We encourage links to the state and county table of contents. ____________________________________________________________ Peter Roth, Butler Book C, page 544, Luzerne Co., PA Peter Roth Will In the name of God Amen: I Peter Roth of Butler Township Luzerne County Pennsylvania being weak in body and of sound mind memory and understanding praised by God for the same do make and publish this my last Will and Testament in manner and form following: And first I direct that my body be decently interred after my decease and my grave marked by a pair of suitable marble tombstones: and of such worldly estate as it hath pleased God to intrust me with I direct that the personal property belonging to me be sold by my hereafter named executors as soon after my decease as convenient and all my debts and funeral expenses paid, and whatever my estate shall amount to after all expenses are deducted I direct that it shall be equally divided among my ten children or their heirs share and share alike. That is to my son Simon and his heirs one tenth part of the whole, unto my son Daniel and his heirs alike tenths (sic) to my son Andrew and his heirs alike one tenth, unto my son Elias and his heirs alike one tenth, unto my son Jonas and his heirs alike one tenth, unto my son Peter and his heirs alike one tenth, unto my son Samuel and his heirs alike one tenth, unto my daughter Elizabeth and her heirs one tenth, unto my daughter Catherine and her heirs one tenth, and unto my daughter Sarah and her heirs one tenth, should she need it in her life time - but should she not need it in her life time the said one tenth falling to her shall be placed out at interest and the interest thereof annually paid to her and after her decease the principle to be paid to her heirs share and share alike. ~ And I do nominate and appoint my sons Simon & Peter my executors of this my last Will and testament hereby revoking and making void all and every other will or wills at any time heretofore by me made and do declare this my last Will and Testament. In witness whereof I have hereunto set my hand and seal this fourth day of September in the year of our Lord one thousand eight hundred and sixty-two. Signed Peter Roth Signed, sealed and declared and published by the above named Peter Roth as and for his last Will and testament in the presence of us who at his request and in his presence have subscribed our names as witnesses thereto. Signed Daniel Santee Signed Samuel Benner Luzerne County S.S. Be it remembered that on the 14th day of September A.D. 1863 before me Geo. B. Kulp Esquire Register for the Probate of Wills and granting Letters of Administration in and for the County aforesaid personally came Daniel Santee and Samuel Benner the subscribing witnesses to the above and foregoing last Will and Testament of Peter Roth of Butler Township Luzerne County and State of Pennsylvania deceased who being duly sworn according to law do say that they were present and saw and heard Peter Roth the testator sign seal publish pronounce and declare the foregoing instrument of writing as and for his last Will and Testament and that at the time of so doing he was of sound mind memory and understanding to the best of their knowledge and belief, and that they did sign their names as witnesses in the presence of each other and in the presence and at the request of the said testator. In conformity to the above and foregoing Will and the Probate thereof Letters Testamintary were this day granted unto Simon Roth and Peter Roth the executors therein named they having first been duly sworn to well and truly administer the goods and chattels rights and credits which were of said testators estate according to law.
