All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Ray Rhoads rhodoray@bellsouth.net January 5, 2009, 11:22 am Assigned To: Elizabeth Clampfer Written: June 4, 1771 Recorded: June 7, 1771 To all people to whom these presents shall come I Judah Foulke Esquire High Sheriff of & for the City & County of Philadelphia send greeting where as in & by a certain Writ of Fieri Facias of our Sovereign Lord the King that now is to me the said sheriff lately directed I was commanded that the goods & chattels land & tenements of William Clampfer late of my county yeoman deceased who died intestate, see the lands & possessions of Elizabeth Clampfer, Leonard Melchior & Nicholas Schreiner late of my county administrator of all singular the goods, chattels, Rights & Credits which were of the said William Clampfer deceased in my bailiwick I should cause to be levied three hundred and sixty nine pounds twelve shillings & four pence lawful money of Pennsylvania which to Mary Clampfer lately in the County Court of Common Pleas before the Justices at Philadelphia were adjudged for her damages which she sustained as well by occasion of the nonperformance of a certain promise & assumption by the said William Clampfer in his life time to the said Mary at Philadelphia in my county made as for her leasts & charges by her about her suite in that behalf expended whereof the said Elizabeth , Leonard & Nicholas were convict as appeared of record. Vis.. If so much in their hands which where of the said William to be administered they had and if so much in their hands they had not then eighty one shillings & three pence of the damages aforesaid I should cause to be levied of the goods & chattels of the said Elizabeth, Leonard & Nicholas and that I should have that money before the Justices at Philadelphia at the County Court of Common Pleas there to be held the sixth day of March then next to tender to the said Mary for her damages aforesaid and that I should have then there that said writ, and whereas I the said sheriff that same day before the said Justices returned that by virtue of the said writ to me directed I had sized & taken in execution a certain three story Brick Messuage and Lot of ground situate on the East side of second street in the City of Philadelphia containing in breadth twenty feet four inches and in depth one hundred & fifty five feet. Also a certain other lot or piece of ground situate in the city of Philadelphia between Vine Street & Sassafras Street containing in breadth twenty feet & in depth forty five feet being the extent from the East side of Front Street to the West side of King or Water street and also a certain Messuage & two tracts of land situate in Shackamaxon in the Northern Liberties of the City of Philadelphia One of them containing sixteen acres & sixty four perches & the other of them containing five acres & one hundred and twenty perches late the estate of William Clampfer in the hands & possession of Elizabeth Clampfer, Leonard Melchior & Nicholas Schreiner Administrators of all & singular the goods & chattels Rights & Credits which were of the said William Clampfer deceased in the schedule thereunto annexed specified which remained in my hands unsold for want of buyers & therefore I could not have the money in the same writ mentioned at the days place in the same writ specified as therin I was commanded and that the residue of the execution of the said writ appeared in a certain schedule or inquisition thereunto annexed By which schedule or inquisition it was found that the rents issues & profits of the said Messuage or Tenement & lots of ground in my said return upon the said Writ thereunto annexed mentioned were not of a clear yearly value beyond all reprises sufficient within the space of seven years to satisfy the damages in the said writ mentioned therefore by a certain other writ of Vendittioni Exponis of the said Lord the King to me the said sheriff directed tested at Philadelphia the eleventh day of March last past I was commanded that the three Messuages & Lots or pieces of ground & Two tracts of Land aforesaid situate lying & being as aforesaid with their respective appurtenances I should expose to sale & that I should have that money before the Justices of Philadelphia at the County Court of Common Please there to be held the fifth day of June instant to render to the said Mary for her damages aforesaid that I should have then there that said writ as in & by the said recited writ & the record & proceedings of the said court relation being thereunto respectively had more fully appears and whereas I the said sheriff having giving due & timely notice of the day & place of sale of the Messuages or tenements, lots of ground and tracts of land aforesaid by me seized & taken in execution as aforesaid exposed the same to