This became most the town of Annville, now Lebanon Co PA. Thomas Penn and Richard Penn Esq. true and absolute Proprietaries and Governors in Chief of the Province of Pennsilvania and Counties of New Castle Kent and Sussex on Delaware To all unto whom these Presents shall come Greeting Whereas by virtue of a Warrant under the Seal of our Land Office bearing date the Second Day of August in the Year of our Lord 1742, a Survey was made unto one Francis Reynolds on a Certain Tract of one hundred & thirty two Acres of Land Situate on Quitapohelia Creek in Lebanon Township in the County of Lancaster Under certain Conditions in the said Warrant mentioned Which Conditions not having been complied with by the said Francis Reynolds the same Warrant and Survey made in pursuance thereof are become utterly Void, as in and by the said Warrant remaining in our Surveyor General's Office, Relation being thereunto has does manifestly appear And Whereas afterwards in and by a Warrant bearing date the Eleventh Day of February 1747, upon Application made to us by Andrew Miller of the said County, our Surveyor General was required to accept and receive unto his Office the Survey of the said Tract of Land, and to make return these of into our Secretary's Office for the Use and Behoof of this Andrew Miller, which Survey being accordingly accepted by our Surveyor General and by him duly returned into our Secretary's Office the Metes and Bounds of the same are setforth and described as follows Viz. Beginning at a marked White Oak by the Side of this Creek and from thence extending by Henry Wistler's Land North forty two Degrees West forty eight Perches to a marked White Oak and North seventeen Degrees West fifty two Perches to a marked White Oak, Thence by John Brightbill's and South Seventy three Degrees West one hundred & fifty Perches to a marked Hickory, Thence by Mathias Bumbgarner's Land South ten Degrees East one hundred & seventeen Perches to a marked Elm standing by the said Creek thence up the same on the several Courses thereof two hundred and twenty Perches to the Place of Beginning containing one hundred and thirty two Acres and the Allowance of six Acres per Cent for Roads and Highways Now at the Instance & Request of this Andrew Miller that we would be pleased to grant him a Confirmation of the same Know ye that in Consideration of the Sum of Twenty Pounds nine Shillings and two pence lawful Money of Pennsilvania to our Use paid by the said Andrew Miller (the Receipts whereof we hereby acknowledge and thereof do acquit and for ever Discharge the said Andrew Miller his Heirs & Assigns by these Presents and of the yearly Quit Rent herein after mentioned & reserved) We have given granted released & confirmed And by these Presents for us our Heirs and Successors Do give grant release and confirm unto the said Andrew Miller his Heirs and Assigns The said one hundred and thirty two Acres of Land as the same is now setforth bounded and Limited as aforesd. With all Mines Minerals Quarries Meadows Marshes Savannas Swamps Cripples Woods Underwood Timber & Trees Ways Waters Water Courses Liberties Profits Commodities Advantages Hereditaments and Appurtenances whatsoever thereunto belonging or in any wise Appertaining and Lying within the Bounds & Limits aforesd. Three full and clear fifth Parts of all Royal Mines free from all Deductions and reprisals for Digging and refining the same and also one fifth Part of the Oar of all other Mines Delivered at the Pitsmouth only excepted and hereby reserved} and also free leave Right and Liberty to and for the said Andrew Miller his Heirs & Assigns To Hawk Hunt Fish and Trowl in and upon the hereby granted Land and Premises or upon any Part hereof To have and to hold the said one hundred & thirty two Acres of Land and Premises - hereby granted with Appurtenances (except as before excepted) unto the said Andrew Miller his Heirs and Assigns To the only Use and Behoof of the said Andrew Miller his Heirs and Assigns forever To be Holden of us our Heirs and Successors Proprietaries of Pennsilvania as of our Manor of Conestoga in the said County of Lancaster in free & Comon Soccage by fealty only in Lieu of all other Services Yielding and Paying thereof yearly to us our Heirs and Successors at the Town of Lancaster in the said County at or upon the first Day of March in every Year from the first Day of March last past one half penny Sterling for every Acre of the same or Value thereof Coin Current according