This indenture made the twenty third day of May in the year of our Lord one thousand seven hundred and ninety two between Frederick Marshall of Salem in the County of Stokes in the state of North Carolina Esquire by his Lawful Attornies John Ettwein of Bethlehem in the County of Northampton in the State of Pennsylvania Clerk Paul Minster of Bethlehem aforesaid Clerk and Hans Christian Schweiniz of the same place Esquire specially constituted of the one part and John Sherbantie commonly called Jan Sherbentie of Chestnuthill Township in the County of Northampton aforesaid Miller of the other part Whereas the said Frederick Marshall by his Power of Atorney or letters of Procuration duly executed and bearing date the Twenty eighth day of May 1783 reciting as is therein recited did Constitute and appoint the above named John Ettwein Paul Minster and Hans Christian Schweiniz his True and lawful Attornies jointly and severally for him in his name place and stead to make execute seal and deliver all such Deed or Deeds Conveyance or conveyances as should be requisite and necessary in the Law for the full and absolute aproving and conveying of such part or parcels of Land Hereditaments or Tenements to such person or persons his her or their Heirs and assigns for ever unto whom the said Attornies may Judge it meet and right and for his Interest to contract with for the sale of any of his lands in the state of Pennsylvania etc. The same Lands to grant and convey for such prices and considerations as the said Attornies shall see convenient as by counsel learned in the Law Shall be reasonable advised and devised and such Deed or Deeds Conveyance or conveyances to acknowledge in due form of Law etc. as in and by the said in part recited Power of Attorney, duly proved and entered on record in the Office for Recording of Deeds in and for the County of Northampton in Book D. vol. 1 Page 138 Etc. Relation being thereunto had more fully and at large appears Now this Indenture Witnesseth that for and in Consideration of the Sum of Two Hundred and Fifty two Pounds lawful Money of Pennsylvania unto them the said John Ettwein Paul Minster and Hans Christian Schweiniz in hand well and truly paid at or before the ensealing and Delivery hereof for the use of the said Frederick Marshall by the said John Sherbantie the receipt whereof he the said Frederick Marshall by his said Attornies doth hereby acknowledge and thereof doth acquit and forever discharge the said John Sherbantie his Heirs and assigns by these presents He the said Frederick Marshall by his said Attornies John Ettwein Paul Minster and Hans Christian Schweiniz Hath granted Bargained for sold released and confirmed and by these presents Doth grant bargain sell release and confirm unto the said John Sherbantie his Heirs and assigns All that Messuage Tenement and Tract or piece of Land situate lying and being in Chestnuthill Township aforesaid bounded and described as Followeth Viz.e Beginning at a Post or Corner of Land now or late of William Gervas thence by Land now or late vacant East Ninety three perches to a Post Fence partly by other Lands of the said Frederick Marshall now in the Tenure of Hannes Meyer and partly by Lands of Richard Peters Esquire North fifteen degrees West two hundred and Ninety five perches to a Stone corner of John Philip Shupps Land thence by the same South Seventy five degrees West two Hundred and thirty six perches to a post or corner of Land now or late of William Gervas thence by the same the three courses and distances following viz.t South fifteen degrees East two hundred and nine perches to a Post North Eighty two degrees East one hundred and fifty perches to a post and South fifteen degrees East fourty four perches to the place of Beginning Containing three Hundred and thirty six acres and one quarter of an acre of Land more or less besides the customary allowance of six acres per cent for Roads etc. (It being part of a Tract of Land of nine Hundred and Ninety five acres which by a Proprietary patent dated the first day of February in the year 1752 on Record at Philadelphia in Patent Book H vol 16 Page 107 etc. was granted unto Frederick Heat in Fee and which part by sundry Mesne conveyances became and is now vested in the said Frederick Marshall as in and by the said Deeds and conveyances duly Proved as well as by a Synopsis or title to the same hereunto annexed relation being thereunto had more fully and at large appears) Together with all the singular the Buildings outhouses Orchards Meadows Gardens Ways Woods Waters Water courses Improvements Rights Liberties Members and appurtenances whatsoever thereunto belonging or in any wise apopertaining and the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof To Have and To Hold the said above described Messuage Tenement and Tract