This Indenture Made the Sixth Day of July in the Year of our Lord One Thousand seven hundred and fifty four Between Thomas Tilbury of the City Philadelphia in the Province of Pennsylvania Baker (who intermarried with Ann Warner lately deceased by whom he had Issue to wit One Daughter named Elizabeth Tilbury a minor under age which said Ann was one of the Daughters of Issac Warner late of Blockley Township in the County of Philadelphia Yeoman Deceased) Guardian Legally appointed (page 560) to the said Elizabeth Tilbury and also to Jacob Warner Arnold Warner, Susanna Warner and Jane Warner Sons and Daughters of John Warner late of the said Township deceased who was Eldest Son of the said Isaac Warner deceased Isaac Warner another of the Sons of the said Isaac Warner deced now a minor by his Guardian Legally appointed to wit Richard Parker of the said City of Philadelphia Taylor James Sherret of the Northern Liberties of Philadelphia Cordwainer and Susanna his Wife late Susanna Warner one of the Daughters of the said Isaac Warner deceased Jacob Widdos of the said Township of Blockley Cordwainer and Jane his Wife late Jane Warner another of the Daughters of the said Isaac Warner deceased Jacob Walker of the City of Philadelphia Mason and Elizabeth his Wife late Elizabeth Warren another of the Daughters of the said Isaac Warner deced Lydia Warner of the said Township of Blockley Spinster another of the Daughters of the said Isaac Warner deced and Margaret Warner a Minor under age by her Guardian legally appointed to wit William Peters of the said City of Philadelphia Esquire the said Margaret being another of the daughters of the said Isaac Warner deceased of the one Part And Arnold Warner of the said Township of Blockley Yeoman one of the Sons of the said Isaac Warner deceased of the other Part Whereas at an Orpans Court held at Philadelphia in the province of Pennsylvania the Seventh day of December in the Year of Our Lord 1753 before Thomas Lawrence, Joshua Maddox, Septimus Robinson and William Coleman Esquires Justices of the same Court the said Tilbury Joab Walker and Elizabeth his Wife and James Herret and Susanna his Wife exhibited their Petition to the said Court Setting forth That the said Isaac Warner the father died intestate seized in his Demesne as of Fee of and in A Certain Messuage Plantation or Tract of Land Situate Lying and being in the said Township of Blockley Containing one Hundred and Eighty Six Acres or thereabouts and that the said Intestate was Indebted at the time of his Death to Sundry Persons in Divers Sums of Money which in order to discharge Veronica Warner Widow & Relict of the said Isaac Warner deceased by order of the Orphans Court Sold and Conveyed Seventy Six Acres Part of the said Plantation unto Matthew Hall for the Consideration of Two Hundred and Twenty Eight Pounds which Together with the Personal Estate amounted to and discharged all the Intestates Just Debts That the said Petitioners Prayed that a Partition might be made of the Remainder of the said Intestates Estate amongst the Children (page 561) of the said Intestate humbly praying That the Court would appoint proper Person to make Partition of the same according to the Laws and Constitutions of the said Province in such behalf made and Provided And Whereas afterwards to wit the seventeenth day of the same month December before the Justice of the said Court It was Ordered By consent and approbation of all the Parties concerned & That Hugh Evans Richard George, James Jones, Jacob Dubroy, Robert Lloyd and Robert Jones should go to the said Plantation Tract of Land and Premisses and make an Estimate of the full Value of the same and having true respect to the Value The same into Eleven Equal Parts to cause to be parted and divided according to the several Rights and Interests therein and assign and deliver each their respective Dividends to hold to them their Heirs & Assigns in severalty forever And that they should make report of their doings to the Next Orphans Court And Whereas at an Orphans Court held at Philadelphia the Eighth day of March 1754 before the Justices of the same Court the said Hugh Evans, Richard George, James Jones, Jacob Dubroy Robert Lloyd and Robert Jones reported That pursuance to the said Order to them directed They had viewed the said Plantation or tract of Land and Premisses and that it was not practicable for them to divide the same into Eleven Equal Parts without Manifest Injury and Wrong to some of the Parties Concerned and that they had also valued and Appraised the said Plantation and Premisses to be Worth