At Pottsville PA. on August 1861, to serve 3 years; he was born in Schuylkill Co. in the state of Penn. Is 18 years of age, 5 feet 5 ½ inches high, florid complexion, brown eyes, brown hair, and by occupation when enlisted a miner. During the last two months said soldier has been unfit for duty 61 days. STATION: Convalescence Camp, Va. DATE: July 24 of 63 I certify that I have carefully examined the said Samuel Fryberger of Captain Gilmores Company, and find him incapable of performing the duties of a soldier because of gunshot wound of right hip; received at battle of Antietam and causing serious lameness. (Name illegible) -------------------------------------------------------------------------------- State of Pennsylvania County of Schuylkill On this eighteenth day of February A.D. 1863, before me the Prothonatary of the Courts in aid for the County and State above named personally appeared Samuel Fryberger a resident of Ashland, Schuylkill County, Pennsylvania, aged 19 years who being duly sworn that he is the identical Samuel Fryberger who was a private in Company H, commanded by Captain Joseph A. Gilmore in the 48th Regiment of Pennsylvania Volunteers, commanded by Colonel J. K. Seigfried: in the war of 1861 and 1862 for the suppression of the Rebellion against the Government of the United States. That he volunteered at Pottsville, Schuylkill County, Pennsylvania on the 23rd day of August, A. D. 1861 for the term of three years and was honorably discharged at the Convalescent Camp near Alexandria, Virginia on the fourth day of February A. D. 1863 as will appear by his Certificate of Discharge herewith presented. That while in the line of his duty in said service at the Battle of Antietam, Maryland, on the 17th September A.D. 1862 he was wounded in the thigh and by reason of said wound is unable to follow his occupation. He makes this declaration for the purpose of being placed on the Invalid Pension Roll of the United States by reason of the disability above stated and he hereby makes constitute and appoints N. Ramlay Potts of Pottsville, Schuylkill County, Pennsylvania his attorney to prosecute this claim and procure a pension certificate. Witness present. Vol’s Application for Pension No. 23149 Date of Examination January 16th 1879 Daniel W. Shindel Examining Surgeon Post Office, Sunbury County, Northumberland State, Pennsylvania I hereby certify that I have carefully examined Samuel Fryberger, late a Private in Co. H, 48th Reg’t, Pennsylvania Volunteers, in the service of the united States, who is an applicant for an invalid pension by reason of alleged disability resulting from G.S wound of right hip & right shoulder. In my opinion, the said Samuel Fryberger is Five Eighths ($5) incapacitated for obtaining his subsistence by manual labor from the cause above stated. Judging from his present condition, and from the evidence before me, it is my belief that the said disability did actually originate in the service aforesaid in the line of duty. The disability is probably permanent in degree. A more particular description of the applicant’s condition is subjoined: Height: 5 ft. 9”; weight, 145 lbs.; complexion, dark; age, 33 yrs.; pulse, 68 per min.; respiration, 18 per min. Applicant received a minnie ball on the upper face of right thigh. The ball passing under muscles, out and around hip and lodged in glutis muscles of same side from which it was extracted several months after wounds, a large abscess having formed from the presence of the ball. Wounds now healed, but I find the site of entrance contracted and tender to the touch, also three distinct cicatrices on back part of hip, the result of incisions made in search of the ball, and the evacuation of matter from the abscess. The body slightly inclined forward with some loss of power in bending the leg and drawing it inwards and outwards from probably injury to muscles. Considerable weakness of the whole limb with lameness equal to eight. I also find a large and deep cicatris near - ------ of right scapula, made, on my judgement, by a passing ball, perhaps in a flank movement. We also find from wound of back, some difficulty and pain in drawing the arm backwards, equal to one-fourth disability. -------------------------------------------------------------------------------- Department of the Interior Pension Office March 01, 1879 Sir: Please furnish this Office a report of hospital treatment in the Claim No. 23149, of Samuel Fryberger, late a “H” Co. 48th PA. On this 28th day of