I, Eve Fagely, of the Borough of Shamokin, in the county of Northumberland, and the state of Pennsylvania, being of sound mind, memory and understanding, do make and publish this my last will and testament. And first, I direct that my body be decently interred in the St. Peter's Cemetery, in Shamokin Township, county and State aforesaid, according to the rites and ceremonies of the Lutheran Church, and that my funeral be conducted in a manner corresponding with my estate and situation in life. As to such as it hath pleased God, to intrust me with, I dispose of the same as following, viz: I give and bequeath to my son George K. Fagely my large Clock, for his use during his pleasure, and thereafter to be given to my Grandson Solomon G. Fagely. All the rest of my personal estate, whatsoever and wheresoever of what nature, kind and quality, the same may be, and not hereinbefore given and disposed of, I give and bequeath unto my legal heirs--namely to be divided equally into Seven shares whereof of my son Valentine shall have one (1) share, my son Henry one (1) share, my son George one (1) share, my daughter Caroline one (1) share, my daughter Ellen one (1) share, and my daughter Eliza's children one (1) share, and my Grandson Curtis McWilliams one (1) share. And as far as the dividing is concerned I leave to my heirs, if they think they can divide it without selling, they shall do so, and if not, peaceably, to make sale thereof and then divide the proceeds. In witness whereof, I, Eve Fagely, the testator, have to this my will set my mark and seal, this 25th day of October A.D. one thousand Eight Hundred and Eighty Four. Fagely and on his solemn oath did depose, declare, and say that he knows that the within-mentioned Eve Fagely died testate and that he will, as the Administrator cum testamento annex of Eve Fagely, well and truly administer the goods and chattels, rights and credits belonging to said estate agreeably to law; that he will immediately publish for creditors, one a week for six successive weeks, and render intothe Register's Office, within thirty days, from this date, a just and true inventory and appraisement of the personal estate of said deceased, and additional inventories when necessary; also a just and true account, calculation, and reckoning of his said administration, in one year from this date, or when thereunto legally required; that he will well and truly comply with the provisions of law relating to collateral inheritances; and also that the whole of the goods, chattels, rights and credits of the personal estate of which Eve Fagely died possessed, in the aggregate, do not in value exceed the sum of Twelve Hundred and Fifty dollars, and that she died on the 13th of February A.D. 1887, and further that said estate is not subject to a collateral inheritance tax, to the best of his knowledge and belief.