the sum of Three Hundred and Fifty two Pounds lawful money of Pennsylvania according to the best of their skill and Judgement And Whereas upon Reading the said Report and Mature deliberation being thereunto had, some objections being made by the said Veronica Warner thereto It was Ordered by the said Court That one Third part of the said Plantation or Tract of Land should be Surveyed for the Use of the said Veronica Warner to hold to her the said Veronica Warner for and during her Natural Life And Whereas at an Orphans Court held at Philadelphia aforesaid the fifth day of June last past the said Valuation or Appraisment was by the said Court Approved of and Confirmed and as it appeared to the Justices of the said Court that the said Plantation or Tract of Land and Premisses could not without Manifest Injury to some of the Parties Concerned be Divided into Eleven equal Parts or Shares as before directed It Was ordered by the said Court and consented and agreed to by and (page 562) Between all the Parties concerned That the said Arnold Warner Party thereto should take the said Plantation Tract of Land and Premisses at the Appraisment Paying the several Heirs or their Representatives their Respective Shares or Proportions which of Right to them and Each and every of them according to the Laws of the said Province belong as in and by the said several recited Orders and Proceedings remaining in the Records of the Orphans Court aforesaid in Book D Relation being thereunto had may more fully and at large Appears. Now This Indenture Witnesseth that the said Thomas Tilbury as Guardian to the said Elizabeth Tilbury and also as Guardian to the said Jacob Warner Arnold Warner Susanna Warner and Jane Warner Sons and Daughters of the said John Warner deceased Isaac Warner by his Guardian Richard Parker James Skerret and Susanna his Wife, Jacob Widdos and Jane his Wife Joab Walker and Elizabeth his Wife Lydia Warner and Margaret Warner by her Guardian William Peters for & in Consideration of the sum of Three hundred and fifty two Pounds lawful money aforesaid to them in hand paid or Secured to be paid according to their respective shares and Proportions as aforesaid by the said Arnold Warner Son of the said Isaac Warner deceased his Heirs and assigns by these Presents Have and each and every of them hath granted bargained Sold Aliened enfeoffed released and Confirmed and by these presents Do and each of them Doth grant bargain sell alien enfeoff release and Confirm unto the said Arnold Warner Son of the said Isaac Warner deceased All that Plantation Piece of Pieces of Land Situate Lying and being in the said Township of Blockley in the County of Philadelphia Beginning at the Bank of the Schuylkill on being the Corner of a Part of the said Intestates Plantation sold to Matthew Hall and Extending thence by the said Land of Matthew Hall South fifty three Degrees West Thirty Six perches to a Stone and West Two hundred and Seventy two perches to a Stake thence by the Land late of John Warner deceased North West seventy six perches and a half to a Stake thence East to the South West Corner of a piece of Ground Part of this Plantation purchased by the said Isaac Warner deceased of Thomas Parsons thence North North East Eighty Perches to a Stone thence by the Land of William Cooch East South East fifty three Perches to a Gum near a small Run South South West Sixty Perches & East Eighty five Perches to the Road Leading up Schuylkill thence along the same North seven degrees East Thirty one Perches and North four Degrees East forty Eight Perches and five Foot thence (page 563) by meadow formerly of Edward Roberts now of the said William Cooch East South East fifty five Perches to the Edge of Schuylkill aforesaid and thence down the same by the several Courses thereof to the place of Beginning Containing one hundred and ten Acres of Land Be the same more of less or however butted bounded lying or being (On being Part and Parcel of the said one Hundred and Eighty six Acres of Land which the said Isaac Warner died Seized and possessed of as aforesaid) Together with all and Singular the Ways Woods Waters Islands Water Courses Rights Liberties Privileges Messuages Buildings Gardens Orchards Lights Easements Fishings Fishing places Stone Tuarries Path Passages Profitts Commodities Advantages Emoluments Hereditaments and Appurtenances whatsoever to the said Plantation Piece or Pieces of Land Hereditaments and Premisses hereby granted or mentioned to be granted with the Appurtenances belonging or in any wise Appertaining and