The petition of Hugh Quigley was presented to the Court representing, that he is the Administrator of Abraham Frey, late of Centre township, Perry County, deceased; That he has settled an account in which he recounted for all the personal estate of said deceased, (who died intestate,) that came to his hands, and which left a balance of $43.12 cents due said estate from accountant; but that the debts still due by said deceased, and unpaid are as per schedule annexed $92.43. That the personal estate is insufficient for the payment of said debts - said deceased left a widow named Eve, and issue six children, to wit; Sophia, intermarried with said petitioner, (and now deceased since death of said decedent.) Mary, intermarried with John Wertz; Elizabeth, intermarried with Samuel Hollabaugh; Nancy, intermarried with David Quigley; David, and Catharine a minor, who has John Campbell, Esq., for her guardian. Said deceased died seized of certain Real Estate, (all he had) situate in said township, and which under proceedings in partition, has been sold by the order of said Court to Henry Wertz for $340.00 and the sale confirmed on the 2d day of November, 1853, Said petitioner therefore paid the court to grant a Rule upon the widow, and the heirs of said deceased, to appear at the next Term of said Court and show cause why the sum of $130.00, or so much as may be necessary, should be paid over to said petitioner, out of the proceeds of said sale, for the purpose of paying the debts of said deceased.
