I Christian (sic) Sherbb, of Cocalico township in the county of Lancaster and state of Pennsylvania, yeoman, being weak in body but of sound mind, memory, and understanding, blessed be God for the same, do make and publish this my last will and testament in manner and form following, to wit, Principally and first of all I commend my immortal soul into the hands of God who gave it, and my body to the earth to be burieth in a decent and Christian like manner…And as to such worldly state wherewith it hath pleased God to bless me in this life, I five and dispose of the same in the following manner, so I give and devise unto my wife Catharine, one bed and bedstand, a chest, two wheels, one large wheele, and spinning wheel, and all the kitchen furniture as she brought to me, and further give and devise unto my wife Catharine, during her natural life, the liberty and privilege to live in the chamber of my dwelling house and also the liberty and privilege in the kitchen, to cook and dress her victuals, and the use of the third part of the garden. I further give and devise unto my wife Catharine, the sum of ten pounds good and lawful money of Pennsylvania to be paid unto her yearly out of my real estate during her natural life. And it is further my will, and I order and direct, that my real and personal estate shall be equally divided amons my children or their legal representatives viz Adam Sherpp, (John Sherbb, & Susanna, the wife of Isaac Gushard, two of the children of my son Christopher Sherbb, deceased), Jacob Sherbb, Elizabeth, the wife of Jacob Young, and John Sherbb, in the manner following, my executors shall cause the same to be divided into lots as follows, the dwelling house and other buildings, and all the clear land with as much timberl land as my executor shall judge sufficient, shall be one lot, and the remainder of my land shall be divided in five acre lots as near as can be, and after the same shall be so divided my said children or their legal representatives shall all be notified by my executor to meet, and to agree to divide the said lots & value them amongs themselves; and if they cannot agree in dividing or valuation the said lots or whatever lot or lots they cannot agree my executor shall expose the same to sale at public vendue, and divide the money amongs my five children or their legal representatives share and share alike, but if one or more of my children should take one or more of said lots, that the sum which the same was valued at will amount to more than his or their share, the same shall be paid and distributed amongst the others, so that their shall be an equal division amongst all my children. I further give and devise unto my daughter Elizabeth, the wife of Jacob young, the one half of the share which is coming unto her out of my esate, on this condition, if she dies without issue, the same shall fall to my other children, and if the said Jacob Young should take any land he shall have no more but what will amount to the one half of the share coming to my daughter Elizabeth, the other half of her share shall remain int the hands of my executor who shall put the same on interest, if he can put it out safe, & the said Elizabeth Young shall be given unto her for her maintenance when necessary. And I also empower my executor to give good and lawful deeds to my children or the purchasers of my land which shall be as good in law as if I had given them myself. And of my last will & testament I nominate, constitute and appoint my friend and neigbour Michael Oberlin executor and declare this and no other to be my last will and testmanet. Lancaster County SS. On the 19th day of October, anno domini, 1807. Before me the subscriber personally appeared Jacob Hibshman and Michael Oberlin, the two subscribing witnesses to the within and foregoing willl who upon their solemn affirmations, according to law, did severally declare and say, that they and each of them were personally present, and saw & heard Christopher Sherbb, the testator in the foregoing will named, sign, seal, publish, pronounce and declare the within and foregoing writing, as and for his last will & testament & at the doing thereof he was of sound and well disposing mind, memory, and understanding, to the best of their knowledge, observation & belief. G. Ross. Reg. Be it remembered, That on the 19th day of day of October, anno domini, 1807. The last will and testament of Christopher Sherbb, late of Cocalico township, Lancaster County, yeoman, deceased, was proved in due form of law and letters testamentary thereon were granted to Michael Oberlin, the executor therein named, and appointed, he having first been duly qualified well and truly to administer the estate of said deceased; especially to exhibit a true and perfect inventory thereof into the Registers Office at Lancaster, within one month, and to Inder a just and true account of his executorship on said estate in one year from this date, or when thereto lawfully required.
