicil to and part of his said last will and testament and that at the doing thereof he was of sound and well disposing mind memory and understanding to the best of their knowledge observation and belief. -- G. Register Be it Remembered that on the 5th day of November Anno Domini 1807 the last will and testament and Codicil of John Nees deceased were proved in due form of law and Letters Testamentary thereon where granted to Salome Nees and George Hensel the Executors therein named, they having first been duly qualified well and truly to administer the estate of the said deceased, especially to exhibit a true and perfect Inventory thereof into the Registers Office at Lancaster within one month from this date and to render a true and just account of their Executorship on said estate in one year ore when there to lawfully required.
