Petition for inquest Michael Derk, deceased No. 38 filed 10 January 1871, in Northumberland Co. Orphan's Court, Vol 15, p.483 The petition of the Subscribers, heirs and Legal representatives of Michael Derk late of Cameron township Northumberland County dec'd respectfully represents That the said Michael Derk lately died leaving him surviving a widow viz Elizabeth Derk and the following heirs viz John Derk, Elias Derk, Israel Derk, Catherine Derk, now deceased who was intermarried with Anthony Heinher and left Surviving her four children viz. Elizabeth intermarried with Simon Kerstetter, Catharine A. intermarried with Aaron Kerstetter, Mary Heinher and Sarah Heinher, the two last named are minors and have for their guardian Anthony Heinher. Elizabeth Derk, now deceased, who was intermarried with Daniel Dooley, and left surviving her six children viz. Michael Dooley, Mary intermarried with John Brennan, Hannah intermarried with Michael Kelley, Sarah Dooley, Catharine A. Dooley and William Dooley, the three last named are minors and have for their guardian, Israel Derk. Abby Derk, now deceased, who was intermarried with Charles K. Weikel and left surviving three children viz. Andrew Weikel, SarahWeikel Susanna Weikel who are all minors and have for their guardian, Elias Derk, and that saidMichael Derk sometime prior to his decease to wit on the 16th day of November A.D. 1867 made his last will and testament which was since there to wit, on the 28th day of December 1868 duly forever and Registered at Sunbury County aforesaid, whereas and whereby he gave after the payment of his debts all the rest residue and remainder of his Estate real and personal whatsoever unto his Said widow during her natural life with remainder to the heirs above and their heirs and assigns in equal shares alike. The Said Michael Derk died seized in his desmesne as of fee of and in the following described real Estate to wit adjoining land of Daniel Derk on the North, Mountain land on the South, land of George Latsha on the East, and land of Henry Otto on the West containing sixty four acres more or less whereon are erected a two story Log dwelling house, and Log barn & your petitioners having Mutually agreed and therefore pray the Court to appoint and order Jacob Wagner, John Boyer and David Billman who have been chosen to make partition of the premises aforesaid to and among the children and representatives of the said Michael Derk dec'd in such manner and in such proportions as by the said will and Laws of this commonwealth is directed if such partition can be made without prejudice to or spoiling the whole, but if such partition cannot be madce thereof then to value and appraise the same and make return of their proceedings herein according to Law and as in duty bound.
