All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Betty-Lu Burton bigburma@juno.com January 19, 2011, 7:02 pm Written: April 5, 1809 Recorded: June 15, 1809 (1) Dillaplain Ridgway et ux to Mary Coulter Philadelphia County, PA Land Deeds Deed Book I C Vol 1 page 527-529 Dated 5 Apr 1809; Recorded 15 June 1809 FHL# 21960 This Indenture made the Fifth day of April in the Year of our Lord one thousand eight hundred and nine Between Dillaplain Ridgway of the City of Philadelphia, Bricklayer, and Dorothea his wife of the one part and Mary Coulter of the said City, Widow of Joseph Coulter deceased of the other part Witnesseth that the said Dillaplain Ridgway and Dorothea his wife for and in consideration of the sum of of Fifteen hundred and Seventy five dollars lawful money of the United States to them in hand paid by the said Mary Coulter at the time of the Execution hereof the receipt whereof is hereby acknowledged have granted bargained sold released and confirmed and by these presents do grant bargain sell release and confirm unto the said Mary Coulter her heirs and assigns A certain lot or piece of ground and brick building thereon Situate on the North side of Pine street at the distance of Seventy four feet nine inches Eastward from Delaware second street in the said City, Containing in front or breadth on the said Pine Street Eight feet nine inches and in length or depth Northward Eighty feet including on the Eastern side thereof one-half of an alley two feet six inches wide and thirty seven feet in length leading into Pine street, Bounded Southward by Pine street Eastward by a lot of ground granted to Henry Bell on Ground Rent Northward by ground formerly of Joseph Marshall Westward by ground devised to Charles Roberts, Together with the free use and priviledge of the said alley as a passage and water course at all times forever in Common with the owners and tenants of the other lot adjoining thereto and full liberty of building under and over the Westmost moiety of said alley to the depth of thirty four feet from Pine street ?ing at least eight feet headway in the {clase?} (Being {cannot read} of ground which George Roberts by Indenture dated the Twenty eighth day of May Anno Domini one thousand eight hundred and Seven Recorded in Deed Book E. F. No. 26 Page 662 Vc granted unto the said Dellaplain Ridgway in fee Simple Paying therefor unto the said George Roberts his heirs and assigns the yearly rent or lease of Thirty five silver milled dollars lawful money of the United States of America in half yearly payments to pay on the first days of March and September in each and every year for ever without any deduction defalcation or abatement for any taxes charges or assessments whatsoever. As in and by the said recited Indenture among Sundry covenants clauses and agreements therein contained wilt fully appear) And Together with all and singular the buildings improvements ways alleys passages waters water courses rights liberties privileges hereditaments and appurtenances whatsoever unto the said hereby granted premises belonging or in anywise appertaining and the reversions remainders rents issues and profits thereof And all the Estate Right Title Interest Property Claim and Demand whatsoever of him the said Dillaplain Ridgway and Dorothea his wife as well at law as in Equity of in to and out of the Same. To Have And To Hold the said described lot or piece of ground buildings hereditaments and premises hereby granted with the appurtenances unto the said Mary Coulter her heirs and assigns To and for the only proper use and behoof of the said Mary Coulter her heirs and assigns for ever. Under and Subject to the aforesaid yearly rent or sum of Thirty five dollars such as aforesaid, so as the same from and since the first day of March last past hath accured and shall hereafter accure and become payable unto the said George Roberts his heirs and assigns in half yearly payments without any deduction or abatement for taxes or assessments as above mentioned. And Subject to all the covenants clauses and agreements in the said recited Indenture contained which on the part of the said Dillaplain Ridgway his heirs and assigns ought to be performed observed and kept, But free and clearly acquitted and discharged off and from all mortgages Judgments liens arrears of ground rent and taxes or other incumbrances whatsoever. And the said Dillaplain Ridgway for himself his heirs executers and administrators doth hereby covenant promise and agree to and with the said Mary Coulter her heirs and assigns that he the said Dillaplain Ridgway and his heirs all and singular the hereditaments and premises hereby granted with the appurtenances unto the said Mary Coulter her heirs and assigns Under and Subject but free and clear as aforesaid, against him the said Dillaplain Ridgway and his heirs and against all and every other person and persons whomsoever lawfully claiming or to claim by from or under him these or any of these shall and will warrant and forever defend. In Witness whereof the said parties have interchangeably set their hands and seals hereunto. Dated the day and year first above written. Sealed and delivered In the presence of us T. Mitchell Dillaplain Ridgway {seal} Jacob Baker Dorothea Ridgway {seal} The fifth day of April Anno Domini 1809 Before me, the Subscriber one of the Alderman of the City of Philadelphia, came the above named Dillaplain Ridgway and Dorothea his wife and acknowledge the above written Indenture to be their act and deed and desired the same may be recorded as such the said Dorothea being of full age and by me privately examined apart from her husband declared that she executed the said Indenture voluntarily without any compulsion and the full contents thereof first made known to her.