as of Exchange shall then be between our said Province by City of London to such Person or Persons as shall from time to time be appointed to Receive the same And in Case of Nonpayment thereof within Ninety Dayspast after the same shall become due that then it shall and may be lawful for us our Heirs & Successors our and their Receiver or Receivers into and upon the hereby granted Land and Premises to Reenter and the same to hold and possess until the said Quit Rent and all Arrears thereof together with the Charges accruing by means of such Nonpayment & Reentry be fully paid and Discharges - Witness Anthony Palmer Esq. President of the Council of the said Province who, in pursuance and by Virtue of certain Powers and Authorities to him for this purpose (interalia) granted by the said Proprietaries hath hereunto set his Hand and Causes the Great Seal of the said Province to be Affixed at Philadelphia this Fifteenth Day of March in the year of our Lord one thousand and seven hundred and forty seven, the Twenty first Year of the Reign of King George the Second over Great Britain and the Thirteenth Year of thesaid Proprietaries Government - Anthony Palmer (Seal) Recorded 26th Day of September 1748 ----------------------------------------------- ----------------------------------------------- After Andrew died in 1754, his eldest son, Abraham received a patent for additional land purchased by his father from Mathias Bumgartner adjacent to his Dad's patent and also the above land. Thomas Penn & Richard Penn Esquires and absolute proprietaries & Governors in Chief of the Province of Pennsylvania and Counties of NewCastle Kent & Sussex on Delaware To all unto whom these presents shall come Greeting Whereas in pursuance of a Warrant under the Seal of our Land Office Dated the ninth Day of June One thousand seven hundred & forty three there was surveyed the eighteenth Day of November the following unto Matthias Baumgardner a certain Tract of Land situate in Lebanon Township in the County of Lancaster Beginning at a marked Elm on the North side of the Quitopehela Creek thence by Land of Francis Reynolds North ten Degrees West one hundred and eighteen Perches to a marked Hickory thence by Land of John Erb South eighty Degrees West one hundred and forteen Perches to a marked Elm on said Quitopehela Creek thence down the said Creek on the several Courses seventy Perches to a marked Beach on South Side of said Creek thence by Land of John Myer and vacant Land South thirty Degrees East one hundred thirty six Perches to a marked Hickory thence by a Line of marked Trees East fifty two perches to a Post on the South Side of Quitopahela Creek aforesaid Thence up the said Creek in the Several Courses thereof eighty four perches to the place of Beginning Containing One hundred twenty two Acres of Land and Allowance of sic Acres P.Cent for Roads as in and by the said Warrant and Survey remaining in the Surveyor General's Office and from thence certified into our Secretary's Office more fully appears And Whereas the said Matthias Baumgardner by his Deed poll of the fifth Day of June One Thousand Seven hundred and fifty did bargain sell convey unto Andrew Miller of the said Township Yeoman in ? All that his said Plantation and Tract of Land under and subject to the Residue of the purchase Monies Interest & Quit Rent due and to become due to us as by the same Deed appears And Whereas in pursuance of a Warrant under the said Seal dated the twenty fifth Day of May One thousand Seven hundred & forty eight there was surveyed unto the said Andrew Miller a certain other Tract of Land situate in the said Township Beginning at a Post thence by vacant Land East twenty Perches to a Post Thence by Land of Christopher Zimmer North by East One hundred and fourteen Perches to a marked Black Oak West forty Perches to a marked Hickory and North thirty one Degrees West ninety one perches to a marked Black Oak thence by Land of John Myer West sixty perches to a marked White Oak thence by vacant Land South twenty nine Degrees East Two hundred & seventeen perches to the Place of Beginning Containing Sixty nine Acres & sixty perches and Allowance aforesaid as by the same Warrant & Survey also remaining in the said Surveyor General's Office & from thence certified into our Secretaries Office more fully appears And Whereas the said Andrew Miller died lately Intestate seized of the said two Several Tracts of Land leaving Issue Abraham his Eldest Son and Heir and Several