All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Cathy Wentz-Eisenstadt ctwentz@aol.com July 31, 2005, 9:17 pm Source: Will; T-155; Sarah Trostle Written: June 28, 1910 Will; T-155 Sarah Trostle June 28, 1910 I, SARAH TROSTLE, of Saville Township, Perry County, Pennsylvania, beng of sound mind and memory, and considering the uncertainty of this frail and transitory life, do, therefore, make this my last will and testament, as follows: FIRST:--I direct that all such debts as shall be by me owing at my death, together with my funeral expenses, and all charges touching the proving of this my last will, shall, in the first place, be fully paid and satisfied; said just debts shall include the payment of TEN DOLLARS per year, with interest thereon, for each and every calendar year from and including the year 1900 to and including the year in which I shall depart this life, unto John Calvin Miller, his heirs, executors or assigns, as a just compensation for the service which he, the said John Calvin Miller will have rendered unto me in my business affairs, and for my physical comfort and social welfare within and during the above mentioned period of my lifetime. SECOND:-- I direct that my executor hereinafter named shall expend a sum not exceeding ONE HUNDRED DOLLARS in procuring a suitable tombstone to mark the resting place of my remains. THIRD:-- I further direct that my executor hereinafter named shall pay out of the residue of my estate unto Mrs. Sarah Bousum, with whom I at this time have my residence, and also pay unto such other person or persons with whom I may hereafter take up my residence, such sum of money as he, my said executor, shall deem sufficient compensation for service that contributes to my health and comfort--services outside and apart from that which applies to my boarding, lodging, laundering, etc.--which the aforesaid person or persons will have rendered unto me during the periods of time I shall have had my residence with the said Sarah Bousum or other person or persons. FOURTH:-- I direct my said executor to set apart out of the residue of my estate the sum of FIFTEEN DOLLARS, the same to be used in any manner my said executor shall deem best calculated to provide for the care and keeping up of my grave in good and proper condition perpetually. FIFTH:-- After the payment of the above debts and the expenses of a tombstone, and after the provisions made for the purposes set forth in the foregoing THIRD and FOURTH articles have been executed and satisfied as directed therein, I direct that my said executor shall divide the residue of the proceeds of my property (all of which, I direct, shall be converted into money,) as directed in the following NOTE, to wit: NOTE:-- Only tose of the direct issue, that is chidlren of the first generation of my brothers and sisters deceased, hereinafter named, who shall be surviving at the time, date, and year when My said executor shall make distribution of the said residue of my estate, shall share in said residue and take under the following bequests, to wit: TO THE SURVIVING CHILDREN OF MY SISTER, CATHARINE WERTZ, as set forth in the above NOTE, Twenty-five percent (25%) of said residue. TO MY BROTHER ABRAM TROSTLE, OR HIS SURVIVING CHILDREN, as set forth in the above NOTE, Fourteen percent (14%) of said residue. TO THE SURVIVING CHILDREN OF MY SISTER, ELIZABETH BROWN, as set forth in the above NOTE, Fourteen per cent (14%) of said residue. TO THE SURVIVING CHILDREN OF MY BROTHER, ISRAEL TROSTLE, as set forth in th above NOTE, Fourteen per cent (14%) of said residue. TO HENRY TROSTLE, OR HIS SURVIVING CHILDREN, as set forth in the above NOTE, Fourteen per cent (14%) of said residue. TO THE SURVIVING CHILDREN OF MY BROTHER, WILLIAM TROSTLE, as set forth in the above NOTE, FIVE per cent (5%) of said residue. TO THE SURVIVING CHILDREN OF MY BROTHER, SOLOMON TROSTLE, as set forth in the above note, Fourteen per cent (14%) of said residue. And my will is that, since the whereabouts of the said children, if any, of my said brother, Solomon Trostle, is to me unknown, whatever expense may be incurred by my said executor in locating or finding by the ordinary means, of the said children of my said brother Solomon Trostle, said expense shall be taken and deducted from the above mentioned fourteen per cent (14%) of my said residue hereinbefore bequeathed to the said SURVIVING CHILDREN OF MY SAID BROTHER, SOLOMON TROSTLE. My will is that the expense of locating and finding said children shall be borne and paid out of their individual share of my estate. If, however, none of the surviving children of my said brother SOLOMON TROSTLE be found within the period of one year after my decease, or at the time that my said executor shall make distribution of the residue of my estate as hereinbefore mentioned and directed, then, and in such case, I direct that the said share of the residue of my estate bequeathed unto THE SURVIVING CHILDREN OF MY BROTHER, SOLOMON TROSTLE, as set forth in the above NOTE, shall be equally divided among those persons who shall take under the above bequests as directed in the above NOTE, to wit: To the surviving children of Catharine Wertz, Abram Trostle, Elizabeth Brown, Israel Trostle, Henry Trostle, William Trostle, and Solomon Trostle, here-in-before mentioned. AND MY WILL AND MEANING IS, that the bequests here in set forth shall be construed to mean only Those CHILDREN OF THE FIRST GENERATION, NOT GRANDCHILDREN, SURVIVING AT THE TIME MY SAID EXECUTOR SHALL MAKE DISTRIBUTION OF THE SAID RESIDUE OF MY ESTATE, an that in case of any of the said children shall depart this life before such time as the part or portion of him, her, or them so dying shall be come payable, then, and in such case, the part or portion of him, her or them so dying shall be equally divided among the surviving brothers and sisters of the person or persons so dying. LASTLY:-- I hereby nominate, constitute and appoint my friend John Calvin Miller, of Saville Township, Perry county, Pennsylvania, to be the executor of this my last will and testament, hereby revoking and making void all other and former wills by me at any time hereto fore made and declare this to be my last will and testament.
