Whereas George Roberts late of the said City deceased father of the said George Roberts party hereto by his last Will and Testament in writing dated the thirteenth Day of December Anno Domini One thousand eight hundred duly proven and registered at Philadelphia did give and devise to his son the said Charles Roberts in fee simple the Western half part of a Lot of ground (?) North side of Pine Street between Front and Second Streets in the City which half part has been measured by James Pearson and is found to be at the distance of about fifty feet from Second Street and is twenty four feet nine inches front and ---- feet in depth and did further Will that if his said Son Charles should die before he arrives to the age of twenty one years the said Western half part should go to his Daughter the said Elizabeth Roberts and her Heirs. And Whereas the said George Roberts (party hereto has agreed to Let on Ground Rent to the said Dillaplain Ridgway the Eastern part of the said Charles Roberts lot to say seven feet three inches in front on Pine Street by eighty feet in depth Bounded on the East by ground this day granted by the said George to the said Dillaplain on Ground rent and they the said Parties hereto do mutually agree as follows First he the said George Roberts for himself his Heirs Executors and Administrators doth hereby Covenant and Agree to and with the said Dillaplain Ridgeway his Heirs Executors and Administrators that immediately on him the said Charles Roberts arriving to the Age of twenty one years (which will be on the thirteenth Day of October One thousand eight hundred and ten) he the said Charles shall and will by a good and sufficient Deed or Deeds of Conveyance or Assurance in the Law grant and convey unto the said Dillaplain Ridgway his Heirs and Assigns the said Lot of ground seven feet three inches in front by eighty feet in depth with the Appratnances Under and Subject to a Yearly Ground Rent or sum of twenty nine Dollars payable to the said Charles Roberts His heirs and forever in equal half yearly payments without any Deduction or Abatement for any Taxes or Assessments whatsoever in which Deed of Conveyance shall be contained the Usual Covenants and Clauses such as are expressed in the Deed from the said George to the said Dillaplain for the next adjoining Lot and in the mean time he the said Dillaplain his Heirs Executors Administrators and assigns shall and may hold and enjoy the same Lot and all Improvements he may erect thereon Subject to said rent freely peaceably and quietly with out any Molestation whatsoever And further if he the said Charles should die in his Minority then and in such case he shall and will forthwith procure from the said Elizabeth Roberts his Heirs or Executors a good and sufficient Deed of Conveyance for said Lot and all Improvements he may make to said Delaplain Ridgway his Heirs and Assigns Under and Subject to the said Ground Rent and Covenants and Clauses above referred to and she the said Elizabeth Roberts for herself her Heirs Executors and Administrators doth hereby Covenant and agree to execute such Deed of Conveyance to the said Dillaplain Ridgway his Heirs and assigns in Case the said Charles should die in his Minority and it is mutually agreed that the said rent shall commence on the first day of September next and be paid until the execution of the said Deed to the said George Roberts his Executors or Administrators in equal half yearly payments to say on the first Day of the Months of March and September in each year the first half years rent to be paid on the first day of March next And the said Dillaplain Ridgway for himself his Heirs Executors and Administrators doth Covenant and Agree to pay the Same accordingly without any Deduction or Abatement for any Taxes or assessments And when the said Deeds are executed he the said Dillaplaine Ridgway his Heirs or Assigns shall and will sign and execute counterparts thereof and for the Just and true Performance of their respective Covenants and agreements aforesaid the said George Roberts and Elizabeth Roberts do severally bind themselves their respective Heirs Executors and Administrators unto the said Dillaplain Ridgway his Heirs Executors Administrators and assigns the penal sum of Three thousand Dollars on Witness whereof the said parties have interchangeably set their Hands and seals here unto Dated the Day and Year first written.
