Will of Michael Smith, 1805 In the Name of God, Amen, this eleventh day of June in the year of our Lord one thousand eight hundred and five, I, Michael Smith of Chillisquaque Township in the County of Northumberland & Commonwealth of Pennsylvania, being at present very sick and weak in Body, but of sound disposing mind, memory and understanding, thanks be to God, therefore, calling unto mind the mortality of my Body, and knowing that it is appointed for all men once to die, Do make and ordain this my last will and testament, that is to say Principally and first of all, I recommend my soul into the hands of God who gave it, hoping through the merits, of our Saviour Jesus Christ, to receive Remission of all my Sins, and an happy admission into the Regions of Bless and Immortality, and as to my Body I recommend it to the Earth, to be Buried in a Christian like and decent manner. And touching such Worldly Estate wherewith it hath pleased God to bless me in this life. I give devise and dispose of the same in the following manner & form -Inprimise-It is my will and do order that in the first place, all my Just debts and funeral charges be paid and satisfied, as soon as conveniently may be after my decease.- Item It is my Will and I do order that my herein named Executors shall Rent or Lease out all that my Plantation whereon I at present dwell or live, after my decease, and which shall be done in four weeks after that, for two years from the time it is Rented or Leased and no longer, and from the Rent or Incomes thereof, It is my Will that my beloved wife Susanna and my two Youngest Children shall be supported or maintained for the said two years, and to have the Liberty to dwell or live in the small House near the River on said Plantation, and which shall be repaired for them to live comfortable therein with a Iron Stove, together with one Acre and a half of Land about said House for their use, besides their other maintenance of my aforesaid Plantation for the aforesaid two years, & what shall be over or more from the Rent of my said Plantation, and not wanted for the maintenance of my Wife and two Children, shall go towards paying my Just Debts. Item It is my Will and I do order, that after the expiration of the aforesaid term of lease or two years, I Executors shall sell all that my aforesaid Plantation, either upon public or private Sale, as they see cause and for the best advantage of my Family, hereby impowering my Executors or either of them to give and execute a good and lawful Deed for my said Plantation unto the purchaser or purchasers of the same, as to vest a fee Simple Estate in him or them. Item It is also my Will, and I do order, that my Executors, shall put or lend out upon good Security, the Sum of Four hundred pounds from the first Money which shall be paid in Land to my said Plantation or Interest, and pay Yearly Interest thereof unto my beloved Wife Susanna so long, She lives and remains my widow, and which shall be in lieu and full as a widow [illegible] for her from my Estate.- Item I give and bequeath unto my beloved wife from my personal Estate a Bed with Bedstead & Bedding, a cow to take her choice and a Spinning Wheel, which She shall have & take before hand, and it is my Will that the remainder of my personal Estate shall be sold upon public Vendue by my Executors and the Money arising from the same, and after my Just debts are paid, I give and bequeath the one third part thereof unto my beloved Wife, and the remaining two third parts as well also the money as it becomes due of my said Plantation and the aforesaid Sum of Four hundred pounds after the decease of my beloved Wife or in case She intermarries again, shall be equally divided amongst my eight Children, to wit, my four sons Benjamin, John, Michael and Henry and four Daughters Catharine marryed[sic] to Michael Wolf, Betzy, Polly & Susanna or the Surviviors of them or their respective Heirs, provided that due regard shall be had & taken to deduct from the equal Share of my son Benjamin the Sum of thirty pounds, from the Share of my son John the Sum of fifty pounds, and from the Share of my Daughter Catharine the Sum of Forty five pounds, which I have advanced unto them in my life time, so as to bring my Children upon an equal Share of my Estate. And lastly I nominate and appoint my Son in law Michael Wolf and my Son John to be Executors of this my last Will and Testament provided they shall have or take no more Commission than from my personal Estate, hereby revoking, disannulling and making void, all former and other Wills and Testaments by me here fore to made, Ratifying and Confirming this and no other to be my last Will & Testament by me. Witness whereof I the said,Michael Smith have hereunto set my Hand & Sealed, Dated the Day and Year first above written. Michael Smith {Seal} Signed, Sealed, Published pronounced & declared by the said Testator as his last Will & Testament in the presence of us the subscribers. Henry Spyker his William O Park mark Northumberland County}SS Be it remembered that on the Eighth Day of August in the Year of our Lord 1805 Before me Jeremiah Simpson, Esq. Register for the County aforesaid personally appeared, Henry Spyker & William Park the two subscribing witnesses to the foregoingWill, who being duly Sworn according to Law doth depose & say that they were personally present & did see Michael Smith the Testator Sign, Seal & delcare the foregoing writing to be his last Will and Testament, That at the time of his so publishing the said will he was of sound & disposing mind & memory as Deponents does believe according to the best of their Knowledge & Understanding, And that the name Henry Spyker and the mark of William Park was wrote & made at the same time as witnesses and are of their own respective writings - And further saith not. Henry Spyker his William O Park mark Sworn and Subscribed the Day & Year [illegible] Cor Jeremiah Simpson, Regr. Be it rememb'd that on the Eighth Day of August in the year of our Lord 1805 before me was proved & approved the last Will & Testament of the said Michael Smith dec'd, of Which the foregoing Record is a true Copy, and Letters Testamentary issued in due & Common Form of Law to Michael Wolf & John Smith, Executors therein named, on the same day, witness my hand.--- Jeremiah Simpson, Regr.