of Land hereby granted or mentioned to be granted with all the Improvements Hereditaments and appurtenances unto the said John Sherbantie his Heirs assigns for ever And the said Frederick Marshall by his said Attornies John Ettwein Pauol Minster and Hans/[p.86] Christian Schweiniz doth hereby Covenent to and with the said John Sherbantie his Heirs and assigns that he the said Frederick Marshall and his Heirs and the said Messuage Tenement Tract of Land Hereditaments and Premises hereby granted with the appurtenances unto the said John Sherbantie his Heirs and assigns against him the said Frederick Marshall and his Heirs and against all and every other person or persons whatsoever Lawfully Claiming or to Claim by from or under Him them or any of them shall and will Warrant and forever defend by these presents And from time to time and at all times hereafter upon the reasonable request and at the propoer Cost and Charges in the Law of the said John Sherbantie his Heirs or assigns Make do Seal and Execute or procure to be made done sealed and executed all and every Such further and other Lawful and reasonable act and acts thing and things devise and devises in the Law conveyance and conveyances assurance and assurances in the Law whatsoever for the further better and more perfect granting conveying releasing and confirming of all the Singular the Premises aforesaid with the appurtenances and every part and parcel thereof unto the said John Sherbantie his Heirs and assigns as by the said John Sherbantie his Heirs or assigns of by his or their counsel learned in the Law shall be lawfully and reasonally advised devised and required In Witness thereof the said parties have Interchangeably set their hands and Seals hereunto the said Attornies Subscribing the name and selaing with the seal of their Constituent and their own names & Seals on the day and year first above written. Horsfield Received the day of the date of the within written indenture of the within named John Sherbantie the sum of Two Hundred and Fifty Pounds lawful Money of Pennsylvania It being the Consideration from therein mentioned I say received of me for the use of Frederick Marshall Hans Chr.n Schweiniz Witness present at signing John Schropp. Synopsis of the Title to 336 1/4 acres of Land Granted by Deed of Frederick Marshall dated the 23.d day of May AD 1792 being part of a Tract of 995 acres in Chestnuthill Township Northampton County Viz.t 1, Proprietary Patent to Frederick Heat for 995 acres and allowance dat. 1 febr. 1752 on record in Philiadelphia in Patent Book A vol. 16 page 107. 2. Deed of Conveyance John Heat and Jeanette his wife to Abraham Bomper for 200 acres (part of the above Tract) dated 18th May 1754 Recorded in the Office for Recording of Deeds in and for the County of Northampton in Book E vol. 1 page 271 etc. 3. Deed of Conveyance Abraham Bomper Administrator of Frederick Höth deed to John Okely to Abrah. Bomper for 795 acres (:residue of the above 995 acres of Land:) date 20 Nov 1757. 4. Deed of Conveyance John Okely to Abrah. Bomper for 795 acres of Land & allowance date of Dec. 1757 5. Deed of Conveyance Abraham Bomper & wife to Nathaniel Seidel for Two Tracts of Land one of them containing 1284 acres 136 p.s and the other 110 acres 112 Perches & allowance date feb. 1792----- The above Deeds No. 3.4.75 recorded in the Office for Recording of Deeds for the County of Northampton in Book E vol 1 as followeth viz.t No 3 page 272 etc No. 4 page 275 etc. and no. 4 page 276 etc. 6 Last Will and Testament of Nathaniel Seidel deceased date 20 Jun 1770 duly Proved and remaining in the Registers Office in and for the County of Northampton in which Will Frederick Marshall is named Residuary Legatee. Recorded 31 day of March 1796. Deed John Cherbaniter To Mess.rs Sheppard. This indenture made the fifteenth day of March in the year of our Lord one Thousand Seven Hundred and Ninety Six between Jan Cherpantier of Chestnuthill Township in the County of Northampton and Commonwealth of Pennsylvania Miller of one p[art and William Shepherd of Plymouth Township in the County of Montgomery and Commonwealth of Pennsylvania Miller and John Shepherd of the same place Stone Cutter of the other part Witnesseth that the said Jan Cherpantier for and in consideration of the sum of one thousand and sevenhundred Pounds lawfull money of Pennsylvania to him in hand will and truly paid by the said William Shepherd and/[p.87] and John Shepherd at and before the Sealing and delivery hereof the receipt whereof is hereby acknowledged Hath granted bargained sold aliened enfeoffed released and confirmed and by these presents Doth grant bargain sell alienen enfeoff release and confirm unto the said William Shpherd and John Shepherd amd tjeor Heris and assigns All that certain Messuage Plantation Grist and