Martin Pontius Deed to Peter Peiffer This indenture made the 25th day of April in1810 between Martin Pontius of Mahanoy Township in the county of Northumberland in the state of Pennsylvania and Mary Barbara, his wife of the one part and Peter Peiffer of Tulpehocken Township in the county of Berks and state aforesaid of the other part, Witnesseth that the said Martin Pontius and Mary Barbara his wife for and in consideration of the sum of one hundred and thirty pounds, lawful money of Pennsylvania to the said Martin Pontius in hand unto and truly paid by the said Peter Peiffer at and before the ensealing & delivery of their presents (The receipt and payment by the said Martin Pontius doth hereby acknowledge and thereof & and every part thereof doth acquit and forever discharge the said Peter Peiffer his heirs and assigns by these presents). have granted, bargained, sold, aligned, released and confirmed and by their presents do grant , bargain, sell, align, release, and confirm unto the said Peter Peiffer his heirs and assigns, a certain messuage, tenement & tract of land situate lying and being in said township and county bounded and described as follows to wit: Beginning at a Maple South sixty six degrees West one hundred & sixty three perches to a Hickory, thence South twenty six degrees . East one hundred and fourteen perches to a Spanish Oak , thence North sixty four degrees past 42 perches to stones, thence North 7 degrees and 1/4 West 163 perches to the place of beginning. Containing 50 acres and 146 perches of land, not business (It being a part of a larger tract which the Commonwealth of the State of Penna. by patent or grant under the great seal bearing states the 19th day of November in the year of our Lord 1801 for the consideration therein mentioned did grant and confirm unto Elizabeth White and James White executors of the Last Will & Testament of John White, late of Mahanoy Twp deceased in trust for the use thereon mentioned with the appurtenances to hold the farm to them in trust as aforesaid as in and by the said recited patent enrolled in the Rolls Office in Patent Book No. 46 P. 236. Relation being thereto had now fully and at large appears. And whereas the said Elizabeth White executors as aforesaid by indenture under their hands and seals dated the 20th day of April year 1802 by virtue of the powers and authority to them given by the said Will & pursuant to the denotions thereof for the consideration therein mentioned did grant and confirm the last above mentioned large tract of land of which the last mentioned & described tract is a part of unto the above mentioned Martin Pontius, party hereto, and his heirs and assigns as in and by the said recited indenture Relation thereto being his now fully and at large appears. Together with all and singular the house, outhouses, edifices, & building thereon erected & built & all ways, woods, underwoods, waters, water courses, meadows, orchards, gardens, profits, commodities, advantages, involuments, hereditaments, appurtenances whatsoever to the farm belonging or in any wise appertaining & the revision and remainder , rents, issues and profits thereof and also all the estate rights title interest, use, trust, property possession. Claim and demand whatsoever of them the said Martin Pontius and Mary Barbara, his wife, of and in and to the farm or every or any part thereof and also all conveyances, deeds, evidences, and writings touching or concerning the farm or any part thereof and now in the custody and possession of him the said Martin Pontius on which he can or may come by without part at law or equity: To have and to hold the said tract of 50 acres and 146 perches of land hereditaments and premises hereby granted with the appurtenances unto said Peter Peiffer, his heirs and assigns, is the only proper use benefit and behalf of the said Peter Peiffer and his heirs and assigns for and under and subject to the exceptions, reservations adopted and reserved for the use of the Commonwealth. And the said Martin Pontius, his heirs executors and administrators doth covenant, promise and grant to and with the said Peter Peiffer , his heirs and assigns, that he the said Martin Pontius and his heirs and all and every other person and persons, his or their heirs anything having or claiming in the said premises above granted or meant or intended so to be or any part thereof by persons or under him. them or any of them shall and will from time to time and at all times hereafter upon the reasonable request and at the proper costs and charges of the said Peter Peiffer, his heirs & assigns, made & do execute or cause & procure to be made done and executed all & every such further and other lawful and reasonable act and acts, thing and things, conveyances and assurances in the law whatsoever for the further better more fair and perfect granting, conveying, and assuring of all and singular the said premises with the appurtenances unto the said Peter Peiffer, his heirs & assigns, forever as by him the said Martin Pontius, his heirs & assigns, his or their Counsel learned in the law shall be reasonably advised, devised, or required. And the said Martin Pontius, his heirs, the said tract of 50 acres and 146 perches of land above described and premises unto the said Peter Peiffer, his heirs & assigns, against him the said Martin Pontius and his heirs and against all and every other person or persons whatsoever lawfully claiming said premises or any part thereof shall and will warrant & forever defend by their presents. In witness whereof the said parties to these presents have interchangeably set their hands and seals. Dated the day and year said above. Martin Pontius (signed) Witness present at signing Michael Enterline, Adam Lenker in Northumberland County fs(sic) (seal) On the 25th day of April AD 1810 before me the subscriber, one of the Justices of the Peace in and for the said county, personally came the above said Martin Pontius and Mary Barbara, his wife, and acknowledged the above Indenture to be their act and deed and desired the same may be recorded as such. She the said Mary Barbara being of full and lawful age and separate from her said husband being by me examined and the sale contents being made known to her, voluntarily consenting thereto.
