(I-17, page 349) Grantor: Philip Dold of the Dounty of Albemarle in Virginia, Cordwainer Grantee: William Pitt of the City of Philadelphia in Pennsylvania, Cordwainer * * * * * * * Philip Dold to William Pitt This Indenture made the 6th day of June in the year of our Lord 1777 Between Philip Dold of the County of Albemarle in Virginia Cordwainer (he being the Surviving Son & heir at Law of Philip Dold late of New Port in Rhode Island Victualler deceased by Catherine his wife also deceased which sd Catherine was one of the daughters of George Peter Hillegas, Sr late of the Northern Liberties of the City of Philadelphia Potter deceased & one of the Co-heiresses in Law of George Peter Hillegas Jr deceased who was the only Son of thesd. George Peter Hillegas Senior and brother of she the said Catherine of the one part and William Pitt of the City of Philadelphia in Pennsylvania Cordwainer of the other part Whereas by Force & Virtue of Sundry Good Conveyances or appurtenances or assurances in the Law duly had and received he the sd. George Peter Hillegas Sr became lawfully seized in his Demesne as of for land in a certain 20 acres of Land situate on Frankford Road in the Township of the Northern Liberties in the County of Philadelphia and being so thereof Seized among other Consequences by Indenture bearing date the 24th day of December in the year of our Lord 1741 made or mentioned to be made between the sd George Peter Hillegas Sr & Margaret his wife of the one part & the sd. George Peter Hillegas Jr the only Son of the other part for the Consideration therein mentioned he thesd George Peter Hilligas Sr & Margaret his wife did grant bargain sell release & Confirm unto thesd. George Peter Hillegas Jr his heirs & assigns a Certain piece of land (part of the afs 20 acres) situate in the Northern Liberties afs. Beginning at a post at a Corner on the North West side of Frankford Road thence extending along the road leading to Harpers __ which divides this from Fatnells land North 25 degrees West 46 perches to a post thence by other land of the sd. George Peter Hillegas as the Father N. East 12 perches and 1/3 part of a perch to a post thence by land intended to be granted to George Passage & Margaret his wife So 29 degrees East 45 perches to a post in Frankford Road afs. thence by the same South West 16 perches 12 ft & 8 inches to the place of Beginning Containing 4 acres & thesd. George Peter Hillegas Sr. by Sundry other Conveyances of the same date granted 4 acres of Land to his daughter Elizabeth Hillegas 4 acres to George Passage who intermarried with his daughter Margaret & 4 acres to his daughter Catherine Dold the wife of thesd Philip Dold the Father other parts of thesd 20 acres so that there remained 4 acres unconveyed which it is supposed he intended for his daughter Susanna who intermarried with thesd. William Pitt having granted an equal part of the estate to his other Children by deeds of Gift & made no provision for his daughter Susanna in like manner died Intestate seized of thesd 4 acres which descended according to the Law of Intestates of Penna unto his daughter the said Susanna as she was not provided for by deed of Gift Will otherwise and Whereas thesd. Peter Hillegas Jr. & his Sister Elizabeth both dying intestate & without Lawfull issue their parts of & in the sd. 20 acres of Land descended unto the Surviving Sisters Margaret Passage Catherine Dold Susanna Pitt part & share alike as for Heiresses in Law & Whereas the said Susanna Pitt hath also departed this life seized in her Demesne as of fee of ___ the sd. 4 acres of Land whereof thesd. George Peter Hillegas Sr died seized of intestate & also of in & to one full equal & undivided 3rd part of the Land whereof the sd. Geo P Hillegas Jr. & his sister Elizabeth died seized & leaving no issue the parts Shares & dividends of the sd Susanna descended unto the sd. Philip Dold party hereto as heir at Law Now This Indenture Witnesseth that the sd. Philip Dold party hereto for & in Consideration of the Sum of 60 pounds Lawfull money of Penna unto him is all & truly paid by the sd. William Pitt at or before the sealing and Delivery hereof the receipt whereof he the sd. Philip Dold doth hereby acknowledge & thereof doth fully acquit & forever discharge the sd. William Pitt his heirs executors administrators & assigns & ___ of them by these presents hath granted bargained sold released & Confirmed and by these presents he the sd. Philip Dold doth grant bargain sell release & confirm unto the sd. Wm Pitt his heirs & Assigns all his the sd. Philip Dolds Estate & Estates Part & Parts Purpart & Purparts Share & Shares dividend & Dividends Right Title Interest Use Possession Property Claim & Demand whatsoever also Law equity or otherwise howsoever in & to all that Tract or piece of land (part of the afs 20 acres) situate in the Township of the Northern Liberties in the County of Philadelphia beginning at a post on the North Westerly side of the Great road leading from the City of Phila to Frankford and on the North Easterly side of a certain Lane leading from the sd. road to Harpersmill thence along the sd. Lane North 25 degrees West 48 ½ Perches to a post thence by Land late of John Moland Esqr. deceased North East 8 perches 14 ft. and 8 inches to another post thence by land of John Snyder South 27 degrees East 47 perches to a post by the side of Frankford road afs thence by the sd road SouthWest eleven perches and three feet to the place of Beginning Containing 2 3/4 acres & 31 perches be the same more or less now in the actual Possession of the sd. William Pitt & also all his the sd. Philip Dolds Estate & Estates Part and Parts Purpart and Purparts Share & Shares Dividend & Dividends Right Title Interest Use Possesion Property Claim & Demand whatsoever of him the sd Philip Dolde in Law Equity or otherwise howsoever of in and to all and every other part of the sd. 20 acres Granted to the sd. George Peter Hillegas Jr and Elizabeth his Sister by the sd. George Peter Hillegas Sr & whereof the sd. Geo P Hillegas La died seized & intestate & which have in Consequence thereof descended to the sd. Philip Dolds party hereto as heir at Law Together also with all & singular the Hereditary Rights M__ & Appurtenances thereunto respectively belonging or in any wise appertaining and the Res__ Remainders Rents Issues & Profits thereof To have & to hold the sd. Estate & Estates Part and Parts Purpart & Purparts Share & Shares dividend & Dividends Right Title Interest Use Possesion Property Claim & Demand whatsoever of him the sd Peter {sic} Dold party hereto of in to & out of all & Singular the Hereditaments & Promises hereby granted bargained & sold or mentioned or intended so to be with the Appurtenances unto the sd. William Pitt his heirs & assigns To & for the only proper Use Benefit & Behoof of the sd. William Pitt his heirs and assigns forever Under the proportionable part of the yearly Quit Rent hereafter accruing to the Chief Lord or Lords of the fee thereof & the sd Philip Dold for himself his Heirs Executors & Administrators doth Covenant promise & grant to and with the sd. Wlilliam Pitt his heirs & assigns & every of them by these presents That he the sd. Philip Dold hath not at any time heretofore made committed done or suffered or willingly or wittingly suffered to be made done or committed any act matter deed or thing whatsoever whereby or wherewith the afs. Estate or Estates Part & Parts Purpart & Purparts Share & Shares Dividend or Dividends of in and to all & singular the Premises hereby granted or mentioned to be granted with their & every of their appurtenances are is shall or may be charged impeached predjidiced or incumbered in Title Estate or otherwise howsoever In Witness whereof the sd parties have interchangeably set their hands & seals hereunto dated the day & year first above written Philip Dold (S) Sealed & Delivered in the presence of us Ml.
