hundred and fifteen between Hans Graf of Strossburg in the county of Chester husbandman and Susana his wife of the one part and Gerhard Rittinghuysen of Krishem in the Germantownship and County of Phil likewise husbandman of the other part, Witnesseth that the said Hans Graf and Susana his wife for and in consideration for the sum of seventy pounds lawful silver money of Pennsylvania to them at and before the sealing and delivery of these presents will and truly paid by the said Gerhard Rittinghuysen the receipt whereof they do hereby acknowledge and thereof and every part thereof do fully acquit and discharge the said Gerhard Rittinghuysen his heirs executors and administrators and assigns forever, have given, granted, bargained, sold, aliened, enfeoffed and confirmed and by these presents do give grant bargain sell alien enfeoff and confirm unto the said Gerhard Rittinghuysen his heirs and assigns a certain tract of land situate lying and being at Krisheim in the Township and county of Philadelphia aforesaid Beginning at a white oak sappling standing in the Plymouth Road and dividing this said tract from Henry Lerentze's Land thence northwest by said road forty three perches and twelve foot to another corner white oak sapling thence southwest by Cornelis Siverts land seventy four perches to a cornerstone, thence North West again by the said Siverts Land forty three perches to another Cornerstone, Thence southwest again by Janam Wegs land three hundred and twenty perches to a corner white oak sapling thence south east by South by the line of the above said Germantownship eighty three perches to a chestnut post for a corner thence north east by the said Henry Lorentze’s land four hundred and ten perches to the place of Beginning, containing one hundred and seventy five acres of land, the same more or less, now in the tenure and possession of the said Hans Graf by virtue of three several deeds of conveyance the first for eighty four acres under the hand and seal of Jan Krey bearing date the 27th day of March 1704 acknowledged in open court of record held at Germantown the second day of May in the said year, the other for seventy five acres under the hands and seals of Isaac Deaves and Martha his wife dated the 21st July 1714 and the third for sixteen acres under the hands and seals of Cornelis Tyson and Margaret his wife dated and duly executed the 31st day of January Last past to hold all and singular the said three parcels of land unto him the said Hans Graf his heirs and assigns forever they yielding and paying such yearly rents as in the aforesaid deeds of sale and convey once are expressed and reserved together with all the houses buildings orchards gardens ways waste passages soil meadows pastures marshes waters watercourses woods underwoods mines minerals quarries fishings fowlings hawkings huntings commodities priviledges improvements hereditaments and appurtenances whatsoever to the herein bargained one hundred seventy five acres of land or any part thereof belonging or in anywise appertaining and the reversions remainders rents issues and profits there of as also all the estate right title interest use possession property claim and demand whatsoever which they the said Hans Graf and Susana his wife or either of them now both or hereafter might or should have of in and to the said Tract of Land or any part or parcel thereof and all deed grants surveys and other evidences and writings concerning the same to have and to hold the said one hundred and seventy five acres of Land (be it more or less) and all and singular the other Hereditaments and premises hereby granted or intended to be granted with the appurtenances unto the said Gerhard Rittinghuysen his heirs and assigns to the only proper use and behoof of him the said Gerhard Rittinghuysen his heirs and assigns forever at and under the several yearly rents mentioned in the above said deeds of conveyance from thenceforth to become due and payable for the hereby bargained land and premises and the said Hans Grof and Susana his wife and the heirs of the said Hans Grof the said one hundred and seventy five acres of land (more or less) with its appurtenances unto the said Gerhard Rittinghuysen his heirs and assigns against them the said Hans Grof and Susana his wife and the heirs of the said Hans Grof and against all and every other person or persons whomsoever lawfully claiming or claim the same premises or any part thereof shall and will warrant and forever defend by these presents free and clear from all and all manner of former and other gifts grants sales mortgages leases indentures dowers wills arrears of rents taxes burdens and incumberances whatsoever had made done offered or executed by him the said Hans Graf the rents aforementioned hereafter accruing only excepted and the said Hans Grof and Susana his wife and the heirs executors and administrators of the said Hans Grof will and will at any time during the space of seven years now next ensuing the date hereof at the personable request and proper costs and charges in the law of the said Gerhard Rittinghuysen his heirs and assigns, Make do and acknowledge or cause so to be all such further acts deeds and devices of the law for the more full and perfect assuring and confirmation of the said one hundred seventy five acres of land and premises to the said Gerhard Rittinghuysen his heirs and assigns or by him or her or any of them shall be rightfully required. In Witness whereof the said parties to these presents have interchangeable here unto set their hands and seals the day and year first above written. Hans Grof. Susana Grof. Sealed and delivered in the presence of Peter Shoemaker, Francis Daniel Pastorius, Dirk Jansen, Martin Meilin, Christian Herr. Memdum that on the 26th day of May 1715 the within named Hans Grof his own person did deliver full quiet and peacable possession and seize in of the within mentioned land and hereditaments with the appurtenances unto the within named Gerhard Rittinghuysen to the use of him the said Gerhard his heirs and assigns forever according to the form and effect of the within written indenture in the presence of Isaac Deoves, Isaac Kasdorp, John Haegher. Philadelphia. Before me the subscriber one of the Justices etc personally appeared Catharine Wistar of the city of Philadelphia said Widow aged seventy eight years and upwards and upon her soleman affirmation did testify and declare that she verily believes the within written indentures was duly and legally executed by Hans Groff and Susanna his wife and for reasons of such Belief she saith that Dirk Jansen (more commonly called Johnson) was her father and that Francis Daniel Pastorius was a school master in Germantown to whom this affirmant went to school, That she has often seen them both write and has of her father’s handwriting now in her possession with which she has compared his signature to the within deed and finds them as well from her memory as by comparison to agree wherefore she firmly believes their names witness subscribed to be their proper handwriting. In witness whereof and in order that it may be recorded I have hereto set my hand and seal Feby 11th 1782. Recorded 12th February 1782.
