We encourage links to the state and county table of contents. ____________________________________________________________ Will of Jonathan Waters Will Book 1, Page 230 30 September 1800 Jonathan Water's Will, In the of God amen, I Jonathan Waters of Shamokin Township, Northumberland County & State of Pennsylvania, Mason, being very sick & weak of Body, but of sound mind, memory, and understanding blessed be God for the same, do make and publish this my last Will and Testament, in manner and form following, to wit. Principally and first of all, I commend my immortal Soul into the hands of God, who gave it and my Body to the Earth to be buried in a descent and Christian like manner, at the discretion of my Executor, herein after named, and as to such worldly estate, wherever it hath pleased God to bless me in this life, I give and dispose of the same in the following manner, to wit. First I order all my just Debts to be paid out of the whole of my Estate, also I give and devise to my oldest son Jacob the sum of Six Dollars and no more, I also give and devise unto my son William a certain piece of ground line situated and adjoining the Schoolhouse Lot and to extend fronting the ground xxxx (page torn) to a pine Tree a corner of my Land likewise as far north as the other lots on that xxxx (torn page) side of the Road, also I give and devise unto my said Son William two acres of mea xxxx (torn page), Beginning on a line of Jacob Snyder's land, and extending on the north side of the xxxx (torn page) to the fence on the South side of the xxxx to hold the same xxxx (torn page) and xxxx forever, the same to be his full share of my Estate, and as touching all the xxxx (rest?) xxxx and remainder of my Estate, Real and personal of whatsoever kind or nature soever the same may be , I give and devise the same unto unto my dear and Effectionate Wife, Mary, during her natural life if she shall so long remain a widow, and from and immediately after her deceased it is my Will and Order that the whole shall be sold, and divided amongst my nine Children, Mary, John, Elizabeth, Nehemiah, Jonathan, Benjamin, Samuel, Aaron and Denis or the Survivor or Survivors of them, (the said Elizabeth to have her Bed and Bedding exclusive of her divide) the same to be divided in such manner that each of my Daughters shall have half as much as each of my Sons last above mentioned, and the Sons Share and Share but if either of the above mentioned nine Children should die before division shall be made, leaving issue, then it is my Will and Order that the Heirs of the deceased shall have their Father's or Mother's part of my Estate amongst them equally divided, And if it shall so happen that my wife Mary may see cause to marry it is my Will and Order that she shall have at that time her riding Mare Saddle and Bridle and two Cows, together with her Bed, Bedding, xxxx and at that time it my will that my Son John shall take my plantation with all the apprentices thereunto belonging and take charge of the younger Children until they arrive at the age of Sixteen Years at which time each of them shall be placed an Apprentice to such as he or they may chose and continue as an Apprentice for the term of Four Years. And lastly, I nominate, constitute and appoint my said Wife and my Son John, and my trusty Friend Godfrey Rockefellar to be the Executors of this my Will, hereby revoking all other wills, and declaring this and no other to be any last Will and Testament. In Witness thereof, I have here unto set my Hand and Seal the nineteenth Day of September in the year of your Lord, One thousand eight hundred. Jonathan Waters (seal) Signed, Sealed, published pronounced and declared by the said Tester as his last will & testament in the presence of us, who in his presence and at his request have subscribed as witnesses, Abrm. Jones, Benjamin Prall, Northumberland County. Beit remembered that on the thirtieth Day of September in the year of our Lord 1800 Abraham Jones and Benjamin Prall, the two subscribing witnesses to the within will, and being sworn accordingly to Law, Saith they were personally present and saw Jonathan Waters the Testator Sign Seal and declare the foregoing Writing to be his last Will and Testament and that at the time of his so publishing his said will, he was of sound & disposing mind and memory, according to the best of their knowledge & understanding, as the Deponents do Believe. That the Deponents respectively wrote their names as witnesses in the presence of each other. And further Saith not, Abrm. Jones, Benjamin Prall, Sworn & Subscribed the same day & year before Jereh. Simpson Regt. Beit remembered, That on the thirtieth Day of September in the Year of our Lord 1800 before me was proved & approved the last Will & Testament of the said Jonathan Waters deceased, of which the foregoing Record is a true Copy ,and Letters Testamentary issued in descant and Common Form of Law to Mary Waters, John Waters & Godfrey Rockefellar, Executors in the said Testament named, on the same day, Witness my hand the same day and year.
