That the deceased died intestate since the passing of the late Act of (assembly?) for the distribution of intestate estates leaving upon seven children to wit. Peter the petitioner, Elizabeth (intermarried with Thomas Crawford), Rebecca (intermarried with Luwick Bachman), Joseph, Catherine, Polly, and Esther. That the deceased died seized of a tract of land situated in Mahoney Township containing sixty four acres and allowance adjoining land of Martin Pinehart and Detrich Stonebrucker-and praying the court to award and inquest to *** raise the estate aforesaid according to the form **** and effect of the Act of (assembly?) in such case made and provided where upon the court on due consideration did award an inquest accordingly as prayed for by the petitioners. And command is given to the Sheriff of the county aforesaid (Northumberland) that justly and without delay h summon and take with him twelve good and lawful men of his bailiwick and go to the lands and tenements aforesaid to describe and then in presence of the parties aforementioned (if being by you summoned they will be present) upon the oaths and affirmations of the inquest aforesaid so by him to be summoned he shall cause the inquest aforeward. Divide the same land and tenements into seven equal shares having due respect as well to the quality and quantity thereof, and one of thou shares upon their oaths and affirmations you assign and set over unto Peter Lebengood oldest son of the said deceased, one other share thereof unto Thomas Crawford and Elizabeth his wife late Elizabeth Lebengood daughter of the said deceased, one other share thereof unto Ludwig Bachman and Rebecca his wife late Rebecca Lebengood, one other share daughter of the said deceased -one other share thereof unto Joseph Lebengood, one other share thereof unto Catherine Lebengood, one other share thereof unto Polly Lebengood, and the remaining share unto Esther Lebengood. To hold to them respectively in severalty forever. Provided that the lads aforementioned can be so divided without prejudice to and spoiling the whole thereof, but if the same cannot be so divided then we command you that you cause the inquest aforesaid upon their oaths and affirmations respectively to value and appraise the same at a reasonable price according to the form force and effect of the Act of Assembly in such case made and provided April 26, 1797 Orphans Court, Sunbury Jacob Lebengood Inquisition Confirmed Page 91, Book 3 (note George Lebengood Inquisition confirmation is on page 95, book 3, dated April 25, 1797) John Brady Esquire high sheriff of the county of Norhthumberland came into court and returned to the court here the writ of partition or appraisement the lands of Jacob Lebengood deceased to wit a tract of land situate in Mahoney Township containing sixty four acres and allowance of land adjoining lands of Martin Rhinehart and Detrich Stonebucher. *** out of this court to him directed listed at Sunbury the twenty third day of January last past together with a certain inquisition thereto *** taken under the hand and seal of the said sheriff and under the hands and seals of twelve good and lawful men of the bailiwick of the said sheriff at Mahoney Township in the county aforesaid the fifth day of this instant. Whereby it appears that the sheriff aforesaid together with the inquest aforesaid did go to the lands described in the said writ and that upon view of the premises the inquest aforesaid upon their oaths and affirmations did find that the lands aforesaid could not be divided among the heirs and representations of the ** deceased according to the directions of the this court at a former day without spoil and prejudice thereof neither would the said tract accommodate more than on of the heirs. Wherefore the inquest aforesaid upon their oaths and affirmations valued the lands aforesaid to the sum of one hundred and eighty one pounds fourteen shillings and four pence lawful money of Pennsylvania. And the court taking the same into consideration do confirm the inquisitions aforesaid and direct that the same be and remain firm and stable forever. Whereupon Peter Lebengood eldest son their of the said deceased (by John Kidd his attorney for this purpose specially constituted by letter of attorney under his hand and seal dated the eight day of April instant duly acknowledged and recorded in the recorders office of said county and to the court here shown and filed of accord) comes into the court and prays the court to award the lands aforesaid unto him according to the form force and effect of the Acts of Assembly in such cases made and provided-and the court thereupon do award the lands aforesaid unto him the said Peter Lebengood and his heirs accordingly and direct him together with Martin Rhinehart (whom the court accepts as a sufficient security) to enter into the Recognizance in the usual form to secure the payment of the shares of the other heirs of the said deceased. And to the said Peter Lebengood by John Kidd his attorney aforesaid binds himself unto the president of this court and his due is 363.8.5 Martin Rhinehart binds himself in 363.8.5 Conditioned that the said Peter Lebengood pays to the other heirs their respective shares and presports of the valuation money aforesaid as by the court shall be adjoined The court find the valuation money to be one hundred and eighty one pounds fourteen shillings and four pence 181.14.4 The costs of the preceding Clerk 2.5.0 Attorney 6.0.0 Sheriff 3.10.6 Total 11.15.6 The neat valuation money 169.18.10 And the court do find the neat valuation money to be after deducting the costs aforesaid one hundred and sixty nine pounds eighteen shillings, and ten pence money aforesaid which the court do distribute as follows.
