The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ************************************************************************ William Winter's Will Wills and Administrations of Northumberland County (PA), p. 131 Transcribed by Diana Lehman, 1998 William Winter's Will In the name of God, Amen, William Winter of Loyal Sock Township in the County of Northumberland, being weak in body, but of sound and perfect mind and memory blessed be Almighty God for the same do make and publish this my Last Will and Testament in manner and form following (that is to say) First I leave and bequeath unto my beloved wife Eleonor, one good Bed and Bedding and my Sorrel Mare, Together with that which shall be underneath mentioned. I give and bequeath unto Henry Miller who intermarried with my Daughter Hannah the Sum of five Shillings besides what he has already got to their full part and Share, I give and bequeath unto my Daughter Jane Campble the sum of ten pounds, together with the House and Garden which She now holds and occupys with firewood of the said farm for the space of five years after my decease to be her full part and Share, I give and bequeath unto my Daughter Phebe Jones and Children two hundred acres of land part of that Tract which I gave to my son William and to be Conveyed to her and Children according to the Bond which is Executed by my said Son William for that purpose, also one Cow which is now in her Possession, Together with the house and Garden which she now occupys & firewood for the space of five years after my decease to be her full part and Share, but if the said Jane Campble & Phebe Jones as aforesaid should not think proper to live in the Houses as aforesaid for the term as aforesaid that as soon as they remove therefrom the said Houses & premises, shall revert to the use of the said following Heirs which shall be hereafter particularly mentioned; I leave and bequeath unto my Son William five Shillings, besides the land which I have already given him to be his full part; I give and bequeath unto Thomas Linkhorn my Son in law the sum of five Shillings in full of his part and Share; And it is my will and I further order as follows (ie) I do leave and bequeath unto my wife Eleonor, Daughter Ann, who Intermarried with George Crawford, Son John, Daughters Sarah and Mary, Sons James & Elias Daughters Elizabeth, Eleonor and Lucy & Son Archibald, all my real and personal Estate in Loyalsock Township; to be Equally divided share and share alike (only my Daughter Ann, or her proper representative Share shall be sixteen pound less than any of them) to them and each of them their Heirs and assigns forever, Subject nevertheless to all the Legacies which is before mentioned and to mention; I leave and bequeath unto my Grandson, Thomas Linkhorn a Bond which is due by his father to me upwards of the Sum of twenty pounds Also one Horse Creature to the value of twenty pounds, or twenty pounds in Cash; and as to my Land in Kentucky which is patented in my name and Sons William, John & James, do will & bequeath, that they shall have the one half thereof according to the patents, to be their full part and Share thereof to them their Heirs and Assigns, and the other half or part which is in my own name and for my use I leave and bequeath as follows (viz) unto my Daughters Sarah, Mary, Elizabeth & Lucy and Sons Elias and Archibald, each and Equal share thereof to them and their Heirs and assigns forever; and it is further my Will that my wife Elonor shall have the Farm and two yoke of Oxen & two Horses for the use of the farm which I now live on for the space of two years, the Oxen & Horses at the Choice of my wife and Executors, Likewise three Beefs and twelve Hogs a year for the aforesd. two years the Hogs to be fatned by the Grain Raised of said farm but if there should happen not to be the number of twelve afsd. that they be bought out of the Estate all which I will and allow for my wife and her Children & Phebe Jones & her Children for their Support & Maintenance for the Term of two years, & one years Bread out of the crop which is now in the ground (but if the said Phebe should Marry before the time mentioned as aforesaid that to such of that part of the Maintenance shall revert back to my wife and her Children) And I will and farther allow my said Executors to rent the place after the term of two years as aforesaid for the term of three years following to the best advantage for the use of all my Heirs, viz applying the same Rent to discharge all the Different Legacies Reserving for my said wife a House and Garden, firewood, pasture for two Cows yearly after Harvest for said Term of three years, also I further allow Negro Tom to be for the use of my said Wife to work for her & her said children during the term of two years after my decease then the said Negro Tom is to be free from his Slavery to serve whom he pleases, and also at the Discretion of my Executors the said Negro Tom is to have one Suit of Clothes at the Expiration of two years from the first of April next, also I leave and bequeath to my Son James one two year old Mare Colt or one year Old Mare Colts at his choice and further it is my will and I order that the Expiration of the five years aforesaid that all my Estates aforesaid shall be sold at Private Sale, and for Ga..s, by my Executors herein after mentioned to the best advantage and for the use of my said Heirs as aforesaid according to their Respective Shares and lastly it is my will and I order the Sums and Legacies or Sums of money which I have bequeathed as afsd. to each of my Legatees that they be paid to each of them Respectively five years after my decease, also I do hereby nominate and appoint my son John Winter and William Hammond Esq. Executors of this my last will and Testament; hereby Revoking all other former Wills by me made In Witness whereof I have hereunto set my hand and Seal this Eighteenth day of June in the year of our Lord one thousand seven hundred and ninety four. William Winter (S) Signed Sealed published and declared by the above named William Winter to be his last will and Testament in the presence of us who have hereunto Subscribed our names and in the presence of the Testator. Northumberland County ..; Be it remembered that on the second Day of August in the year of our Lord one thousand Seven hundred and ninety four, in the Office of the Register, before the Register for the Probate of Wills and granting Letters of Administration in & for the County aforesaid, at Sunbury came the within named William Vanderbelt and Isaiah Voras, two of the Subscribing witnesses to the within Instrument of writing and being duly sworn according to law deposed and said that they were personally present and did see William Winter the Testator named in the within Testament sign his name thereto and Seal the same and that he published the same Instrument of writing as and for his last Will and Testament that he desired the Deponents to Subscribe the same as Witnesses, that they accordingly Subscribed the same as Witnesses, the said William Vanderbelt subscribing the name "William Vanderbelt" with his own proper hand, and the said Isaiah Voras also subscribing the same Will by making his Mark thus (...) between his Christian name Isaiah & his Sir-name Voras with his own proper Hand, and in the Presence of the Testator and that they did see Samuel E. Grier Subscribe his name likewise as a Witness in their presence & in the presence of the said Testator, and that at the time of the signing Sealing and Publishing of the said Will in manner and form aforesaid the said William Winter was of a sound and disposing mind and memory according to the best of their understanding and Belief. Simpson Regst An Inventory of the Goods & Chattels of Wm Winters Decd Taken by us the Subscribers this 28th of July AD 1794.