August, A.D. on thousand eight hundred and eighty two, personally appeared before me, a Notary Public within and for the county and State aforesaid, Samuel Fryberger, aged 37 years, a resident of the Boro of Shamokin, county of Northumberland, State of Pennsylvania who, being duly sworn and according to law, declares that he is a pensioner of the United States, enrolled at the Philadelphia Pension Agency at the rate of six dollars per month, by reason of disability from Gunshot wounds of the right hip and right shoulder incurred in the Military service of the United States while a Private of Company “H”, 48th Reg., Pa. Vol’s. That he believes himself to be entitled to an increase of pension on account of increased disability arising from said wounds. His physical condition by reason of said wounds of right hip is such as to cause him great pain and the wounds being on the same side of the body prevent him at times from doing any work. Rock St, City of Shamokin, County of Northumberland, State of Penna., and her post office address is Shamokin, Penna.. (Widows Signature) Margaret Fryberger Also personally appeared Margaret Reagan, residing at Shamokin, Pa., and Mary Consadine, residing at Iowa City, Johnson Co., Iowa, who, being duly sworn, say they were present and saw Margaret Fryberger sign her name to the foregoing declaration; that they know her to be the lawful widow of Samuel Fryberger, who died on the 6th day of June, 1896; and that their means of knowledge that said parties were husband and wife, and that the husband died on said date, are as follows: Affiant Margaret Reagan knows they lived and cohabited together as man and wife for past sixteen (16) years. Mary Consadine knows they lived as such for past nine months, and both were present at soldiers bedside when he died. On this 14th day of July AD 1896, personally appeared before me A Justice of the Peace in and for the aforesaid County duly authorized to administer oaths, M. C. Farrow aged 43 years, a resident of Shamokin in the County of Northumberland and State of Penna. Whose post office address is Shamokin, PA. I am an undertaker in the Borough of Shamokin and was mutually acquainted with deceased soldier for at least eighteen years and know that he died on the 6th day of June, 1896, as I was called to his residence immediately after his death to prepare the body for burial, and I buried him in the Shamokin Cemetery on June 9th, 1896. This testimony is written by the Justice Francis M. Rowe at his office at Shamokin, PA. In my presence on the 14th day of July 1896 and only from my oral statements to him there made. In the matter of Pension Claim No. 635,917 of Margaret Fryberger, Widow of Samuel Fryberger, Co. H, 48th Regiment, PA Inftry. On this 14th day of July A.D. 1896, personally appeared before me A Justice of the Peace in and for the aforesaid County duly authorized to administer oaths, August Shultz, aged 39 years, a resident of Shamokin in the County of Northumberland and State of Penna. Whose post office address is Shamokin, PA. I have known deceased soldier and claimant for the past fifteen years. They lived in this town during all of that period and lived and cohabitated together as man and wife during all of this time and up and to date of soldiers death June 6th, 1896, and to the best of my knowledge were therefore never divorced. Claimant has not remarried since soldiers death this fact is known to me personally. If she had resumed marriage relations, I would have been acquainted of the fact. I also know positively that the children claimed for, Frank R., Dora E., Eva V., Maggie M., and Marion, are living at this date. The manner in which coal mining is carried on at present the claimants income is Three Dollars per week which is amount of earnings received from her minor son, has no other income other than $30.00 per month which she receives from her sons who are of legal age, when they earn sufficient to pay this amount, so possesses no property other than house with effects. On this 14th day of July AD 1896, personally appeared before me A Justice of the Peace, in and for the aforesaid county duly authorized to administer oaths, Rev. D. T. Davis aged 73 years, a resident of Shamokin in the County of Northumberland and State of Penna. Whose post office address is Shamokin, Penna. I Rev. D. T. Davies, Pastor of the Welsh Congregational Church of Shamokin, Northumberland Co., Penna. Do testify that I baptized Mr. Samuel Fryberger and his wife Margaret Frybergers