We encourage links to the state and county table of contents. ____________________________________________________________ Elias Acker Will Book E page 163 In the name of God Amen I Elias Acker of Hollenback Township Luzerne County and State of Pennsylvania, being sick and weak in body, but of sound mind and memory and understanding Praised be God for ?? and Considering the certainty of death and the uncertainty of the time thereof, and to the end I may be the better prepared to leave this world whenever it shall please God to Call me hence, do therefore make and declare this my last will and testament in manner following, that is to say first and principally I commend my soul into the hands of Almighty God my creator, hoping for free Pardon and Remission of all my sins and to enjoy everlasting happiness in the heavenly Kingdom through Jesus Christ my Saviour, my body I commit to the Earth at the discretion of my friends, first: I will that all my just debts as shall be by me owing at my death together with my funeral expenses and all Charges touching the Proving of or otherwise concerning this my will, shall in the first place out of my Personal Estate and Effects be fully Paid and satisfied: And from and after payment thereof and subject thereto then my Will is that all the Residue of my Goods chattel and Real Estate shall be Impartially appraised and after such appraisement the same shall be sold at Public sale for the best price that can be obtained for it, and then my will is that the same Proceeds of Sales of all my Estate be Divided into Seven shares and first, I give and Bequeath unto my Mary the Interest of one share during the term of her Natural life and at her death the Principle to Revert back and be Equally divided Between my heirs. Then my will is that my daughter Hannah shall have one share then my will is that my daughter Mary shall have one share then I will that my son Lafayea shall Receive the interest of one share During his lifetime then to Revert back to the other heirs - to my daughter Abbey I give and Bequeath the Interest of one share during her life time and at her death the Principle to go to her heirs, to my daughter Emma I give and Bequeath one share but the said share to be one hundred dollars less than a full share, to my daughter Elmina I give and Bequeath the Interest of one share during her life and at her death her heirs to Receive the Principle And to the three heirs of My son Charles Acker I give and Bequeath each the sum of Five Dollars as the full share of the said Charles Acker. And I make and ordain Mary Acker my wife, and John Klinger Executors of this my last will and Testament. In witness whereof I have hereunto set my hand and seal this twentieth day of November A.D. 1870 Signed Elias Acker Signed & sealed in Presence of Peter Hart J.R. Maurer Registers Office Wilkes Barre 6 February 1871 Luzerne County S.S. This day before me C.C. Plotz, Esq., Register for the probate of Wills and granting Letter of Administration and for the County aforesaid, personally came Peter Hart one of the subscribing witnesses to the above and foregoing last will and testament of Elias Acker late of Hollenback Township Luzerne County and State of Pennsylvania deceased, who being duly sworn according to law, doth say that he was present and saw and heard Elias Acker the testator, sign seal publish pronounce and declare the foregoing instrument of writing as and for his last will and testament and that at the time also doing he was of sound mind memory and understanding to the best of his knowledge and belief and that he did sign his name as subscribing witness in the presence of J.R. Maurer the other subscribing witness and in the presence and at the request of the said testator. Signed Peter Hart Sworn and subscribed before me the day and year above written. Signed J.A. Plotz, Esq., Register for the probate of Wills and granting Letter of Administration and for the County aforesaid, personally came J. R. Maurer one of the subscribing witnesses to the above and foregoing last will and testament of Elias Acker late of Hollenback Township Luzerne County and State of Pennsylvania deceased, who being duly sworn according to law, doth say that he was present and saw Elias Acker the testator, sign & seal the foregoing instrument of writing and that at the time of so doing he was of sound mind memory and understanding to the best of his knowledge and belief and that he did sign his name as subscribing witness in the presence of Peter Hart the other subscribing witness and in the presence of and at the request of the said testator. In conformity to the above and foregoing Will and the probate thereof Citation having first been issued to Mary Acker Executrix and Peter Hart and J.R. Maurer witnesses to said will, to bring in and prove it, Letters Testamentary were granted to John Klinger one of the Executors named in the said will (Mary Acker the other Executrix having renounced her right by paper filed) he having first been duly sworn to well and truly administer the goods and chattels, rights and credits which were of Elias Acker the said decedents Estate according to law.