the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof And also all the Estate Right Title Interest Property Shares parts purparts Claim and Demand whatsoever in Law and Equity of the said Elizabeth Tilbury, Jacob Werner Arnold Warner Susannna Warner and Jane Warner Sons and Daughters of the said John Warner deceased Isaac Warner, James Skerret and Susanna his Wife Jacob Widdos and Jane his Wife Joab Walker and Elizabeth his Wife Lydia Warner and Margaret Warner or any or either of them of in or to the said Plantation piece or pieces of Land and Premisses and of in and to every part parcel, and member thereof To Have And To Hold the said Platation piece or Pieces of Land Hereditaments & Premisses hereby granted or mentioned so to be with the Appurtenances to the said Arnold Warner Son of the said Isaac Warner deceased his Heirs and Assigns to the only proper use and Behoof of him the said Arnold Warner Son of the said Isaac Warner deceased his Heirs and Assigns for ever Under and Subject to the proprietary Quit rents hereafter accruing and becoming due for the same to the Chief Lord or Lords of the Fee thereof And also under and Subject to the said Veronica Warners Right of Dower or Thirds of in and to the said Plantation piece or pieces of Land and Premisses (according to the said order of the (page 564) Orphans Court) for and during her Natural life And the said Thomas Tilbury for himself [and as] Guardian to Jacob Warner, Arnold Warner, Susanna Warner and Jane Warner Sons and Daughters of the said John Warner deceased Isaac Warner James Sherret and Susanna his Wife, Jacob Widdos and Jane his Wife, Jacob Walker and Elizabeth his Wife, Lydia Warner and Margaret Warner and every of them for him her and themselves Severally and Respectively and Not Jointly or one for the other their and every of their Heirs the said Plantation Piece or pieces of Land Hereditaments and Premisses hereby granted or mentioned so to be with the Appurtenances unto the said Arnold Warmer Son of the said Isaac Warner deceased his Heirs and Assigns against them the said Elizabeth Tilbury Jacob Warner, Arnold Warner Susanna Warner and Jane Warner Sons and daughters of the said John Warner deceased Isaac Warner James Skerret and Susanna his Wife Jacob Widdos & Jane his Wife, Joab Walker and Elizabeth his Wife Lydia Warner and Margaret Warner and their Heirs respectively and against all and every other Person and Persons whatsoever lawfully claiming or to Claim by from or under them or any of them (Veronica Warners Right of Dower or thirds aforesaid during Life excepted) shall and will warrant and for ever defend by these presents And the said Thomas Tilbury for himself and the said Elizabeth Tilbury and for the said Jacob Warner Arnold Warner Susana Warner and Jane Warner (Sons and Daughters of the said John Warner deceased) and for their Heirs Exectors and Administrators respectively Isaac Warner for himself his Heirs Executors and Administrators James Skerret for himself and Susanna his Wife their Heirs Executors and Administrators Jacob Widdos for himself and the said Jane his Wife their Heirs Executors and Administrators the said Lydia Warner for herself her Heirs Executors and Administrators and the said Margaret Warner for herself her Heirs Executors & Administrators do and each of them doth Jointly and Severally covenant promise and Grant to and with the said Arnold Warner Son of the said Isaac Warner deceased his Heirs and assigns by these Presents That the said Elizabeth Tilbury, Jacob Warner Arnold Warner Susanna Warner and Jane Warner Sons and Daughters of the said John Warner deceased Isaac Warner James Skerret and Susanna his Wife Jacob Widdos and Jane his Wife Joab Walker and Elizabeth his Wife Lydia Warner and Margaret Warner and every of them, theirs & (page 565) every of their Heirs respectively and all and every other Person and Persons whomsoever lawfully Claiming or to Claim at any time or times hereafter any Estate Right Title or Interest of in or to the said Plantation Piece or Pieces of Land or any Part or Parcel thereof by from or under them or any or either of them (except as before excepted) shall and Will at any time or times hereafter upon the reasonable request Cost and Charges in the Law of the said Arnold Warner Son of the said Isaac Warner deceased His Heirs and Assigns make execute and acknowledge or cause so to be all and every such further and other reasonable Act and Acts Deed or Deeds Device or Devices in the Law whatsoever for the further and better Assurance and Confirmation of the said Plantation Piece or Pieces of Land Hereditaments
