The petition of Elias Harman eldest son and heir at law of Henry Harman, late of the township of Greenwood the said County deceased, Lydia & Elisabeth daughters of said deceased Henry Harman another son of said deceased by his guardian Wm Kipp and Judia (Julia) Harman, widow of said deceased: respectfully represents: That the said Henry Harman died intestate about three years since bearing issue the above named petitioner, Lydia & Elisabeth Harman, Henry Harman who is a minor & has for his guardian Wm Kipp; & Judia (Julia) Harman widow of said deceased; and that the said intestate died seised in his demes__ as of fee of and __ the following described Real estate: A tract of land situate in Greenwood township bounded by lands of Jacob Leas, Geo. Shuman & Capt. John Wright, containing 175 Acres more or less, having therein erected a log house, bank barn & other buildings with the appurtenances. __ partition or valuation of the said estate having ben had, your petitioners pray the Court to order & appoint Thomas P. Cochran, Jacob Leas, Nicholas Wetz, Benjamin Horting, Michael Wenner, Charles Wright & Mathias Rumbaugh who were chosen by your petitioners for that purpose to make partition or valuation of the said premises according to the laws of the Commonwealth in such case made & provided & to make report of the proceedings herein at the next Orphans court after they shall have so parted & valued the same. [End page] [Beginning of page] To the Honorable the Judges of the Orphans Court. In the matter of the Partition and Valuation of the Real Estate of Henry Harman deceased. And now, to wit, August 4th, 1851 The Inquest having returned their proceedings in obedience to the order of the Court setting forth that the Real Estate of said Henry Harman cannot be divided and partitioned so as to accomodate more than one of the Heirs of said Decedent and having valued and appraised said Estate at and for the sum of $ [amount left blank] we the undersigned being Judah Harman widow, Wm Kep, guardian of Henry, Elias Harman, Lydia Harman, Elisabeth intermarried with Saml Klessman all the heirs of said decedent do hereby appear and waiving as entirely and fully as wer could in perons in Court, the granting and issuing of Rule commanding us to appear at the next erm of your Court and accept or refuse to accept the said Real Estate so appraised as above ___ the valuation thereof; and we do hereby refuse to accept said Real Estate of sd Decedent as valued above. And further we do hereby without the granting of the Rule, signify our willingness that the said Real Estate shall be shold under the order & supervision of the Orphans Court. And as there has been no letters of Administration or letters testamantary been issued on said Estate of Henry Harman, we would suggest Wm Kip of Millerstown as a proper person to sell said Real Estate upon giving bond for the ___ful appropriation of the proceeds of such sale and that Friday the 17th day of October next, be appointed for such purpose.
