The twenty third day of February in the year of our Lord One thousand seven hundred & ninety five I Abraham Gerhard of Douglass Township in the County of Montgomery and State of Pennsylvania Yeoman being very sick and weak in Body but of prefect Mind and Memory, Thanks be given unto God therefore Do hereby make my Last Will & Testament in Manner and form following, That is to say, First I will that all my just Debts & Funeral Expenses shall be duly paid and Satisfied. Item I Give and Bequeath to Margaret my Dearly beloved Wife All my Lands and Plantation, consisting of three Tracts, The One of them containing seventy four acres and half The other of them containing thirty three acres and fifty perches, and the third of them containing thirty one acres, Together with their several and respective Appurtenances, To hold the same to Her my said Wife Margaret during her Natural Life; Moreover I Give and Bequeath to her my said wife Margaret, all my Personal Estate Except such and so much thereof as may be found necessary to dispose of to pay my Just Debts and Funeral expenses/ To hold same to Her my said Wife Margaret during her Natural Life, and I Will and Declare that what I have herein given to my said Wife is and shall be in Lieu & full Satisfaction of her Dower or Thirds in all my Estate and not otherwise. Item I Give and Devise unto my Son Peter Gerhard, and my Step-Son David Zerly, their Heirs and Assigns all my Lands and Plantation aforesaid, Situate in said Douglass Township Together with their several & respective Appurtenances, To hold the same to them the said Peter Gerhard and David Zerly their Heirs and Assigns forever, as Tenants in Common and not as Joint Tenants – (to Possess the same from and immediately after the decease of my said wife) They or either of them, their, or either of their Heirs or Assigns, or any of them, Paying therefore such a Sum of money in Gold or Silver Money of Pennsylvania, as the same may be valued at & fixed upon for payment thereof by Impartial Men, who are to be nominated in the following manner,Viz. my said Son Peter Gerhard & my said stepson David Zerly shall nominate two of them and my other Children & Step Children shall nominate two of them, and if those four Men cannot agree, They themselves shall nominate a fifth man, who or any three of them, shall Value the same at they shall think a reasonable rate, And also fix upon the Terms of payment thereof, which said Money arising Out of the Lands and Plantation, As also what my Arrise Out of my Personal Estate [which is to be sold Except what I own that belongs to the Potting and Weaving Business as soon as Convenient after the Decease of my said Wife] shall be Divided in the following Manner Viz. my Sons Peter Gerhard, and Daniel Gerhard, and my Step Son David Zerly, each of them shall have and receive Thirty Pounds thereof, Together with what I own that belongs to the Potting and Weaving Business, before hand, and Elizabeth Zerly Daughter of my Step Son Jacob Zerly deceased, shall have & receive Twenty pounds thereof, and the residue thereof shall be Equally Divided Amongst all my Children, to wit, Peter Gerhard, Daniel Gerhard, Catharina (intermarried to Mathias Hynderleyder, and step children to wit John Zerly, David Zerly and Lodwick Zerly share and share alike,To hold the same to them, their heirs & assigns respectively forever, And to receive the same according to Seniority. And lastly I constitute and appoint my said Son Peter Gerhard & my Step Son David Zerly to be the executors of this my Last Will & Testament, Utterly disallowing revoking & disannulling all & every other former Testaments Wills Legacies & Executors by me in any ways before this time named Willed & Bequeathed. Ratifying & Confirming this and no other to be my Last Will & Testament. In Witness whereof I have herewith Set my Hand and Seal the day & year above written.
