Will of Charles Shiber I, Charles Shiber of the City of Wilkes-Barre, County of Luzerne, and State of Pennsylvania, being of sound mind, memory, and understanding, do make and publish this, my last will and testament, hereby revoking and making void all former wills by me at any time heretofore made. And first I direct that my body be decently interred and that my funeral be conducted in a manner corresponding with my estate and condition in life. I direct my executor hereinafter named to pay all my just funeral expenses together with such other items of expenses as I shall herein after direct. I give, devise, and bequeath unto my Son Charles C. Shiber, his heirs and assigns forever, all my property, real, personal and mixed, of what nature or kind soever and wheresoever the same shall be at the time of my death, subject nevertheless to the following legacies hereinafter enumerated, and to be paid by him the said Charles C Shiber. First, I direct that within one year from the date of my death, he the said Charles C. Shiber will pay unto Anna M. Roze11e, my daughter, the sum of one thousand Dollars. Second, I direct him, the said Chas C. Shiber to pay within two years from my death the sum of one thousand dollars to be invested in real estate in the name of Charles C. Shiber, in trust for my son Alfred Shiber, he the said Alfred to enjoy the use and benefit thereof, and that upon the death of the said Alfred Shiber, this trust estate shall descend in fee unto the children of the aforesaid Alfred. Third, I will and direct that my son Chas C. shall pay unto my grandchildren herein after named upon their attaining the age of twenty-one years respectively the sums of money hereinafter named to wit; unto Alfred Joseph Frey, twenty-five dollars; unto Henry Eiger Frey, twenty five dollars; unto Charles William Frey, fifty dollars; unto George Franklin Frey, twenty-five dollars; unto William Herd Frey, fifty dollars; unto Walter Sterling Frey, twenty-five dollars; unto Raymond Frederick Shiber, twenty-five dollars, unto Walter George Shiber, twenty-five dollars; unto Bertha Goyne Shiber, one hundred dollars. Fourth, I also will and direct that he the said CharIes C. Shiber shall pay the following sums of money for monuments as follows: for a monument to be placed over the grave of my deceased son George Shiber, two-hundred dollars; and the sum of five-hundred dollars to be expended for a monument to be placed over my own grave. Lastly, I do hereby constitute and appoint my said son Charles C. Shiber, sole executor of this my last will and testament. In witness whereof I, Charles Shiber, the testator have to this my will written on one sheet of paper set my hand and seal this day of September A.D. One Thousand Eight Hundred and Ninety One. Foster Be it remembered that I, Charles Shiber, of the City of Wilkes-Barre, County of Luzerne and State of Pennsylvania, do hereby make a codicil to my last will and testament, dated _____ day of September, A.D. one thousand eight hundred and ninety-one. WHEREAS, I the said Charles Shiber, being desirous of altering my will in respect to the devise of all my real estate do therefore make this present writing which I will and direct to be annexed as a codicil to my said will and taken as a part thereof. Item- I give and devise all that certain lot, piece or parcel of land with the improvements thereon known as the Homestead where I now reside, to my daughter-in-law, Mary Morrow Shiber, wife of my son, Charles C Shiber, situate on the Westerly side of North Washington Street, and being more particularly described in deed of Ziba Bennett and wife to Charles Shiber, dated the 12th day of June, 1872, and recorded in Deed Book No. 177, page 533. I make the above devise to my daughter-in-law because of the care I have been to her during the many years which I have resided with them, and for the cars and attention she has shown me on so many occasions. In all other respects I do ratify and confirm my said will in everything, except where the same is hereby revoked and altered as aforesaid. In witness whereof, I the said Charles Shiber, have to this codicil set my hand and seal this 25th day of February A.D. 1910. Gallagher, Register of Wills in and for the County aforesaid personally came M.H. McAniff one of the subscribing witnesses to the above and foregoing last will and testament of Charles Shiber of the City of Wilkes-Barre, Luzerne County and State of Pennsylvania deceased who, being duly sworn according to law, says he was present and saw and heard Charles Shiber the testator sign, seal, publish, pronounce and declare the foregoing instrument of writing as and for his last will and testament, and that at the same time of so doing he was of sound mind, memory and understanding to the best of his knowledge and belief, and that he did sign his name as a subscribing witness in the presence of Charles D. Register of Wills in and for the County aforesaid personally came Robert Alexander who being duly sworn according to law, says that he was well acquainted with Charles D. Foster a late resident of the City of Wilkes-Barre, in the County of Luzerne, State of Penna.,, who was one of the subscribing witnesses to the last will and testament of Charles Shiber late of the City of Wilkes-Barre, Luzerne County and State of Pennsylvania, deceased; that he is familiar with the handwriting of said Charles D. Foster having frequently seen him write his own name as well as other matters that the said Charles D. Foster is now dead, that he has carefully examined the signature Charles D. Foster to the aforesaid last Will and Testament date the ___ day of September, A.D. 1891, and verily believes the same to be the own proper handwriting of said Charles D. Foster. Davis the subscribing witnesses to the above and foregoing last will and testament of Charles Shiber of the City of Wilkes-Barre, Luzerne County and State of Pennsylvania deceased who, being duly sworn according to law, says he was present and saw and heard Charles Shiber the testator sign, seal, publish, pronounce and declare the foregoing instrument of writing as and for his last will and testament, and that at the same time of so doing he was of sound mind, memory and understanding to the best of his knowledge and belief, and that he did sign his name as a subscribing witness in the presence of Charles D. Having considered the testimony offered in this case and filed the same of record, I do adjudge the foregoing writing to be duly proved as the last Will and Testament of the said Charles Shiber now deceased, and as such I do enter the same of record according to law.