Saw Mill and Tract of Land Situate in Chestnuthill Township in the County of Northapmton aforesaid bounded and described as follows viz. Beginning at a Post a corner of Land now or late of William Zerjass thence by land now or late vacant East Ninety three perches to a POst thence partly by other land of said Frederick Marshall and lands of Richard Peters North fifteen Degrees West Two hundred and Ninety five perches to a stone a corner of John Philip Shuph's land thence by the same South Seventy five degrees West Two Hundres and six perches to a post a corner of said Zerjas's land thence by the same South fifteen degrees East two hundred and nine perches to a post North Eighty two degrees East one hundred and Fifty perches to a post and North fifteen degrees East fourty four perches to the place of Beginning Containing three hundred and thirty six acres and one quaarter of an acre of land and the allowance of Six per Cent for Roads etc. a (Being part of a Tract of Nine Hundred and Ninety five acres etc. Which the late Proprietaries of pennsylvania by Patent vearing date the first day of February Anno Domini one Thousand Seven Hundred and fifty two granted unto Frederick Heat in Fee as said Patent Recorded in the Rolls office of Pennsylvania at Philadelphia in Patent Book A. vol 16 page 107 etc. relation thereto being had more fully and at large may appear and the said Tract with other Land adjoining legally vested by sundry mesne conveyances in Frederick Marshall Esquire in Fee who by his Attornies the Rev.d John Ettwein PaulMinster and Hans Christian Schweiniz by Indenture bearing date the twenty third day of May Anno Domini one thousand seven Hundred and Ninety two granted and confirmed the above described Tract to the said Jan Cherpentier (by the name of Sherbantie) in Fee by the said Indenture relation thereto being had more fully and at large May appear) Together with all and singular the Mills Houses Outhouses Edifices and Buildings theron erected and built profits Commodities advantages emoluments Hereditaments and apourtenances whatsoever to the same belonging or in any wise appertaining and the reversions and remainders rents Issues and Profits thereof and all the Estate Right Title Interest property Possession Claim and demand whatsoever of him the said Jan Cherpantier of in or to the same or any and every part thereof To Have and to Hold the above described Messuage Tenement Plantation and Tract of Land Hereditaments and premises hereby granted or mentioned or intended so to be with the apopurtenances unto them the said William Shepp[ard and John Sheppard and their respective Heirs and assigns as Tenants in Common and not as Joint Tenants and to the only proper use benefit and Behoof of them the said William Sheppartd and John Sheppard and respective Heirs and assigns for ever And the said Jan Cherpantier for himself and his Heirs Executors and Administrators doth Covenent promise grant and agree to and with the said William Sheppard & John Sheppard their respective heirs and assigns by these presents that he the said Jan Cherpantier and his Heirs the said above described Messuage Plantation Grist and Sawmill and Tract of Land Hereditaments and Premises hereby granted or mentioned or intended so to be with the appurtenances unto the said William Sheppard and John Sheppard their and their respective heirs and assigns against him the said Jan Cherpantier and his Heirs and against all and every other person and Persons whatsoever lawfully Claiming the same or any part thereof shall and will warrant and for ever Defend by these presents And Further that the said Jan Cherpantier and his Heirs and all and every other person and Persons lawfully claiming or to Claim by from or under him them of any of them shall and will from time to time and at all time hereafter upon the resasonable request and at the proper Costs and Charges in the Law of the said William Sheppard and John Sheppard their or either of their Heirs or assigns make do and Execute or cause to be made done and Executed all and every such further and other Lawful and resonable actor acts Deed or Deeds device and devices in Law whatsoever for the further better more perfect and absolute assurance and confirmation of the said Messuage Plantation and Tract of Land Hereditaments and Premises hereby granted or mentioned or intended so to be with the appurtenances unto them the said William Sheppard and John Sheppard and their respective Heirs and assigns as by the or by their Counsel lerned in the Law shall be reasonable advised devised and required In Witness whereof said Parties to these presents have hereto Interchangea bly put their hands and seals the day and year first above written Jan (his mark) Cherpantier (seal) Sealed and Delivered in the presence of Will Henry Grnveis Grp.