children. Margaret was born Sep. 19, 1885. Baptized Sept. 30, 1885. Eva Viola was born June 26, 1889, was baptized Sept. 1889. Dora Elizabeth was born November 8, 1891, baptized August 15, 1893. Frank Rayman was born March 13, 1893, and was baptized July 11, 1896. The above is written by my own hand writing as facts according to my record book of baptizing. In the matter of Pension Case No. 635,917 of Margaret Fryberger, widow of Samuel Fryberger, Co. H, 48th Regiment, PA Infty. On this 15th day of July AD 1896, personally appeared before me A Justice of the Peace in and for the aforesaid County duly authorized to administer oaths, John Weir aged 60 years, a resident of Shamokin in the County of Northumberland and State of Penna whose post office address is Shamokin Penna. I am the assessor of the 5th Ward of the Borough of Shamokin, the ward in which soldier resided and in which the claimant still resides for the past ten years, 1886 to 1896 inclusive, and since 1887 to 1897 inclusive, solder nor claimant did not possess any taxable property of any kind whatever, as the records kept in my custody show. This testimony is written by the Justice Francis M. Rowe at my residence at Shamokin PA, on the 15th day of July 1896, in my presence and only from my oral statements to him then made. Fischer aged 46 years, a resident of Shamokin in the County of Northumberland and State of Penna whose post office address is. . . . I am at present pastor of Trinity Lutheran Church at Shamokin, and find by the church record, that Marion Christian Fryberger, son of Samuel Fryberger and his wife Margaret, was born in Shamokin, Northumberland Co., PA. On the 29th day of May, 1883, and that he was baptized by the Rev. J. A. Flickinger October 31, 1883 who was at that time pastor of the above mentioned church. I have written this above without dictation from anyone, and only as upon the facts as above narrated. I further declare that I have no interest in said case and am not concerned in its prosecution. Our family and his family lived in the same town for a great number of years and therefore know that he was not married prior to his marriage to the claimant. In the matter of Pension Claim No. 635,917 of Margaret Fryberger, widow of Samuel Fryberger, Co. H, 48th Regiment, PA Vol. Infty. On this 16th day of July AD 1896, personally appeared before me A Justice of the Peace in and for the aforesaid County duly authorized to administer oaths, Elias Seitzinger aged 62 years, a resident of Shamokin in the County of Northumberland and State of Penna whose post office address is No. 130 S. Shamokin St, Shamokin PA. I have known Samuel Fryberger this deceased soldier from the time that he was about twelve or thirteen years old, long enough before his marriage to any person have lived neighbors together in Gordon, PA and Shamokin, PA for at least forty five years, and can therefore state positively that he had not been married prior to his marriage to the claimant. Elias Seitzinger -------------------------------------------------------------------------------- GENERAL AFFIDAVIT State of Pennsylvania, County of Northumberland, ss. In the matter of Pension Claim No. 635,917 of Margaret Fryberger, widow of Samuel Fryberger, Co. H, 48th Regiment, PA Vol. Infty. On this 20th day of July AD 1896, personally appeared before me A Justice of the Peace in and for the aforesaid County duly authorized to administer oaths, Patrick Martin aged 64 years, a resident of Shamokin in the County of Northumberland and State of Penna whose post office address is #638 E. Race St, Shamokin PA. That I know this widow prior to her marriage to Samuel Fryberger, her maiden name was Margaret Gehring. I have known her for the past thirty five years. I resided in Gordon, Penna the same town in which claimant resided during her single days and was acquainted with her and her family and can therefore state positively that she was never married prior to her marriage to soldier. I also knew deceased soldier prior to his marriage to claimant as he lived at Fountain Springs, PA about a mile from Gordon, PA, and know that he was never married prior to his marriage to claimant. This affidavit is written by the Justice Francis M. Rowe at his office at Shamokin, PA on the 20th day of July 1896 in my presence and only from my oral statements to him then made. In the matter of Pension Claim No. 635,917 of Margaret Fryberger, widow of Samuel Fryberger, Co. H, 48th Regiment, PA Vol. Infty. On this 22nd day of July