I, Mary Powell of Tuscarora Township, Perry County, State of Pennsylvania; being sick and weak in body, but of sound mind, memory, and understanding, (praised be God for it), considering the uncertainty of death, and the uncertainty of the time thereof, and to the end I may be better prepared to leave this world whenever it shall please God to call me hence, do therefore make & declare this my last Will & Testament in manner following (that is to say;) 1st and principally, I commend my soul into the hands of Almighty God my creator, and as to my worldly effects, I order that my funeral expenses and just debts, together with the expense of proving or otherwise concerning this Will, shall in the first place be fully paid and satisfied; 2nd I will that my daughter, Mary Ellen, intermarried with Charles Noy, is to have two hundred fifty dollars out of my estate and the balance to be divided equally among my children named as follows: Susanna intermarried with James Crossley Caroline intermarried with David Powell Maria intermarried with Huston McNaughton George Washington Powell Franklin Pierce Powell David Alexander Powell Emaline intermarried with Jacob Fry Jacob Powell and Mary Ellen intermarried with Charles Noy. 3rd I nominate & appoint Jonathan R. Black as my executor of this, my last Will and Testament; 4th I hereby authorize my executor to sell all my real estate & personal property & make Deed or Deeds for my real estate when sold and to sell my real estate to the best advantage either as a whole or in parts; My desire is that this, my last will and testament be read to my heirs at the house after my internment. Powell of the County of Calaway, in the State of Missouri, son and heir of Mary Powell, late of Tuscarora Township, Perry County, [PA], deceased, to W.A. Sponsler, Respectfully represents that his mother, Mary Powell, made her last will and testament dated the 29th day of July A .D. 1886, which was duly proven before the Registry of Wills of the Court of Perry on the 20th day of December 1886, and Letters Testamentary issued _[to]_ Johnathan Black, who was appointed Executor on 20 Dec 1886, by the will of Mary Powell . That more than ___ years have elapsed since Letters Testamentary issued to the said Jonathan Black and he has filed no account. Therefore your petitioner prays the court that a citation & ______ be issued tot he said Jonathan Black to compel him to file an account of his trust.
