[the] Third over Great Brittain France and Ireland King Annoq Dom 1762 Between Ann Potts Widow and [relect] of the Reverend Mr. Joshua Potts late of the Manor [of] Moorland in the County of Philadelphia in the Province of Pensilvania Yeoman Deceased and Joseph Hart of the Township of Warminster in the County of Bucks and Province [aforesaid] Esqr of the one part and William Folwell of the Township of Southampton in the county of Bucks aforesaid of the other [part, Ann] and Joseph being Joynt Executors of the [estate] of the Sd Decd Joshua Potts where _________ Proprietary and ________ dated the 29th Day of March Annoq Domi 1712 Recorded ______ office aforesaid in Book E Vol 8 Page 157 did grant all ______ aforesaid Five hundred and fifty five acres of and unto ________ Walton of Bilberry in the County of philadelphia aforesaid ______ and the said William Waltons by Indentures of lease and ________ Dated the 20th & 21st Days of January Recorded at philadelphia in Book F Vol 9 page 139 Did Grant two hundred acres __________ thereof unto Isaac Walton Eldest Son and Heir of the said ________ Walton And the said Isaac Walton and Sarah his Wife by Indenture of the 24th Day of September Annoq Dom _____ Died grant fifty acres part thereof unto Thomas Potts of ___________ in the County of Bucks and the said Thomas Potts Indenture of the 1st day of January Annoq Domi 1754 ________ grant the abovesd fifty acres of land unto his Son the _______ Joshua Potts and Whereas the Sd Isaac Walton and _____ his Wife by their Indenture of the 31st day of March _____ Dom 1755 Did Grant unto the said Joshua Potts Eighty ____ acres and forty perches of the aforesd two hundred acres ______ the said Isaac Walton and Sarah his wife by their Indenture of the 3d Day of March Anoq Dom 1752 Did ____ unto the said Joshua Potts the just proportion and Quantity of thirty two Acres of Land and by Indentures of the 2d Day May Anno Domi 1753 Did also Grant unto the Sd Joshua Potts the just proportion or Quantity of Seventy Eight acres and forty three perches of Land which said thirty two acres and the Sd seventy eight acres was granted to the said Isaac Walton by Thomas Marden of Biberry in the county of ________ Taylor in Exchange for other land as by his Indenture the 31st day of October Annoq Domi 1748 reference being unto had may more fully and at Large appear and so said Deced Joshua Potts became seized of __________ in Lands and Premises as by the said ______________ ance being thereunto had may more _______________ and being so thereof seized made _______________________ in Writing whereby he Nominate _________ ____________________________ in Writing whereby he Nominate ____________________ his beloved Wife Ann Potts & ________________________ authorizing them to sell ________________________________ and Tenements in the ________ _______________________________________________________________ authorize and empower my sd Executors also to sell and dispose of all and Singular my Messuages Lotts Lands and Tenements whatsoever and wheresoever to be bound and under their Hands and Seals to Convey assine and __________ all or any of the said Messuages Lotts Lands and Tenements until such person or persons as shall of them purchase the same etc as by the said recited Will bearing Date the 19th Day of September annoq Domi 1755 since the Death of the testator Duly proved and recorded in the Register Generals Office at Philadelphia Reference being thereunto had may more fully and at large appear now this Indenture Witnesseth that the aforesaid Ann Potts and Joseph Hart by Force and Virtue of said Will and Testament and the Power and authority thereby to them granted and for and in Consideration of the Sum of Eleven hundred and Sixty Pounds to them in hand well and Truly paid by the sd William Folwell the receipt whereof of the Said Ann Potts and Joseph Hart doth Hereby acknowledge and thereof and therefrom doth acquit and Discharge the said William Folwell his Heirs and Assigns by these presents Have granted Bargained Sold aliened Enfeoffed released and Confirmed and by these presents do absolutely grant Bargain Sell alien Enfeoff release and confirm unto the said William Folwell and to his Heirs and assigns for Ever the just proportion or Quantity of one hundred and ninety six acres of land and one hundred and twenty eight perches of the lotts and Lands aforesd Beginning at a corner of the Widdow Waltonís Lott Residence part of the aforesaid 300 acres extending thence by the same South forty one degrees and Ten Minutes West forty perches and four Tenths to a Corner in the Road Dividing this form Thomas Penningtons and thence along the said Road South forty Seven Degrees & forty minutes East fifty seven perches and Six Tenths to a Stone set for a corner thence North forth two degrees & twenty Minutes East Eighty Seven perches to a corner of a Lott intended shortly to be granted to John Bond thence by the same North Sixty Nine degrees West Eleven perches & one tenth to a Maple Tree and North fifty four Degrees and twenty five minutes West thirteen perches and for tenths to another Corner of the said Lott thence by the same North 43 Degrees & 25 minutes East sixteen Perches and two tenths to a corner in the Line of David Thomas Lott thence by the same North forty Nine Degrees West eight perches & Eight tenths to a Corner of Said Lott thence by the same North 42 _________ and 35 minutes East 18 perches to a Corner in Hersham Road thence up the said Road by the Mill Race and Dam the several courses thereof to a Corner of Adamss Land thence by the same South forty Two Degrees and Twenty five minutes West one hundred and Eighty Nine perches to a Corner in the Line of Bamís Land in the fist mentioned Road thence along the Middle of the same south forty Seven degrees and forty minutes East 86 perches to a corner of the Widow Waltons Lott aforesd thence by the same North forty two Degrees East forty perches and four tenths to another corner of said Lott thence by the same south forty seven degrees & forty five minutes East Forty perches and four tenths to the first mentioned corner the place of Beginning containing one hundred and ninety Six acres of Land and one hundred and Twenty eight perches or be the same more or less together also with all and Singular the buildings orchards Fields Meadows Gardens Ways Woods Waters Water Courses Rights Liberties privileges Hereditaments and appurtenances and the Reversions Remainders Rents Issues and Profits thereof To have and to hold the said one hundred and Ninety Six acres and one hundred and Twenty Eight perches of Land Hereditaments and Premisses hereby granted or mentioned to be granted with the appurtenances as unto the said William Folwell his Heirs and assigns to the only proper use Benefit and Behoof of him the said William Folwell his Heirs and Assigns for Ever under the proportionable _______ of the __________ proprietary Quit Rent hereafter accruing on the same to the chief Lord or Lords of the Fee thereof and the said Ann Potts for her self her Heirs Exer & Adms doth covenant and promise and Grant to and with the said William Folwell his Heirs and Assigns by these presents in manner following that is to say that for the said An Potts and her Heirs the said described Tract of land Hereditament an Premisses hereby Granted or mentioned so to be with the appurtenances to the sd William Folwell his Heirs & Assigns against her the said Ann Potts and her Heirs and against the Heirs of him the said Joshua Potts respectively and against all and every other Person and persons whatsoever lawfully claiming or to claim any Estate Right tight or Interest of in or to the Lands and Premises hereby granted or mentioned so to be with the appurtenances by from or under her them or any of them shall and will warrant and forever defend by these presents and the said Joseph Hart for himself his Heirs Exrs & admi doth covenant promise and grant to and with the sd William Folwell his Heirs and assigns by these presents that he wit said Joseph Hart have not done committed or Wittingly or willingly suffered any act matter or thing whereby the premisses hereby granted or mentioned to be Granted with the appurtenances or any part of parcels thereof is shall or may be impeached or incumbered in Title charge or Estate or otherwise In Witness whereof the Parties abovesaid have hereunto set their Hands and Seals Dated the Day and Year first above written Ann Potts
