David Malick's Will, 1834 In the name of God, Amen. I David Malick of Augusta township in the County of Northumberland & State of Pennsylvania, farmer, being very sick and weak in body [illegible] of sound mind, memory and understanding, Blessed be God for the same; And considering the uncertainty of this transitory life, Do make this my last will & testament in manner following to wit: Principally and first of all, I commit my immortal soul into the hands of God who gave it: and my body to the earth to be buried in a descent and Christian like manner: --Item, I give and bequeath unto my son John Malick my plantation in Augusta township, on the waters of Plum Rock containing one hundred acres, more or less, being the same plantation that I purchased from Christian Kreeger, together with the appurtenances, to him the said John Malick, his heirs and assigns forever, he paying the usual yearly rent for the same until my decease & no longer; --Item, I give and bequeath unto my son, Jacob Malick my plantation in Augusta township adjoining lands of William Reeser & Others containing one hundred & nine acres more or less, being the same tract of land that I purchased from George Miller, together with the appurtenances, to him the said Jacob Malick his heirs & assigns forever; I give and bequeath unto the legal heirs or children of my son, David Malick, Jun. deceased, being ten in number, my plantation in Augusta township on the Hallowing Run Road, being two adjoining tracts of land the one that I purchased from Alexander Hunter, the other that I purchased from Jacob K. Boyce, Containing together one hundred acres more or less, together with the appurtenances to the Children of David Malick Jr. deceased share and share alike their heirs and assigns forever. Provided nevertheless that my daughter in law Catharine Malick, widow of my son David Malick Jr. dec'd shall have the privilege of residing on said premises, and farming the same for her own use so long until her youngest child by David Malick Jr. dec'd shall arrive at the age of fifteen years; she the said Catharine paying the usual rent for the same until my decease and no longer; And I do hereby give and bequeath unto my said daughter in law Catharine Malick the privilege of so residing on and farming said plantation until said child Sarah arrives at the age of Fifteen years which will be in the year of Our Lord 1848, --Item I give and bequeath unto my son, Peter Malick the plantation whereon he the said Peter now resides in Augusta township, being part of the land that I purchased from Zentzinger together with the appurtenances to him the said Peter Malick his heirs and assigns forever; Provided nevertheless that my said son Peter Malick pay to my executor herein after named for the use of my estate five dollars per acre, for each and every acre, excepting the usual allowances; over and above one hundred acres & allowance, first deducting one hundred acres & the allowance, then pay five dollars per acre for the remainder except the allowance; And by the said Peter Malick paying the usual yearly rent up until the time of my decease, & no longer: --Item, I give and bequeath unto my son Henry Malick the plantation whereon he the said Henry now resides in Augusta township aforesaid being part of the land I purchased from Zentzinger, together with the appurtenances, to him the said Henry Malick his heirs and assigns forever. Provided nevertheless that my said son Henry Malick pay to my Executor herein after named for the use of my estate; five dollars per acre for each and every acre except for the allowance, contained in said tract after deducting one hundred acres and the usual allowance; and he the said Henry Malick paying the usual yearly rent for the same until the time of my decease and no longer: And the rent herein before mentioned from my five sons herein before named, I consider as full compensation for the lands so bequeathed unto them; excepting what Peter & Henry have more than one hundred acres and allowance each as herein before stated; And I do hereby order & direct that my executor herein after named shall dispose or make sale of all my other lands and tenements, not herein before bequeathed wherever the same may be; for the best price that can be gotten for the same, and to the best advantage for my estate, and I hereby empower my Executor herein after named for the survivor of them to execute & deliver good & sufficient deed or deeds of Conveyance for said land to the purchaser or purchasers thereof; --Item, I give and bequeath unto my son John Malick two shares out of twenty one, say divide my estate into twenty one shares, two of these shares to be John Malicks: --Item I give & bequeath unto my son Jacob Malick two shares out of twenty one shares of my estate; --Item, I give and bequeath unto Catharine Malick, widow, of my son David Malick Jr dec'd the sum of fifty dollars to be paid to her as soon as conveniently may be after my decease: --Item, I give & bequeath unto the legal heirs or children of my son David Malick Jun. dec'd the remainder of two shares out of twenty one shares of my estate after deducting the fifty dollars willed in the preceding bequest to the widow of said Dec'd. --Item, I give and bequeath unto my son Peter Malick two shares out of twenty one shares of my estate, --Item, I give and bequeath unto my son Henry Malick two shares out of twenty one shares of my estate, --Item, I give and bequeath unto my son George Malick two shares out of twenty one shares of my estate. --Item I give and bequeath unto my daughter Catharine intermarried with Philip Weiser two shares out of twenty one shares of my estate. --Item, I give and bequeath unto my daughter Mary intermarried with Samuel Reeser two shares out of twenty one shares of my estate. --Item, I give and bequeath unto my daughter Elizabeth intermarried with William Reeser, Jr two shares out of twenty one shares of my estate. --Item, I give and bequeath unto the Children (two in number) of my daughter Margaret dec'd formerly intermarried with Yonth? Jr., one share out of twenty one shares of my estate. --Item, I give & bequeath unto my daughter Sarah intermarried with Peter Thirsten two shares out of twenty one shares of my estate. And it my will that all the amount charged by me against my children or in anywise due to me from any of my children that the same shall be deducted by my executor out of the first money to be paid to such child or heir so to me indebted, and further it is my will that none of my children shall charge my estate for working for me after he she or they were of age; and if any one or more of my children shall make any charge for working for me after he, she or they were of age; such child or children so charging & persisting therein or in any other way trying to defeat the true intent & meaning of this my last will & testament; such heir or heirs shall not receive more than five dollars each out of my estate, and the remainder of his, hers, or their Shares shall be divided amongst those of my legatees who are willing to submit peaceably, to this my Will. And lastly I nominate and appoint my beloved son Peter Malick & my son-in-law Philip Weiser to be the executors my last will, hereby revoking all other wills heretofore made and making this my last will & testament.
