Whereas Jacob Bealert father of the said Elizabeth White being seized in his demesne as of fee of and in a certain messuage plantation and tract of land situate in Merion township late in the County of Philadelphia now in the County of Montgomery and being so seized of the said premises by his last Will and testament in writing bearing date the third day of March One thousand seven hun- dred and seventy did will in the words following to wit: " All the residue of my Estate shall be divided equally amongst my five children namely Rudolph and Mary Latch (one share) Jacob David Susannah & Elizabeth Bealert share and share alike their heirs and assigns forever. And further that my children endeavour to agree on a moderate value of my real Estate and whenso agreed the aforesaid Rudolph and Mary Latch shall have the first choice thereof at the said moderate value so fixed on payment or causing to be paid unto each and every of the rest of my said children one equal and just part or portion in and to the said real Estate so equally divided and the said Rudolph Latch and Mary his wife on paying as is before directed shall have hold enjoy and occupy the same for their own proper use and behoof and their heirs and assigns forever". And sometime after making the said Will the said Jacob Bealert died seized of the said premises in his Estate aforesaid having previously mortgaged the same for securing the payment of a certain debt or principal sum with interest for the same. And Whereas the said Rudolph Latch and the children of the said Testator did verbally agree upon the value of the aforesaid Real Estate agreeably to which the said children of the said testator were to have and receive the sum of Sixty five pounds each from the said Rudolph Latch for their respective shares and interests in the said premises which said Rudolph Latch who was the father of the said Jacob Latch party hereto is since also deceased. Now This Indenture Witnesseth That the said Benjamin White and Elizabeth his wife for and in consideration of the sum of Sixty five pounds lawful money of Pennsylvania unto them in hand well and truly paid by the said Jacob Latch at and immediately before the sealing and delivery hereof the receipt whereof the said Benjamin White and Elizabeth his wife do hereby ack- nowledge and thereof and therefrom acquit and forever discharge the said Jacob Latch his heirs and assigns by these presents Have granted bargained & sold aliened enfeoffed and confirmed and by these presents do grant bargain sell alien enfeoff release and confirm unto the said Jacob Latch and to his heirs Executors ad- ministrators and assigns p 152 All that their part and share of in and to the Real Estate lands tenements & here- ditaments late of their father the said Jacob Bealert deceased which they the said Benjamin White and Elizabeth his wife or either of them are intitled to under the said recited last will and testament or otherwise howsoever Together with all the rights liberties priviledges members and appurtenances whatsoever to their said part or share belonging or in any wise appertaining and the reversions & remainders rents issues and profits thereof accruing or to accrue and all the Estate right title interest property claim & demand whatsoever of them the said Benjamin White and Elizabeth his wife or either of them in law equity or otherwise howsoever of in and to the same To have and to hold all and singular the hereby granted or mentioned to be granted premises with the apurtenances unto the said Jacob Latch his heirs and assigns to the only proper use benefit and behoof of him the said Jacob Latch his heirs Executors administrators and assigns forever Under and Subject to the afore- said mortgage & to the mortgate monies due or hereafter to grow due and payable in conveyance of the same and subject also to the right and Estate in the said premises of the heirs and devisees of the said Rudolph Latch deceased and of her the said Mary Latch widow and relict of the said Rudolph Latch deceased And the said Benjamin White and Elizabeth his wife for themselves their heirs Executors and administrators do covenant promise and agree to and with the said Jacob Latch his heirs Executors administrators and assigns by these presents that they the said Benjamin White & Elizabeth his wife and their heirs Executors and administrators respectively all and singular the said premises hereby granted or mentioned so to be with the ap- purtenances unto the said Jacob Latch his heirs Executors administrators and assigns against them the said Benjamin White and Elizabeth his wife and their heirs respectively and against all and every other person or persons whatsoever lawfully claiming or to claim by from or under him her them or any or either of them shall and will subject as aforesaid warrant and forever defend by these presents And further that he she or they shall and will at any time when thereunto required make execute and acknowledge all and every such further & other acts deeds and devises in the law as he the said Jacob Latch his heirs Executors ad- ministrators and assigns or any or either of them or his or their Counsel learned in the law shall advise devise or require for the better assuring and conveying the premises hereby granted or mentioned to be granted with the appurtenances unto the said Jacob Latch his heirs Executors administrators and assigns In Witness Whereof the said Benjamin White and Elizabeth his wife have set their hands and seals hereunto dated the day and year first above written Sealed and delivered in the } Benjamin White {seal} presence of us } her NB the word (after) being first interlined} Elizabeth X White {seal} in the 20th line of the first page} mark Robert Loller Mary Loller } Received on the day of the date of the above and afore going Indenture of the above named Jacob Latch the sum of Sixty five pounds lawful money of Pennsylvania it being the full consideration money in the said Indenture mentioned we say received per us witness present at signing Benjamin White Robert Loller Mary Loller p 153 The twelvth day of March Anno Domini 1795 before me the subscriber one of the Judges of the Court of Common Pleas for the County of Montgomery came the above named Benjamin White and Elizabeth his wife and acknowledged the above and foregoing In- denture to be their act and deed and desired that the same might be recorded as such acording to law the said Elizbeth being of full age secretly and apart from her said husband by me examined did declare that she voluntarily consented thereto without any coercion or compulsion of her said husband the contents of the said Indenture being first made known unto her Witness my hand & seal Robert Loller {seal} Recorded 13th October 1795