AD 1896, personally appeared before me A Justice of the Peace in and for the aforesaid County duly authorized to administer oaths, Henry Startzel aged 56 years, a resident of Shamokin in the County of Northumberland and State of Penna whose post office address is 120 S. Pearl St, Shamokin PA. That I have known this claimant for abut thirty six (36) years, went to school with her and known from my long and intimate acquaintance with her that she was a single woman when she married the soldier. She was positively not married prior to her marriage to Samuel Fryberger, the deceased soldier. Her maiden name was Margaret Gehring. I also know that soldier was not married prior to marriage to claimant. This affidavit is written by the Justice Francis M. Rowe at his office at Shamokin, PA on the 22nd day of July 1896 in my presence and only from my oral statements to him then made. Henry Startzel -------------------------------------------------------------------------------- GENERAL AFFIDAVIT State of Penna, County of Philadelphia, ss. In the matter of application of Margaret Fryberger, widow of Samuel Fryberger, personally appeared before me a Notary Public within and for the County and State aforesaid, John F. Gearing, aged 54 years, resident of 2414 N. 25th St, Philadelphia, County of Philadelphia, and State of Penna., and . . . That he is the brother of Margaret Fryberger, formerly Gearing, who is now the widow of Samuel Fryberger who died at Shamokin, PA., June 6th, 1896; that the said Margaret Gearing was married to Samuel Fryberger on the Twenty-First day of November, 1868, at Cressona, in Schuylkill County, PA., at the residence of this affiant and that he was present at the time and he further declares that the said Margaret Fryberger had never been married before and has not been married since. This statement being made in the presence of John H. Craven and reduced to writing on this Eighteenth day of August, A.D. 1896, at 1546 Nth Seventh Street, Philadelphia, that he was not aided or prompted by any written or printed statement made, prepared or dictated by any other person and not attached as an exhibit to this testimony. Affiants declare that he has no interest direct or indirect in said case, and that he is not concerned in its prosecution. Witness, Mae b. Lewis John F. Gearing Sworn to and subscribed before me on the 18th day of August, 1896, and I hereby certify that the contents of the affidavit were fully made known to the affiant before signing and that I have no interest in this claim. Reserves, by their next friend (and mother), Margaret Laughlin (nee Fryberger,) respectfully represents, that of the above minor children the two former are under fourteen years of age and the latter is over fourteen years of age, and that the above named minor children are entitled to a pension by reason of their father the above named soldier having been a Pensioner (and that their Father left no other Estate from which they would derive any benefit) and they are entitled to pension at the rate of Two dollars per month, until they each arrive at the age of sixteen years. They therefore prey the Honorable Court to appoint some suitable person as their Guardian for that purpose, as they have no person legally authorized to take charge of their persons and estates (as their mother having remarried on the 15th day of February 1905.) and the latter named minor suggests the name of her mother as her Guardian she being over fourteen years of age. And it is further represented that the above named minors will be entitled to Two dollars per month each until sixteen years f age, from the 7th day of April 1905, the date of the filing of their application made by Margaret Fryberger, now Laughlin, mother and next friend, and the amounts to be received (or due said minors, will be about as follows, Eva V. will be entitled to draw about $5.20 for 2 mos 18 days, and Dora E. $62.00 dollars for 31 months and Frank R. $94.33 dollars for 47 1/6 mos, therefore Eva V. prays the Court to waive her appearing to avoid expense and respectfully requests that her mother Margaret Laughlin be appointed as her Guardian, and therefore joins in this petition and prays the Court to waive the matter of Bondsmen in her case as the amount will be two small to bear the expense, and your petitioners will every pray to Her Witnesses to mark Margaret X Laughlin Jno. Fryberger, Dora E. Fryberger, and Frank R. Fryberger, minor children of the late Samuel Fryberger (the latter two being under