public sale on the twenty thirty day of April last past when Jacob Schreiner of the City of Philadelphia skin dresser bought the Messuage & Lot of ground situate on the East side of Second Street in the City of Philadelphia for the sum of Fourteen hundred & sixty Pounds lawful money of Pennsylvania he being the best & higest bidder. Now know ye that I the said sheriff for and in consideration of the said sum of fourteen hundred & sixty Pounds lawful money aforesaid to me in hand well & truly paid by the said Jacob Schreiner at & before the sealing & delivery hereof the receipt whereof I the said sheriff do hereby acknowledge & confess have granted bargained sold & delivered & by force & Virtue of the said Province of Pennsylvania in such case made & provided do grant bargain sell & deliver unto the said Jacob Schreiner his heirs & assigns. The said Messuage or Tenement & Lot or piece of ground situate on the East side of Second Street from Delaware in the said City of Philadelphia between Mulberry and Sassafrass Street containing in breadth Twenty feet & four inches & extending in length One hundred and fifty five feet as aforesaid bounded southward a Messuage & Lot late of Damaris Chick afterwards in the tenure of Joseph Drinker eastward with ground now or late in the Possession of Samuel Fisher northward with Well’s ground formerly in the possession of John Hendrickson now in the tenure of Aquila Jones and westward with Second Street aforesaid together with all the rights liberty & privilege of ingress egress & regress which the said William Clampfer in his life time had or ought to have had of in and to a certain four feet alley extending from Gilberts Alley to the hereby granted lot of ground for the accommodation of the said hereby granted lot of ground and together also with all & singular the buildings improvements lights easements rights liberties privileges improvements Hereditaments & appurtenances whatsoever unto the said Messuage & lot of ground belonging or in any wise appertaining & the reversions & remainders thereof To have & to hold the said Messuage & Lot of ground Hereditiments & premises hereby granted or mentioned to be granted with the appurtenances unto him the said Jacob Schreiner his heirs & Assigns to the proper use benefit & behoof of him the said Jacob Schreiner his heirs & assigns for ever, according to the force , form and effect of the laws & usage of the said province of Pennsylvania in such case made and provided under the Proprietary quit rent hereafter accruing for the hereby granted premises. In witness whereof I the said sheriff have hereunto set my hand & seal dated the fourth day of June in eleventh year of the Reign of our Sovereign Lord George the third by the grace of god of Great Britian, France and Ireland King Defender of the faith & in the year of our Lord One thousand seven hundred & seventy one. Judah Foulke Sheriff & Test. - Hilary Baker Jun’r Acknowledged in open Court of Common Pleas held at Philadelphia for the City & County of Philadelphia the seventh day of June in the year of our Lord One thousand seven hundred & seventy one & recorded amongst the records of the said Court, Certified under my hand & the seal of the said county. -County Seal- James Biddle O. pro*** A brief of the title to the within granted Messuage & Lot of ground,, Patent to Richard Bull recorded in Book A, Vol. 2nd page 609. Deed said Bull to Fitzwater recorded in Book G, Vol 1st page102. Deed Fitzwater to Joseph Redman dated Nov 4, 1704. Deed John Redman to Ellis Jones dated Jany 4, 1705, Rec. in book B,Vol 2nd page 438. Ellis Jones by his last will and testament dated 22nd of the 3rd mo. 1722 devised the within granted premises unto his wife Jane Jones. Jane Jones by a codicil to her last will the codicil bearing date the 7th Dec 1732 devised the same premises unto her grand children Susanna Jones & Ellis Jones. Edward Evans & the said Susanna Jones administrators of the goods & chattels, lands & tenements of the said Jane Jones dec’d the said Edward Evans being also guardian of the said Ellis Jones (an infant underage). By virtue of an order of the Orphans Court held at Philadelphia the 7th day of June 1740. Sold and by indenture dated the 1st of August in the same year (Recorded in Book G, Vol 2nd, page 262) granted & confirmed the same premises unto Adam Klampfer. Adam Klampfer last will dated the 27 day of July 1765 devised the same premises unto his the within named William Clampfer N.B. The above recited deed from Joseph Redman to John Redman was supposed last, wherefore a release was executed from Thomas Bowne & Sarah his wife she being the residuary devisee of the said Joseph Redman her former husband to Adam Klampfer, dated 2nd of August 1740. But the said deed being since found the release is now superfluous.
