All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/lebanon/ _______________________________________________ 1812 - Recorded 1822 Lebanon County PA Vol B Pages 566-567 Know all men by these presents that I John Hochtetter of Annville township in the County of Dauphin and in the State of Pennsylvania Yeoman am held and firmly bound unto Jacob Gingrich of the same place Yeoman in the sum of four thousand four hundred and seventy dollars lawful money of Pennsylvania to be paid to the said Jacob Gingrich or to his certain Attorney Executors Administrators or Assigns to which payment well and truly to be made and done. I do hereby bind myself my heirs Executors and administrators and every of them firmly by these presents sealed with my seal dated the ninth day of March in the year of our Lord one thousand eight hundred and twelve Whereas the lands and real Estate of John Gingrich the father of the above Jacob Gingrich was lately appraised by order of the Orphans Court of Dauphin County and divided between the said Jacob Gingrich and John Gingrich and that part thereof which adjoins the lands of Joseph Gingrich, Abraham Buckholder & Others Containing one hundred and twenty seven acres was by the said Orphans court alotted and confirmed unto the said Jacob Gingrich subject to the payment of the several and respective shares of the children of the said John Gingrich deceased and the interest arising from and accruing and growing due upon the sum of Two thousand two hundred and thirty five dollars and nine cents being the one third part of the valuation and appraisement of the said land for the use of the Widow of the said John Gingrich deceased yearly and every year during her life and after her death to the payment of the principal sum of two thousand two hundred and thirty five dollars and nine cents to the children and heirs of the said John Gingrich deceased in equal shares the said Jacob Gingrich to have and receive his equal share with the other children in the same. And Whereas the said Jacob Gingrich and wife have by their deed bearing equal date with these presents sold and conveyed the said tract or piece of land of one hundred and twnety seven acres and thirty nine perches unto the said John Hochtetter in fee and the said John Hochstetter having retained the said sum of two thousand two hundred and thirty five dollars and nine cents of the purchase money in his hands and it was agreed and so reserved and excepted in and by the said deed from the said Jacob Gingrich to the said John Hochstetter that he the said John Hochstetter shall and will pay the interest arising on the said sum unto the Widow of the said deceased yearly and every year during her life and after her death the said principal sum to the heirs of the deceased as aforesaid. Now the Condition of the above or within obligation is such that if the said John Hochstetter his heirs Executors and Administrators or any of them shall and do well and truly pay or cause to be paid unto Elizabeth Gingrich Widow of the said John Gingrich deceased the interest arising from and accruing or growing due upon the said principal sum of two thousand two hundred and thirty five dollars and nine cents yearly and every year during her life and after her death shall and do well and truly pay or cause to be paid unto the children and heirs of the said John Gingrich deceased or their legal representtives (the said Jacob Gingrich to be one of them) the said principal sum of Two thousand two hundred and thirty five dollars and nine cents according to the order and decree of the said Orphans Court and the Act of Assembly in such case made and provided And shall and do save harmless and keep indemnified the said Jacob Gingrich his heirs Executors and Administrators and every of them of and from all damages costs trouble and expences which he or they or any of them shall or may be put unto or sustain by reason of the premises that then this obligation to be void or else to be and remain in full force and virtues Sealed and delivered in the presence of Heinrich Mayer Jno Gloninger John Hosteter (seal) Recorded the 20th day of May AD 1822 Henry Kelker Recorder I John Hochstetter having purchased the lands appraised and alotted to Jacob Gingrich late the Estate of John Gingrich dec'd Containing one hundred and twenty seven acres and thirty nine perches from the said Jacob Gingrich and having retained in my hands the several and respective shares of all the children of the said John Gingrich deceased of and in the said valuation & Appraisment money except that part thereof which is coming unto the said Jacob Gingrich deceased which I have paid. I therefore do hereby promise to pay unto each and every of the other children of the said John Gingrich deceased their several and respective shares of and in the valuation or apprisement money of the said tract of lands so as aforesaid alotted and confirmed unto the said Jacob Gingrich according to the order of the orphans court.