fourteen years and the former, Eva V. being over fourteen years joining in said petition and as these minor children had no person legally authorized to take charge of their persons and estate and praying the Court to appoint some suitable person as their guardian for that purpose and suggesting the name of their mother, Margaret Laughlin, as such, upon due consideration the Court, believing it to be for the best interests of said minor children, hereby appoints Margaret Laughlin as Guardian as aforesaid and direct that she give bond in the sum of Eighty dollars for Dora E. Fryberger and in the sum of One hundred and twenty dollars for Frank R. Fryberger with sufficient surety, to be approved by the Court, for the faithful performance of the duties of her said trust, and in the case of Eva V. Fryberger the Court, waive the matter of requesting a Bond to be furnished as the sum will be so small as not to warrant the expenses incident thereto, and also appoints the same guardian over her person and estate. Legitimate children of Samuel Fryberger, who was enrolled under the name of Samuel Fryberger at _____ on the 2nd day of August, 1861, as a Private in Co. H, 48th Penna. Vol. Infantry and Co. B, 14th Reserves, and honorably discharged Feby. 4th, 1863, having served ninety days of more during the late war of the rebellion. That the soldier was in the military or naval service of the United States except as stated above. Co. “B”, 14th Regt., Penna Reservers, and discharged July 15th, 1865, at Washington, D. C. That the mother of said children was married under the name of Margaret Gearing to the soldier at Cressona, Schuylkill Co., PA, on the 21st day of November, 1868 by Rev. Fred K. Cracker (Krecker); that there was no legal barrier to the marriage; that she had not been previously married; that he had not been previously married. That the said soldier died June 6th, 1896, at Shamokin, Pa., that he left a widow surviving and nine children living there and now. That the following named are the only children of the soldier who are now living and under sixteen years of age, to wit: Eva V. Fryberger born June 26th, 1889, at Shamokin, PA Dora E. Haven Febry. 18, 1863 I hereby certify, that I have carefully examined Samuel Fryberger, late a Private in Capt. Jos. H Gilmores Co. H, 48th Regt. PA Vols, in the service of the United States, who was discharged at Convalescent Camp, VA., on the 4th day of February 1863, and is an applicant for an invalid pension, by reason of alleged disability resulting from gun shot wounds. In my opinion the said Samuel Fryberger is not incapacitated for obtaining his subsistence by manual labor from the cause above stated. Judging from his present condition, and from the evidence before me, it is my belief that the said disability occurred in the service aforesaid in the line of duty. The disability is Temporary A more particular description of the applicant’s condition is subjoined. On 17th of Sept. 1862, at Battle of Antietam in the act of evading, received a gun shot wound of right thigh. Ball entered thigh a few ins. below groin, passed upward and backward, was extracted from glutei muscles, flesh wound does not interfere with motions of thigh, I have rejected him. J. G. Well known to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows: They have respectively known Margaret Fryberger, now Laughlin, the mother of Eva V., Dora E., and Frank R. Fryberger, minor children of Samuel Fryberger under sixteen years of age for eight months and seven years, and have been and are now intimately acquainted with the family, and know from personal knowledge that Eva V., Dora E., and Frank R. are still living and are the only children of the said Samuel Fryberger deceased, soldier, living under 16 years of age and the said children claimed for are living with their mother the above named Gaurdian Mrs. Margaret Laughlin, and that the deceased soldier, Samuel Fryberger left no other children under 16 years, now living. He had poor health and died with lung trouble, 22 years ago. They had a number of children, on was 1 ½ years of age at his death. She worked hard. Even taking in washing. She has had a stroke and is deserving of help. One son, Merion Fryberger, age 34 has enlisted. Is in the 19th Railroad Engineers at Philadelphia, PA. On February 15th, 1905, she married William C. Laughlin. On December 9th, 1923, William Laughlin died. We are of the opinion that she is now entitled to a pension as the widow of Samuel Fryberger.