other Children and on the Petition of the said Abraham to the Orphans Court for the County of Lancaster an Order was made appointing proper persons to Value the Real Estate of the said Intestate and on Return of the said Valuation to the said Court It was considered and ordered by the said Court at a Court held the first Tuesday in June last That on the said Abrahams paying or securing the Payment of the said younger Children's Parts & Shares of the said Valuation with the Dower or thirds of Margaret the said Intestates Widow he the said Abraham and his Heirs should hold and enjoy all his said Fathers Real Estate absolutely for ever agreeable to the Act of Assembly in that Case made and provided As by the said Order & Proceedings of the said Court more fully appears And Whereas such Security hath been accordingly given and the said Abraham hath now humbly requested us to grant him our patent of Confirmation for the said two several Tracts Now Know Ye that in Consideration of the premises and of the Sum of Twenty nine Pounds eleven Shillings and ten Pence lawful Money of Pennsylvania to our Use paid by the said Abraham Miller (The Receipts wherefore hereby acknowledges and thereof do acquit & forever discharge the said Abraham Miller his Heirs and Assigns by these presents) And of the yearly Quit Rent herein after mentioned & reserved We have given granted released and confirmed and by these presents for us our Heirs and Successors do give grant release and confirm unto the said Abraham Miller his Heirs and Assigns All those the said two Several Tracts of One hundred and twenty two Acres & sixty nine Acres and sixty perches of Land as the same are set forth bounded & limited as aforesaid With All the Mines Minerals Quarries Meadows Marshes Savannahs Swamps Cripples Woods Underwoods Timber & Trees Ways Water Water Courses Liberties Profits Commodities Advantages Hereditaments & Appurtenances whatsoever thereunto belonging or in any wise appertaining and lying within the Bounds & Limits aforesaid [Three full and clear fifth Parts of all Royal Mines free from all Deductions and Reprizals (sic) for digging and refining the Same and also one Fifth Part of the Ore of all other Mines delivers at the Pitsmouth only excepted & hereby reserved] And also free Leave Reight & Liberty to and for the said Abraham Miller his Heirs and Assigns to hawk hunt fish & trowl in & upon the hereby granted Lands and Premises or upon any Part thereof To have and to hold the said two described Tracts of One hundred & twenty two acres & sixty nine acres and sixty perches of Land and premises hereby granted (except as before excepted) with their Appurtenances unto the sd Abraham Miller his Heirs and Assigns To the only Use and Behoof of the said Abraham Miller his Heirs and Assigns for Ever To be holden of us our Heirs and Successors proprietaries of Pennsylvania as of our Manor of Conestoga in the County of Lancaster aforesaid in free & Common Loccage by Fealty only in Lieu of all other Services Yielding & paying therefore yearly unto us our Heirs & Successors at the Town of Lancaster in the said County at or upon the first Day of March in every year from the first Day of March last One - halfpenny Sterling for every acre of the same Or value thereof in Coin current recording as the Exchange shall then be between our province and the City of London to such person or Persons as shall from Time to Time be appointed to receive the same And in Case of Nonpayment thereof within ninety Days next or after the same shall become due That then it shall and may be lawful for us our Heirs and Successors our & their Receiver or Receivers into and upon the hereby granted Lands & Premises to Reenter and the same to hold and possess until the sd Quit Rent and all arrears thereof together with the Charges accruing by Means of such Nonpayment & Reentry be fully paid & discharged Witness James Hamilton Esq Lieutenant Governor of the said province who by virtue of certain Power and Authenties to him for this Purpose (interalia) granted by the sd Proprietaries hath hereunto for his Hand and caused the Great Seal of the Province to be hereunto affixed at philadelphia this sixteenth Day of October in the Year of our Lord One Thousand Seven hundred & sixty two The second Year of the Reign of King George the third over Great Britain & ? and the forty fifth Year of the said proprietaries Government James Hamilton (LS) Recorded 28 October 1762 --------------------------------
