Calling to mind the mortality of my Body and that it is appointed for all men once to die do make and ordain this my last will and Testament in the following manner and form Viz.___ Imprimis I will and Order that all my Just Debts funeral Expe__ies be fully paid and discharged by my Executors hereinafter named, out of my Personal Estate. Item I will and order my Executors hereinafter named to pay unto my well beloved wife Elizabeth immediately after my decease the sum of two hundred pounds Current money of Pennsylvania out of my Personal Estate and also nine pounds per annum during such time as she remains my widow and to deliver to her all the household goods of every kind in my possession which I got my means of my marriage with her in the manner I have engaged that it shall be done in and by a certain marriage contract duly Executed under my hand and seal bearing date prior to my marriage with my said beloved wife. Item I also give and bequeath unto my said beloved Wife a Cow necessary firewood during such time as she shall continue my widow (to be taken of such kind as my Executors shall direct from my woodland in Gwynedd Township) together with all the privileges reserved in and by the deed of Conveyance made to Daniel Shoemaker for the plantation whereon I now dwell which said Bequests I mean and intend to be in lieu of my said wife's Dower or third in my Estate Real and personal. Item I will and order that my Executors do sell all and singular my Personal Estate not herein before disposed of as soon after my decease as it can conveniently be done and the money arising from such sale together with all the residue of my personal Estate after my Just debts funeral expencies legacies and the principal sum to raise the above mentioned annuity being first deducted I give and bequeath unto my son Matthis Martins and to my daughter Elizabeth Trexler to be equally divided between them share and share alike and to their Heirs and Assigns respectively. Item at the decease or marriage of my said beloved wife whichever shall first happen I will and order that my Executors do sell all that my Lot of Woodland in Gwynedd aforesaid Containing about twenty acres be the same more or less at public sale and the money arising from such sale together with the principal sum taken to arise the aforesaid annuity I give and bequeath unto my two Children to be equally divided between them share and Share alike and to their Heirs and assigns respectively. But in case my said beloved Wife and my said Children or the representatives of my said Children in case they or either of them should be deceased can or does at any time hereafter agree in such manner as will be satisfactory to my said beloved Wife and that she will release her right of having her firewood from the said lot of woodland Then I order and direct my Executors to sell my said lot of woodland at public sale as soon after such agreement takes place as conveniently may be and divide the money arising from such sale (after necessary expencies &c are first deducted) between my said two Children share and share alike as soon as it can conveniently be Collected. And I do hereby nominate constitute and appoint my trusty friend Robert Loller of the Manor of Mooreland Surveyor and Baltzer Ernst of Upper Dublin Yeoman Executors of this my last will and Testament hereby giving them or The survivor of them full power to make execute and acknowledge a good lawful and sufficient title or titles Deed or Deeds of Conveyance in fee Simple for all or any part of my said lot of woodland to the purchaser or purchasors of the same and to his her or their heirs and Assigns for ever And lastly I do hereby revoke all wills or Testaments by me at any time heretofore made ratifying this and no other to be my last Will and Testament. In Testimony whereof I have hereunto set my hand and seal this ninth day of April in the year of our Lord One thousand seven hundred and ninety Eight 1798___ John Martins (seal) Signed Sealed published and declared by the said John Martins as his last will and Testament in the presence of us who were desired to be witnesses of the same. Daniel Shoemaker Peter Steriger Personally came each of the Witnesses to the foregoing Will and being duly affirmed according to law did say that they seen John Martins the Testator within named sign and seal and heard him pronounce and declare the same to be his last Will and Testament and at the doing thereof he was of a perfect sound disposing mind memory and understanding to the best of their knowledge and that they signed their names as Witnesses at the request of the Testator in his presence and in the presence of each other. Be it remembered that on 27th day of April 1799 the foregoing Will of John Martins ded. was proved, in due form of law and Letters Testamentory granted to Robert Loller & Baltzer Ernst Executors therein mentioned the having been first sworn well and truly to perform the same and render an account according to law Given under my hand and seal Registered the 27th day of April 1799.
