The Last Will and Testament of Philip Weaver On file in Butler county, Ohio Records Old Will Book #2, pages 157-159 In the name of God Amen. I Philip Weaver of the County of Butler and the state of Ohio, being under affliction of the body but of sound and disposing mind, memory and understanding considering the certainty of death and the uncertainty of the time there of and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence, do therefore make and publish this my Last Will and Testament in manner and form following that is to say First and principally I commit my soul into the hands of Almighty God and my body to the earth to be decently buried at the discretion of my Executrix herein after named and after my debts and funeral charges are paid I give, devise and bequeath as follows. First I give and bequeath unto my beloved wife, Catherine, the two east rooms of my mansion house the one below and the other above during her lifetime, also all my personal property that I may own at my death both in and out of the house. Item first, I give and devise unto my oldest son, Henry, all of the lands lying on the East side of the State Road from Jacksonburg to Hamilton supposing to be two hundred and five acres more or less, also eight hundred dollars to be paid by my son, John, one year after my wife, Catherine’s, death in consideration of the lands herein devised to John being of more value than that devised to Henry. Item second, I give and bequeath unto my daughter, Catherine Snyder, the sum of two thousand dollars to be paid to her one year after my death by my Executor herein after named. Item third, I give and devise unto my youngest son, John, my Plantation wherein I now dwell containing about two hundred and sixty five acres more or less to him, his heirs and assigns in fee simple allowing him to pay my oldest son Henry the sum of eight hundred dollars one year after my beloved wife, Catherine’s death in consideration of John’s lands being more valuable than Henry’s as before mentioned. Also I require my son John to provide all the necessary provisions for bread, meat and wood , in short all that will be necessary for the support of my wife, Catherine, during the period of her life. He is to furnish feed for what stock she may wish to keep. Item fourth. I give and bequeath after the death of my wife, Catherine, am equal share to each of my three mentioned children of the assets remaining and not divided in the before mentioned items. And lastly I do hereby constitute and appoint my dear wife, Catherine, and my oldest son, Henry, my executors of this my Last Will and Testament satisfying and confirming this and none other to be my Last Will and Testament in Testimony whereof. I Philip Weaver have to this my Will consisting of one sheet of paper set my hand and seal this twelfth day of June, eighteen hundred and thirty four.
