Henry Witmer's Will Recorded in Northumberland Wills, Vol. 2, Page 493 In the Name of God, Amen. I Henry Witmer of Lower Mahanoy township Northumberland County in the State of Pennsylvania, Farmer, being very sick and weak in body but of sound mind memory and understanding Blessed be God for the same, but Considering the uncertainty of this transitory life do make and publish this my last will and testament, in manner and form following to wit, Principally and first of all I commend my immortal soul into the hands of God, who gave it, and my body to the earth to be buried in a decent and Christian like manner, at the discretion of my executors hereinafter named, and as to such worldly estate wherewith it hath pleased God to bless me in this life, I give and dispose of the same in the following manner to wit, First, it is my will and I do order that all my just Debts and Funeral expenses be duly paid and satisfied as soon as conveniently can be after my decease. 2nd, I do give and bequeath unto my Dear wife Catharine the whole and sole use and occupation of my plantation whereon I now live, as long as she shall live, together with two horses and the hoarse geeres one wagon, one plough and one harrow three Cows the Sheep seven hogs all the grain in the barn and the hay the corn and buckwheat in the hold four beds and bedsteds and as much of my house hold furniture & kitchen utensils as she may chose to keep for her use. 3, it is my will and I do order my son Samuel shall have the use and occupation of my said plantation for two years after the Decease of my said wife clear of rent he paying the taxes. 4, it is my will and I do order that after the decease of my said wife and after the expiration of the said two years that then my said plantation containing one hundred and seventy-five acres situate part in Lower Mahanoy township aforesaid in the (county) of Northumberland and part in Mifflin township in the county of Dauphin shall be sold by my Executors hereinafter named or the survivor of them to such person or persons and for price or prices as may be Reasonably gotten for the same and for that purpose I do hereby authorize and empower my said Executors or the survivors of them to sign seal Execute and acknowledge all such Deed or Deeds of Conveyance as may be requisite to and necessary for the granting and assuring the above to the purchaser or purchasers thereof in fee simple. 5th, I give and bequeath unto my grandson Samuel he being the son of my son Peter the sum of thirty Dollars to be paid to him when he arrives at the age of twenty one years, out of the monies arising of such sale of the Land, and the Rest of the money shall be equally Divided among my eight Children or their heirs, my son John shall have one share, my son Daniel shall have on share, my son Benjamin shall have one share, my son Henry shall have one share, my son Peter shall have one share and my son Samuel shall have one share and my daughter Catharine shall have one share and my daughter Magdalena shall have one share. And from and immediately after the decease of my said wife all my moveable property shall be sold and the money arising from such sale to be Equally divided among my said eight children or their heirs. And last I nominate constitute and appoint my Son Henry Witmer and Jacob Weiser both of Lower Mahanoy township to be the Executors of this my last will hereby Revoking all other wills legacies and bequests by me heretofore made and declaring this and no other to be my last will and testament, In witness whereof I have hereunto set my Hand and Seal the twenty first day of September in the year of our Lord one thousand eight hundred and twenty five. his Henry X Witmer seal Signed sealed published pronounced Mark and declared by the said testator as his last will and his last will and testament in the presence of us who in his presence and at his request have subscribed as witnesses Henry Werth Adam Lenker Northumberland County Set. Be it remembered that on the seventh day of November A.D. 1825 Before me Eli Diemer Esquire Register for the county aforesaid personally appeared Henry Wirth and Adam Lenker the two subscribing Witnesses to the foregoing will who being sworn according to Law saith they were personally present and did see Henry Witmer the testator sign seal and declare the within writing to be his last will and testament by making his mark thereto that at the time of republishing the said will he was of sound and disposing mind and memory as Deponents do believe according to the best of their Knowledge and understanding and that the names Henry Wirth and Adam Lenker wrote as witness at the same time are of their respective hand writing and further saith not Adam Lenker, Henry Wirth Sworn and Subscribed the day and year aforesaid. Eli Diemer Register Be it remembered That on the Seventh Day of September in the year of our Lord 1825 Before me was proved and approved the last will and testament of Henry Witmer deceased of which the foregoing Record is a true copy.
